Dear Mr. and Mrs. Boswell:
This is the second letter to notify you that your property being used as a construction contractor
yard for your paving business is not allowed. A letter was sent out on May 11,2000(enclosed)
instructing you to cease your business on the above-mentioned parcel. From a recent complaint
and site investigation, it was apparent that you did not comply with the first notice by the large
trucks and piles of fill located on the parcel.
According to the Mason County Comprehensive Plan Development Regulations, Parcel No.
12221 14 90014 is located within the Rural and Resource Land Designation. The Comprehensive
Plan is to preserve the character of the rural lands by not allowing uses that are out of scale or
dissimilar to rural residential, farm and forest uses. A construction contractor yard does not fit
with the character of the Rural and Resource Lands. A construction contractor yard is only
allowed in Urban Growth Areas and Rural Activity Centers.
Action required within 30 days:
Cease use of property that is not compatible with the Mason County Comprehensive Plan
Development Regulations. Remove construction equipment and other construction materials
from parcel.

property, Parcel No. 12221 14 90014,as a construction contractor yard for your paving business
is not allowed.
It is my understanding,that after receiving the letter, you spoke to Mr. Salzer,the Planning
Department Director at the time. You stated to him that you would to sell the property and move
to an area where your business is allowed. It was his decision to not take further action at that
time to allow you a reasonable period in which to do so. It has been nine months since you
received the first letter advising you of your business's incompatibility with the other surrounding
land uses. From a recent complaint and site investigation, it was noted that you do have the
parcel up for sale but it is apparent that you have not ceased operations by the large trucks and
piles of fill located on the parcel.
The Planning Department is concerned with the impact that your business is having on the
surrounding community. We would like to know what your intent is regarding ceasing operations

Dear Mr. and Mrs. Boswell:
This letter is to notify you that the Mason County Planning Department is aware that the use of
this property is no longer of the rural residential character as called for in the Mason County
Comprehensive Plan. The residence and garage structures approved for this property in 1998
and 1999 are allowed land uses, but the use of the property as a contractor yard for your
asphalt paving business is not allowed.
According to the Mason County Comprehensive Plan Development Regulations (noted in
Figure 1.03.020), a construction contractor yard is only allowed in the designated Urban
Growth Area and Rural Activity Area locations in the county, such as Allyn, Grapeview, or
Belfair. This type of land use is of the same intensity (type 5) as vehicle sales and repairs,
boat yards, mobile homes sales, light industrial, and wholesale businesses. Such uses create
increased traffic of large-sized vehicles, and are out of scale and too dissimilar to rural
residential uses like single-family homes on larger parcels or farm/forest/vacant lands away
from community services, as in the area of Victor Road.
The parking / storage of large contractor business trucks, in greater number than drivers
residing on the property, and the associated business equipment are the types of uses that are
not incidental to the primary use of the property, single-family residential land use. Your
present use is contrary to the building permit condition initialed by Kitty Boswell on June 22,
1999 when the building permit for the garage was issued:
"The applicant acknowledges that this structure is to be used as an accessory residential
use to the single-family residence approved in December 1998. The applicant shall
comply with the policies and regulations stated in the Mason County Comprehensive
Plan and development regulations."

An applicant is obliged to meet their conditions of approval when issued a Mason County
building permit. You acknowledge this condition by signing the permit. The use of the
property as a contractor yard for your asphalt paving business does not comply with this
condition, as well as not being in compliance with the Development Regulation standards as
noted previously.
To correct this violation, you will need to relocate your contractor yard for an asphalt paving
business to a property within the designated Urban Growth Area and Rural Activity Area
locations in the county, such as Allyn, Grapeview, or Belfair. Once you have selected a site,
you shall contact Michael MacSems in the Mason County Permit Assistance Center (in Shelton
or at 360-427-9670, ext. 281) and arrange for a pre-submission meeting for a proposed
contractor yard for your asphalt paving business. These actions shall take place within a
reasonable amount of time by July 15, 2000.
You should be aware that this letter is precipitated by several complaints that we have received
regarding the activities that we have addressed in this letter. We are obligated to respond to
those complaints and to assure all of the affected residents that the land uses are compatible
and in compliance with applicable regulations. If you have questions on this matter, you may
