BOX 578 of �o 1864 SHELTON,WA 98584 • (360) 427-9670 AUGUST 14, 1996 TO: Alan Tahja, Public Works FROM: .Allan Borden, Community Development /#,& RE: Review of Grading Permit (GRD96-0024) I am enclosing a copy of a grading permit for Delancey Woods on Old Belfair Highway; he is proposing to use 3000 cu. yds. of fill to create a level building site on a parcel which has wetland soils and has been ditched without a permit two years ago. Several issues need consideration: a) as a condition to the SEPA review, Mr. Woods needs to verify that a septic system can be placed on the property. For a site to be found, setbacks from the wetland must be followed (75 to 100 feet, depending on the type of septic system used); a proposed building would need to meet the 65 foot development setback from the edge of the wetlands. If a septic system is not possible, then the need for creating a building site is gone and the fill of the property should not proceed. b) if Mr. Woods fills the unpermitted ditches, water runoff on the property will still proceed to the south as it did a couple of years ago. The attached letter of comment from a neighbor expresses the concerns for resuming the runoff and for presenting a stormwater plan for Mr. Woods' property. It should be possible to arrive at a solution that allows water in the area to still flow southwesterly onto the Matijevich property. It appears that the fill may be 7 to 8 feet high to occupy 11,500 sq. ft. of area and be filled by 3000 cu. .yds. of material; I feel that the final area to be filled may need to be staked on the property so that potential problems are eliminated. The applicant will have to do some replanting of trees and shrubs cleared off the property in 1994, and this revegetation may affect the dimensions of the fill area. Please review this information and send your comments back to me. I can add any conditions that you feel are needed. Department of the Army regulations dated July 27, 1995, authorize the discharge of dredged or fill material for a single- family home under this nationwide permit, provided all general conditions are met . The entire text of Nationwide Permit 29 and conditions are enclosed. As discussed with you during our site inspection on December 13 , 1995, you are also required to restore the unauthorized ditches in wetlands and allow the remaining 0 . 5 of an acre of wetlands that had been land cleared to revegetate (drawing enclosed) . In addition, for Nationwide Permit 29 to be valid, you must obtain approval from the State . You must obtain 401 Water Quality Certification and Coastal Zone Management Consistency Determination from the State . You may use the enclosed sample letter as your application to the State . Once you have received approval from the State, the work is authorized by Nationwide Permit 29 . This verification of a nationwide permit will be valid for a period of two years from the date of this letter or until the nationwide permit is modified, reissued, or revoked. This nationwide permit is scheduled to expire January 21, 1997, but is expected to be reissued. SUBJ: Grading Review Comments NAME: Delancey Woods Allan, Public Works review of the Delancey Woods grading/Land Modification Permit application, raises two issues that appear to have been overlooked, or not adequately addressed. One issue is alluded to in your cover letter regarding building and drainfield setbacks . It appears impossible to site a building on any portion of the proposed fill, and maintain a 65 foot building setback from the wetland boundary. The second issue is the siting of a building on fill material. No information is provided pertaining to the receiving soil, its competency, or that the grading (fill) is to be performed under the direction of an engineer. If the fill site is expected to support a structure, then the fill should be conducted as an engineered fill, and the proponent should be required to provide a letter from his engineer certifying the integrity of the completed grading, and its adequacy for foundation bearing purposes . Compaction testing results should also be requested to document the fill' s conformance to grading standards for structural fill . As structural fill, the proponent may need to remove some of the existing material to provide a stabile subgrade to build up from. Specifically the surface rater that cascades onto my property from the ditch that the Corp.- of En-ginaers is M requiring to be filled in. There is now a "channel" in ivhiclh the surface water flows into the "wetland" on my property. The paint at which this surface water enters the "wetland" on my property is crucial to my wetland, environmental ; easement, pond and stream that terminates in the Union River on tami.iy propettc,. I am prepared to work with Mr. Woods to maintain this topographical point, as I have an ongoing project with USDA Soil Conservation Service for the t 't purfioses of fish enhancement. 2. Erosion has to be addressed. The Codas requires -ou replace the fill E r (.i.e. ditches dug in 1994) proper measures have to be put ii-i place so silt does not.flow onto my property. ` 3. In Kitsap County a surface water plan is required and the surface water must be disposed of on your own property.
