Mason County Environmental Policy Ordinance and Mason County Building Code. Flood Damage Prevention Ordinance. 2380 Old Belfair Highway,Belfair. Union River. Dear Ms. Sorenson: A site inspection of the subject property was conducted on May 13, 1994 in response to complaint. It was found that unpermitted fill material had been placed on the property. The placement of this fill is in violation of the Mason County Shoreline Master Program, the Mason County Environmental Policy Ordinance(SEPA), the Mason County Flood Damage Prevention Ordinance and Chapter 70 of the Uniform Building Code. You are to cease and desist further activity on-site. Fill in the amounts present on this site require a Shoreline Permit. The Union River is under the jurisdiction of the Mason County Shoreline Master Program and the Shoreline Management Act. These laws regulate development within their jurisdiction. The jurisdiction of these programs extends landward 200 feet from the edge of the floodway of the Union River. Pursuant Chapter 7.32 of the MCSMP and WAC 173-17-040, RCW 90.58.200 you are hereby ordered to remove all the fill material from the property with the exception of the material between Old Belfair Highway and the blue roofed shed. You have (20) twenty days from the date of receipt of this letter in which to comply with the removal requirement. Please contact this Department of your intent to comply within (10) ten days of receipt of this letter. If the requirements of this department are not met in a timely fashion this matter will be turned over to the Mason County Deputy Prosecuting Attorney's office for enforcement action in which case: "Any person violating any of the provisions or failing to comply with any of the mandatory requirements of resolutions or ordinances of the County is guilty of a misdemeanor. Any person convicted of a misdemeanor under the resolutions or ordinances of the County shall be punished by a fine of not more than five hundred dollars, or by imprisonment not to exceed ninety days, or by both, unless otherwise required by state law. Dear Ms. Sorenson and Mr. Broughton: A site inspection of the subject properties was conducted again on May 26, 1994 as a follow up to a conversation with Mr. Broughton. It was found that unpermitted fill material had been placed on the Broughton property as well. The placement of this fill is in violation of the Mason County Shoreline Master Program, the Mason County Environmental Policy Ordinance (SEPA), the Mason County Flood Damage Prevention Ordinance and Chapter 70 of the Uniform Building Code. You are to cease and desist further activity on-site. Fill in the amounts present on this site require a Shoreline Permit. I have enclosed the necessary information and application materials. Triple permit application fees are required, however since the fill was placed jointly on abutting properties you will not be assessed triple fees individually, if you desire you can apply for the shoreline permits jointly. Dear Ms. Sorenson: Your site has been re-evaluated and the previous administrative decision regarding the suspected violation on the property has been reconsidered. The department is evaluating the material as landscaping which is not subject to permitting under the Shoreline Master Program or the Flood Damage Prevention Ordinance. Landscaping is also exempt from the SEPA process. No further action will be taken. Thank you for patience and cooperation. Respectfully, J.
