Belfair, WA 98528-9684 RE: Site Inspection; Tax Parcel Number 12316-22-90082 Dear Mr. and Mrs. Garcia: On November 21, 2002, I conducted a site inspection on the above noted tax parcel number in response to a complaint received by the Mason County Planning Department. The complainant expressed concerns regarding tree-cutting and vegetation removal on a steep slope above Ponderosa Road. While on-site with Planner Rick Mraz, I used a clinometer to measure the slope of the hillside and determined that the slope averages 65%. I also determined that at least 12 established trees were removed from the slope and that the bare soil is exposed on the slope. The slope meets the definition of a Landslide Hazard Area as defined in Mason County Resource Ordinance section 17.01.100(A)(f),because the slope exceeds 40%. A copy of this definition is enclosed for your reference. Section 17.01.100(C)(2)provides that "permits are required for all new construction,grading, land clearing . . . within a Landslide Hazard Area or its buffer." Section 17.01.100(D)(2)(a) defines"land clearing" as the cutting or harvesting of trees or the removing or cutting of vegetation so as to expose the soil . . . To bring the site into compliance with Mason County regulations, you must submit a restoration plan that meets the requirements of Mason County Resource Ordinance section 17.01.200(I). A copy of this information is enclosed and highlighted for your reference. You will need to hire a licensed civil engineer with specialized knowledge of geotechnicaUgeological engineering or a practicing engineering geologist with special knowledge of the local conditions with at least three years of experience in landslide assessment to prepare the restoration plan. Please provide a copy of section 17.01.200(I) to your consultant to ensure that an acceptable restoration plan is prepared. The restoration plan must include a monitoring section pursuant to section 17.01.200(I)(2). Finally, you must submit a restoration bond based on a reasonable, formal estimate for the costs associated with implementation of the recommendations contained in the restoration plan. A restoration bond form is enclosed for your use. Please submit the restoration plan and the restoration bond by January 13, 2003. You will want to act immediately to allow time to hire a qualified consultant and to have the restoration plan prepared. You can consult the yellow pages in area phone directories if you need assistance in locating a qualified civil engineer or practicing geologist. If the restoration plan and bond are received by January 13, 2003, no penalties will be assessed. If the restoration plan and restoration bond are not received by January 13, 2003, a hearing date will be set. If this matter proceeds to a hearing, you may be found responsible for costs incurred by the County in addition to further fees and fines imposed. The complainants expressed concerns regarding land-clearing that has occurred on the steep slope above the end of Ponderosa Road. I observed that the slope in question appears to meet the Landslide Hazard Area criteria pursuant to Mason County Resource Ordinance section 17.01.100. I have enclosed a copy of this section for your reference (included in first class mailing only). Please review section 17.01.100. If you agree that the slope meets the Landslide Hazard Area criteria, you will need to do the following to restore the site: • Submit a restoration plan prepared by either a licensed civil engineer with specialized knowledge of geotechnical/geological engineering or a practicing engineering geologist with special knowledge of the local conditions. The restoration plan must meet all of the requirement listed in Mason County Resource Ordinance section 17.01.200(l)—highlighted for your reference. Please share a copy of the section with your consultant to ensure that the appropriate information is submitted. Incomplete plans will NOT be accepted. Please note that the plan must include a monitoring section that complies with 17.01.200(I)(2). • Submit a restoration bond pursuant to Mason County Resource Ordinance section 17.01.200(l)(3). The restoration bond form is enclosed in this mailing. The bond amount shall be based on a reasonable, formal estimate for the cost of conformance with the restoration plan. • Submit a$70 site inspection fee for investigation of a valid complaint. If you do not agree that the property meets the Landslide Hazard Area criteria identified in section 17.01.100,please contact me by November 13, 2002. I will be happy to meet with you on site to perform formal slope measurements and detailed site evaluation if you wish. A site inspection will be conducted after receipt of a$70 site inspection fee. Alternatively, if you agree that the parcel meets the Landslide Hazard Area criteria identified in section 17.01.100, please submit the above referenced restoration plan and restoration bond by November 26, 2002.
