9. Narrative
At 1901 hrs. On August 23, 2000, Deputy Pittman and I were on duty as a uniformed Deputy
Sheriff's operating a fully marked patrol vehicle in Mason County, Washington, when we were
advised of a strong chemical odor in the area of Ponderosa Dr off the Old Belfair Highway
approximately 3 miles north of Belfair. Dispatch advised the reporting paarty was Fire Protection
District #2 (FPD #2)and they had received the initial complaints. I called the Fire Department and
spoke with Bill Hunt. He told me a Hispanic subject identified only as Juan paints cars at his
residence and the odor may be associated with that activity.
At 1917 hrs. Deputy Pittman arrived in the area of Ponderosa. As we arrived I contacted a male
later identified as Gary C. Jenkins. He stated the smell was so bad he had to leave. Further he
told me the people who live at 110 NE Ponderosa frequently paint cars and this toxic odor is an
ongoing problem because the residents are not taking the proper precautions to prevent the
escape of the fumes. Jenkins went on to say this is an ongoing problem threatening the well being
of nearby residents. Deputy Pittman and I drove about two to three hundred feet up the road
where we practically overcome by fumes. I recognized the smell as similar to lacquer and lacquer

thinner. I immediately felt a headache come on so we backed out of the area. At that point we
backed out of Ponderosa to the Old Belfair Highway.
I requested dispatch to notify the on call Department of Ecology (DOE) personnel. I also
updated FPD#2 of the situation along with Sergeant Barrett. WSP Bremerton was also notified of
the circumstances.
At about 1940 hrs. DOE advised they could not respond as their personnel was on a priority
detail. I conferred with Sergeant Barrett and FPD #2 personnel. We decided to respond to the
area sending in personnel with breathing apparatus to check the area for possible injuries and to
assess the danger to other residence.
At about 2015 hrs Deputy Pittman, FPD#2 and I went back to the area.
Just after our arrival at the scene I was contacted by David A Tullar who lives at 81 NE
Ponderosa. He stated he observed a female painting a vehicle around 1700 today. Tullar said the
fumes from the operation drifted over on his property forcing him to leave his home to escape the
toxic fumes. Tullar also stated he wanted to be check by fire personnel for possible adverse effects
of the fumes.
After our arrival in the area, I instructed radio to call the resident at 110 Ponderosa, Juan Garcia-
Castallo. They were to advise him to come down to the highway to talk to officers. It took two
calls to get someone to respond as requested. Finally, Juan Garcia came to the staging area.
I contacted Juan who at first denied knowing anything about any painting. Finally he admitted his
mother Elia Garcia had been painting a car today. Juan denied being at all bothered by;th�fumes
from the painting operation.

FPD #2 dawned breathing apparatus and went to the residence where the odors were emitting
from. They contacted Elia Garcia DOB/10-21-65 at 110 NE Ponderosa. She denied painting any
cars although a freshly painted Chevy Baretta was found on the property. Further FPD#2
personnel found several 5 gallon containers of paint thinner and degreaser. Evidence of red over
spray was observed on the ground by FPD personnel.
During the our time at the staging area, I was once again contacted by Gary Jenkins. He wanted
to be checked out by FPD #2 medics. Jenkins told me he saw a Hispanic woman paint a car red.
Jenkins also stated the paint being applied was red and stated all of the fruit on the trees would
have to be cleaned because of the paint landing on the fruit.
Tamara Byerly who also lives in the area with her 5 year old daughter, Savana and her boyfriend
Steve Poe complained about her daughter being exposed to the lacquer fumes. Steve Poe is a
painter by trade. He stated the paint and solvents are being grossly mishandled by the residents at
110 NE Ponderosa.
