Wetlands The study area was evaluated for wetlands using methodology from the Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Western Mountains, Valleys,and Coast Region Version 2.0(Regional Supplement)(US Army Corps of Engineers [Corps]May 2010).Wetland boundaries were determined on the basis of an examination of vegetation,soils,and hydrology.Areas meeting the criteria set forth in the Regional Supplement were determined to be wetland.Soil,vegetation, and hydrologic parameters were sampled at several locations along the wetland boundary to make the determination. Identified wetlands within the property were classified using the 2014 Update to the Western Washington Wetland Rating System(Publication#14-06-029)(Rating System). Streams The study area was also evaluated for streams based on the presence or absence of an ordinary high water mark(OHWM)as defined by the Revised Code of Washington (RCW)90.58.030 and the Washington Administrative Code(WAC)220-660-030.The OHWM edge was located by examining the bed and bank physical characteristics and vegetation. Onsite streams were classified using the stream typing system established by WAC 222- 16-030,per Mason County regulations. Study Area The study area includes the northeastern corner of the property that is within approximately 250 feet of the proposed tower location(Figure 1).Wetlands and streams within this study area of the subject parcel were delineated. Areas outside the parcel were screened at a reconnaissance level from the parcel boundaries and the right-of- way. Findings The subject parcel is located in the Case Inlet basin of Watershed Resource Inventory Area(WRIA) 15:Kitsap;Section 21,Township 22N,Range 01W.The property is zoned Rural Residential 5 acres and is designated Forest Land.The study area portion of the parcel is undeveloped and does not contain any structures.The topography of the subject parcel generally slopes down to the south;a gently sloped ravine containing a seasonal stream is located within the western half of the study area.Upland vegetation is characterized as a mixed deciduous/coniferous forests(see'Non-wetland Areas'). Mason County GIS,NWI,and PHS do not document the presence of wetlands within the subject parcel.The stream is mapped by Mason County GIS,FPARS,NWI,and SalmonScape.None of the aforementioned sources document the presence of fish, salmonid or otherwise,within the stream.According NRCS WETS,the month of May would be considered having wetter than normal precipitation.WSS records soils within the study area as Alderwood gravelly sandy loam,8 to 15 percent slopes and Sinclair shotty loam,5 to 15 percent slopes. Wetland and Stream Delineation Report Tyler Clouse Summit Solutions May 22,2017 Page 4 Within the study area,one stream and one wetland were identified on-site,and one wetland was identified off-site.Just south and outside the study area, a second wetland was identified;since the largest Mason County buffer would not encumber the tower site,this wetland is not discussed further in this report(see wetland and stream delineation sketch). Stream A Stream A is a seasonally flowing stream located within the ravine.The stream generally flows south,connecting to an unnamed,fish-bearing stream south of the parcel,which outlets into Puget Sound's Case Inlet.Defined stream characteristics,such as evidence of scour were first observed approximately 20 feet south of Wetland A.Within the study area,Stream A completely infiltrates in several areas where all bed,bank and OHWM characteristics are lacking.Within the study area,the stream channel ranges from two to four feet wide with an average depth of less than six inches and consisting of a gravel and sandy substrate.At the time of the visit,flowing water was only visible in a few sections within the study area.FPARS maps this stream as a Type N,which is confirmed by observations of natural fish migration barriers(infiltration). Wetland A Wetland A is a small depressional/slope wetland with a scrub-shrub Cowardin vegetation class(Figure 2).It is located along East Victor Road within the ravine. Common vegetation within the wetland includes salmonberry and Dewey's sedge. Hydric soils meet indicator Redox Dark Surface(F6).Wetland hydrology was confirmed with a High Water Table(hydrology indicator(A2),Saturation(A3)and a Sparsely Vegetated Concave Surface(B8).Hydrological inputs in the wetland include runoff from the adjoining forest,culvert and road,and an occasionally ponded hydroperiod was observed.The culvert is a round,corrugated metal pipe and one foot in diameter. Non-wetland Areas Areas outside the ravine are characterized as upland mixed deciduous/coniferous forests,consisting largely of