We reviewed the environmental checklist and have the following comments: Any land use within critical areas and buffers should be protective of water quality. Dear Nationwide Permit Applicant: Ecology has reviewed the Corps of Engineers' recent letter to you authorizing an after-the-fact placement of 0.264 of an acre of fill, at the above address, under a Nationwide Permit 29. Your proposed work complies with the State requirements for this Nationwide Permit, and is considered valid by the state of Washington, including the condition that the location of your project is not habitat for sensitive, threatened, or endangered species. This letter serves to verify that your project may proceed under the terms described in the letter from the Corps of Engineers; and is considered the individual 401 Water Quality Certification for this project. Due to the nature of your project, you may not need a shoreline permit; however, you must still contact the local authority to ensure you are complying with all Shoreline Management Act requirements. Please note this Letter of Verification does not exempt, and is provisional upon compliance with other statutes and codes administered by federal, state and local agencies. BOX 3755 SEATTLE, WASHINGTON 9 8 1 24-2 25 5 REPLY TO ATTENTION OF Regulatory Branch Mr. Delancy Woods 3200 Southwest Lake Flora Road Port Orchard, Washington 98366 Reference : 95-4-02237-ATF Woods, Delancy Dear Mr. Woods : I have determined that Nationwide Permit 29 authorizes the placement of 0 . 264 of an acre of fill for your project, located along Old Belfair Highway, near Belfair, Mason County, Washington. Department of the Army regulations dated July 27, 1995, authorize the discharge of dredged or fill material for a single- family home under this nationwide permit, provided all general conditions are met . The entire text of Nationwide Permit 29 and conditions are enclosed. As discussed with you during our site inspection on December 13 , 1995, you are also required to restore the unauthorized ditches in wetlands and allow the remaining 0 . 5 of an acre of wetlands that had been land cleared to revegetate (drawing enclosed) . In addition, for Nationwide Permit 29 to be valid, you must obtain approval from the State. You must obtain 401 Water Quality Certification and Coastal Zone Management Consistency Determination from the State. You may use the enclosed sample letter as your application to the State . Once you have received approval from the State, the work is authorized by Nationwide Permit 29 . This verification of a nationwide permit will be valid for a period of two years from the date of this letter or until the nationwide permit is modified, reissued, or revoked. This nationwide permit is scheduled to expire January 21, 1997, but is expected to be reissued. The verification will remain if not modified or your proposed work complies with any subsequent modification. 2 - If additional work is contemplated in this area which involves excavation, filling, grading, or mechanized land clearing of wetlands, you should consult with our office to determine if you will be required to obtain an individual Department of the Army permit . Nothing in this letter shall be construed as excusing you from compliance with other Federal, State, and local statutes, ordinances, and regulations which may pertain to this work.
