RE: Cliff Rickards property (PN: 42018-21-00000)
On June 15 , 1994, I received a complaint by phone from Mr. Robert
Carey (W 7900 Shelton-Matlock Road; 426-6556) that Cliff Rickards
was continuing to excavate surface soils from his own property
located directly behind Mr. Carey. Previously in April 1993 , Mr.
Carey had phoned in a complaint to which Don Bri:� h had made a
site visit; at that time, Don noted that no impacts to the
wetlands on this property were caused by the top soil removal .
On June 20 , 1994 , I made a site visit and observed that sixty
percent of a 300 ft . by 250 ft . has been excavated by scraping
the top one to four feet of surface soil and hauling it away.
Compaction on the road and work area has caused water to pond,
and stump and limb debris has been piled in various locations,
especially adjacent to the wetland area. The topography of the
site is mostly less than five percent, but slopes greater than 15
percent have been created by the excavation done so far.
The main concern; to be addressed with the grading now taking
place on this property are erosion and sedimentation towards the
wetland area and the railroad right-of-way, and the hauling of
soil materials as part of a commercial operation without proper
permits . The general grade of the areas now being excavated is
towards the wetland area and the railroad, and the surface runoff
across the cleared areas during intense rainfall events would
head in this direction. No sedimentation control measures (silt
fencing, hay bales, or drainages) are in place to lessen the
potential sediment deposition that would impact he wetland or
railroad right-of-way.
The full review of this excavation of soil materials in the past
eighteen months has yet to be made. The area of clearing and
excavation and the fact that work done on site is part of a
Recycled
commercial operation (LAND ASCAPERS NORTHWEST, Shelton, WA. )
provide merit to addressing this on-going excavation work. The
best method would be to have Mr. Rickards, as the property owner
and the operator of the work being done, apply for a Mason County
Land Modification Permit. All aspects of the work on-site, now
and in the future, will be reviewed, and a permit and conditions
corresponding to the operation can be finalized.
The current excavation work would not be exempt from a Land
Modification Permit for several reasons. The site is not in an
isolated self-contained area, since runoff from land clearing and
excavation areas may pose a threat to the nearby railroad and
wetland areas . The location is not in a material site recognized
by the county or state as a source for soil or gravel . The
excavations that have taken place already are deeper that two (2)
feet in depth and have created a cut slope greater than five (5)
feet in height and steeper than one and one-half horizontal to
one vertical . Since the work has involved more than 500 cu. yd.
of material since first noted in April 1993 , this project will
need to be reviewed through the county' s SEPA environmental
checklist process.

Stop Work Order

Dear Mr. & Mrs. Rickard,
On 8-23-94, this office posted a stop work order at the above location
in response to a referral of a complaint from the Department of Community
Development. This stop work order was posted for the continuing violation of
clearing, grading and excavation without obtaining a Land Modification Permit.
Land Modification permits are required when the amount of cubic yards of any
of the activities listed exceeds 50.
THE FAILURE TO STOP WORK, THE RESUMING OF WORK
WITHOUT PERMISSION FROM THE BUILDING OFFICIAL OR THE
REMOVAL, MUTILATION, DESTRUCTION FOR CONCEALMENT OF
THE NOTICE IS PUNISHABLE BY FINE AND IMPRISONMENT.
Enclosed is the Land Modification Application. Please complete the
application and submit it to this department prior to September 15, 1994.
1 have also attached a copy of the memorandum which details the investigation
report as done by the planning department. The last paragraph on the last page
refers to a SEPA environmental checklist being required for this permit. I have
included those forms as well. The fees for the SEPA checklist need to be paid
at the time the checklist is submitted and directed to the Department of
Community Development. Any questions related to SEPA should also be
directed to that department. Land Modification application questions will be
handled by the Building Department.

I have marked your file for a compliance date of September 15, 1994. If
the application for the Land Modification Permit and SEPA checklist are not
received by this date, further action to bring the property into compliance will
be commenced by referring the case to the Mason County Prosecutors Office.