bigleaf maple,western hemlock and Douglas-fir in the canopy with snowberry,salmonberry,huckleberry,beaked hazelnut,Himalayan blackberry,tall Oregon grape,sword fern,bracken fern, and bleeding heart in the understory(Figure 3).Within the ravine,non-wetland areas are dominated by red alder, salmonberry and sword fern.While the areas within the ravine are dominated by facultative vegetation and hydrology was observed,they were determined to be non- wetland as the soils did not exhibit any hydric soil indicators.Furthermore,presence of wetland hydrology was not reliable at the time of the visit,due to wetter than normal precipitation(NRCS WETS),and presence of surface water in other areas that do not contain hydrophytic vegetation nor hydric soils. Wetland and Stream Reconnaissance On the north side of East Victor Road,immediately east of the culvert inlet,a small ditch was observed(Figure 4).It appears that the ditch was excavated from non-wetland area or is a result of the construction of the road.The ditch is vegetated with lady fern, salmonberry,and Himalayan blackberry.Water from the ditch appears to drain through the culvert into Wetland A;flowing water was not observed the time of the visit. Local Regulations Critical areas in Mason County are regulated in Chapter 8 of the Mason County Code (MCC).Wetlands buffer widths are determined based upon wetland category,habitat score and proposed land use intensity.Low intensity land use is characterized as forestry,and open space,low-intensity uses,such as passive recreation and natural resources preservation,minor transportation improvements.A cell tower would likely be considered a low intensity land use;however,this should be verified with the County.As a Category III wetland with a moderate habitat score and low intensity land uses,the standard buffer width for Wetland A would be 110 feet(Table 1). Wetland and Stream Delineation Report Tyler Clouse Summit Solutions May 22,2017 Page 8 Stream buffers are measured horizontally from the ordinary high water mark(OHWM). A building setback of 15 feet is required from the edges of wetland and stream buffers. Minor structural intrusions into the area of the building setback may be allowed if it will not negatively impact the wetland or stream. Table 2.Summary of stream classification and buffer width. Wetland buffers may be modified through buffer averaging.Wetland buffer averaging is possible if the total area of buffer after average is equivalent to the total area before averaging;functions and values of the wetland buffer beyond what is currently in place will increase;and the buffer width will not be reduced to less than seventy-five percent of the standard buffer width. As the ditch north of Victor Road appears to be made either from non-wetland area or created as a result of construction of a road,it would not be regulated by Mason County's critical area regulations.However,if the ditch were to be regulated locally as a wetland,it appears the road would act as a significant break,interrupting buffer function to areas south of the road. State and Federal Regulations Wetlands are also regulated by the Corps under section 404 of the Clean Water Act.Any proposed filling or other direct impacts to Waters of the U.S.,including wetlands(except isolated wetlands),would require notification and permits from the Corps.Wetland A would not be considered isolated.A formal isolated status inquiry can be requested from the Corps through the Jurisdictional Determination process. Note that a new Clean Water Rule for wetlands and other Waters of the U.S.went into effect in August 2015; however,the rule was recently"stayed"nationwide by the 60,Circuit Court due to pending litigation.Therefore,the prior rule is in effect until further notice. Federally permitted actions that could affect endangered species may also require a biological assessment study and consultation with the U.S.Fish and Wildlife Service and/or the National Marine Fisheries Service. Compliance the Endangered Species Act must be demonstrated for activities within jurisdictional wetlands and the 100-year Wetland and Stream Delineation Report Tyler Clouse Summit Solutions May 22,2017 Page 9 floodplain.Application for Corps permits may also require an individual 401 Water Quality Certification and Coastal Zone Management Consistency determination from Ecology and a cultural resource study in accordance with Section 106 of the National Historic Preservation Act. In general,neither the Corps nor Ecology regulates wetland buffers,unless direct impacts are proposed.When direct impacts are proposed,mitigated wetlands may be required to employ buffers based on Corps and Ecology joint regulatory guidance.
