Dear Mr. And Mrs. Ciambrone,
On October 21, 2005, I posted a Stop Work on your property located at 60 E North Bay Rd, in
Mason County, WA. The Stop Work Order was posted due to clearing and excavation activity
within a jurisdictional wetland system. During my site inspection, I noted that vegetation was
not only removed from the wetland buffer,but also from the wetland itself.
The Mason County Resource Ordinance section 17.01.070 states that in all regulated wetlands,
the removal, excavation, grading, dredging, dumping, discharging, or filling of any material
requires a Mason Environmental Permit. The destruction or alteration of wetlands and wetland
vegetation area through clearing, harvesting, shading, intentional burning, or planting of
vegetation that would alter the character of a designated wetland or vegetation area is also a
Mason Environmental Permit required activity.
If you want to try to keep the site the way it is now, you will need to apply for the Mason
Environmental Permit, which will be subject to after-the-fact penalty fees. Please keep in mind that
applying for a permit does not guarantee approval. When applying for this permit,the applicant must show
that impacts to the wetland were avoided and minimized as much as possible.
Absent prior permit approval, the wetland and its associated buffer must be restored to its original
state. To accomplish this,you will need to have a restoration plan prepared by a qualified professional, as
well as submit a bond in the amount of the restoration(including materials and labor), and the site will be
assessed with a three-year monitoring period to ensure survival of the restored vegetation. The restoration
requirements are discussed in more detail in section 17.01.210 of the Mason County Resource Ordinance
(enclosed).

The restoration plan will need to include a component that rates and categorizes the wetland system. This
will determine the boundary where the wetland starts and what associated buffer will be required.

9670 ext. 602. I anticipate receiving the joint wetland delineation/restoration plan and bond by
November 28, 2005. Upon receipt of the plan and bond form I will close the enforcement case and create a tracking case file. Once per year, for a period of three years from completion of
restoration activities, a qualified professional shall submit an annual report to the County (see
Mason County Resource Ordinance section 17.01.210(2) — copy enclosed). The bond will be
released following the three-year monitoring period, if the requirements of section 17.01.210(3)
are satisfied. Thank you for anticipated cooperation.
