Box 1095 Allyn, WA 98524-1095 May 4, 2009 Re: 12220-5015003 Dear Mr. Davies, Last week(4/27/09) I inspected the above referenced parcel in conjunction with your short subdivision application. I have a number of comments and observations, which I will outline below. Survey I was unable to locate the found survey pins for the previous survey of NW and NE corners of resulting Lot 3. Typically, found monumentation will be flagged by the current surveyor. I was also wondering what the legend note"Corner Not Set As Described" means? Setbacks Why is sewer tank and pump located on a proposed property line?This needs to be on one side or the other of the property line, and if it involves an above ground structure, then a 5' setback is require. Wetlands & Environmental Concerns I have read through the TWC's Wetland Delineation Report, but I am not convinced that this site meets the fine print to qualify for wetland buffer reduction of 17.01.070.E.2.d. The TWC wetland report does not provide any evidence that the proposal meets the criteria of d.a.(l) and d.a.(2). Please have WTC provide a detailed justification for how your proposal meets the buffer reduction criteria. Although I realize that the site plan provided by WTC is not meant to be as accurate as information provided by a survey, I am uncomfortable with the conceptual differences between the locations of the buffer edge on the survey map and in Figure 2 of the TWC wetland report. Considering what a tight fit locating homes on resulting parcels 1 and 3 will be, building envelopes will need to be surveyed in based on common line and the minimum 35' setback from OHW (but not until it has been determined that this proposal qualifies for the wetland buffer reduction). I recommend that you pay Mason County to locate your common line by applying for a Shoreline Pre-Inspection. Allan Borden at ext. 365 can help you with this. ! I'm also concerned about the unresolved wetland violation on site. I would remind you that enforcement case ENF 2008-00068 is still active. I expect that restoration of the wetland and buffer will be required and that the resulting lots of this short subdivision application will not be allowed benefit from the misdeeds of the previous property owner. (An example of this would be the proposed location of a new two-party well deep into the wetland buffer). Code Enforcement Officer Christine Clark(ext. 577)is reviewing you case. Your application is also under review by Mason County Public Health, Mason County Public Works and Mason County Waste and Utilities. I will issue a SEPA threshold determination for this case, only after the wetland& shoreline setback issues have been resolved the building envelopes have been established.
