If you want that letter,you will need to submit a formal Records Request. Here is the Records Request form: httv://mww.co.masoii.NN,a.us/forms/Community Dev/research request.pdf However I did find the text for a 2003 site inspection letter, written by a planner names Rick Mraz who is no longer with the County. Allan Borden is the current planner for this location and author of the 2010 letter. Some of the codes have changed since 2003, but not since 2010. I wasn't able to find a deed for an easement on the Auditor's website, but those on-line records only go back about 25 years. Older records are on micro-fisch and you would need to call the Auditor at 360- 427-9670 ext. 466 for more information. The only records I found was for an easement to Mason County to operate their sewer system. A field inspection of the subject property was conducted on 5/20/03 to assess critical areas issue relevant to future home construction. The parcel is located adjacent to State Route 302. It has frontage on North Bay and is bisected by a type II/III stream. This property may prove exceedingly difficult to develop and may require several variances, special studies, and governmental agency approvals prior to building. Given the sinuous nature of the stream, potential building sites that are of sufficient size for a house footprint are extremely limited or nonexistant. The Fish and Wildlife Habitat Conservation Areas chapter of the Mason County Resource Ordinance (RO)requires setbacks for development from streams. The size of the setback depends on the type of stream. Type I streams require a 165' setback(150' undisturbed vegetative buffer+ 15' building setback). Residential construction within that buffer requires a variance. A Habitat Management Plan (HMP),prepared by a qualified biologist, would be required to support the variance request. The HMP addresses impacts to the buffer and offers measures to preserve and protect the buffer or mitigate impacts. A copy of the Fish and Wildlife Habitat Conservation Areas chapter is enclosed. It includes details on the contents of an HMP. A variance application is also included. The stream is characterized by a floodplain and anecdotal information indicates that the stream leaves its bank several times a year, inundating the property. Construction in a floodplain is limited and regulated by the Mason County Flood Damage Protection Ordinance and construction in a floodway is prohibited. The shoreline setback for this parcel is derived using a common line procedure. An imaginary line is drawn from the most waterward portion of the roofline of one adjacent residence to the most waterward file:///C:/Users/ahb/AppData/Local/Temp/XPgrpwise/53E4C4EDMasonmail... 8/8/2014 Page 2 of 2 portion of the roofline of the other adjacent residence. The position where this line crosses the subject parcel serves as the setback for the parcel. No structure may project into the setback. The setback was identified but not staked. However, as noted previously,the stream position limits any development of the site. Other issues related to salmonid use of the stream are regulated by Washington Department of Fish and Wildlife,National Marine Fisheries Service,U.S. Army Corp of Engineers and U.S Fish and Wildlife Service. Each agency may have review authority and/or permit authority over any activity that may adversely affect salmon.
