Dear Mr. Hoover:
On September 13, 2001, my staff inspected your property at 2491 Old Belfair
Highway, Belfair, Mason County, Washington, in response to a complaint. Based on
the results of our investigation, I have determined that you placed fill in uplands located
between your gravel driveway and pond (inspector's sketch enclosed). There has been
no violation of the Clean Water Act because no dredged or fill material was discharged
into wetlands or other waters of the United States. A Department of the Army permit is
not required for the work in place on the date of our investigation.
Regulations and guidelines implementing our permit program under Section 404
require that you obtain a permit prior to the discharge of any dredged or fill material into
waters of the United States including wetlands (definitions enclosed). The low-lying
forested area northwest of the pond appears to fit this description of wetlands. If any
filling, grading, excavation, or mechanized Iandclearing is planned for this area, a
Department of the Army permit may be required.

Dear Mr. Hoover:
On April 5, 2001,a site investigation was completed and a STOP WORK ORDER posted on the
above-mentioned parcel regarding the fill of a wetland. A wetland with fill was observed on the
eastside of the driveway. There was a grading permit issued in 1994 for grading another area of
the property. According to Mason County records,no permits were issued for fill in this wetland
area.
According to the Mason County Resource Ordinance Chapter 17.01.070 Wetlands (D.La)"A
Mason Environmental Permit shall be obtained from the County...In all regulated wetlands, (for)
the removal, excavation,grading, dredging,dumping,discharging, or filling of material."
To fill a wetland,a Mason Environmental Permit,JARPA form, Mason County Grading Permit,
and an Environmental Checklist are needed. If the decision is made to not fill,the wetland needs
to be restored its previous condition.
