A BE was prepared as required under Section 7 of the ESA to ensure that any action authorized,funded,or carried out by a Federal agency is not likely to jeopardize the continued existence of an endangered or threatened species,or result in the destruction or adverse modification of Critical Habitat of a protected species. The writing of this BE strictly follows guidelines provided by the U.S. Army Corps of Engineers,United States Fish and Wildlife Service(USFWS), and NOAA Fisheries(formerly known as the National Marine Fisheries Service(NMFS))(NMFS, 1996; NMFS, 1999; U.S.Army Corps of Engineers,2000). This report: 1)describes the existing site conditions and the project plan,2)characterizes aquatic habitat and fish species that occur within the Action Area,3) identifies the status of fish species under the ESA in these environments,4)evaluates sensitive habitat within the Action Area for ESA listed fish species,and 5) identifies possible impacts to Federally-listed fish and sensitive habitat resulting from the construction and post-construction phases of the development. This BE will determine if the proposed project will adversely affect,not likely to affect,not affect, or positively affect listed species under the ESA(Table 1). Because the U.S. Fish and Wildlife Service(USFWS)and NOAA Fisheries identified Federally- listed species and have designated Critical Habitat in the general vicinity of the project site,the ESA must be addressed as a part of the permit process. The Washington Department of Fish and Wildlife(WDFW)have documented the occurrence of these species within the vicinity of the subject property. This BE will address impacts and provide conservation measures in order to satisfy requirements under the ESA. 1.2 Project Location The 0.84-acre subject property is located at 370 Cronquist Rd,Mason County,WA(Figure 1; Table 1). Engelbert Dock Project Biological Evaluation 1.3 Primary Constituent Elements Known primary constituent elements are listed with the critical habitat description. Primary constituent elements may include,but are not limited to,the following:roost sites,nesting grounds,spawning sites, feeding sites, seasonal wetland or dry land,water quality or quantity, host species or plant pollinator,geological formation,vegetation type,tide,and specific soil types. Agency regulations under 50 CFR 424.12(b)interpret the statutory phrase"physical or biological features essential to the conservation of the species." The regulations state that these features include,but are not limited to, space for individual and population growth and for normal behavior; food,water,air,light,minerals,other nutritional or physiological requirements;cover or shelter; sites for breeding,reproduction,and rearing of offspring;and habitats that are protected from disturbance or are representative of the historical geographical and ecological distribution of a species. The writing of this BE addendum strictly follows guidelines provided by the U.S. Army Corps of Engineers, United States Fish and Wildlife Service(USFWS),and NOAA Fisheries(formerly known as the National Marine Fisheries Service(NMFS))(NMFS, 1996;NMFS, 1999;U.S. Army Corps of Engineers,2000). 2.0 PROJECT DESCRIPTION 2.1 Existing Conditions 2.1.1 General Property Description The project site is a privately owned parcel on Case Inlet of Puget Sound. The site is developed containing a single-family residence,paved parking,and driveway(Figure 2). The western portion of the subject property contains trees and a driveway. The central portion of the subject property contains a back yard,parking area and a shed(Appendix A,Photo 1). The front yard is located at the top of the bluff and contains graveled pathways, lawn grass,and ornamental plants(Appendix A,Photos 2-8). A bluff occurs between the back yard and the shoreline area (Appendix A,Photo 30). The bluff is reinforced by a rock wall at the subject property (Appendix A,Photos 12,15, 16, 18,21,22,32). Graveled paths and rock and wooden stairs provide pedestrian paths traversing the bluff(Appendix A,Photos 5, 12, 15,16). The toe of the bluff contains a patio and landscaped paver bricks and gravel(Appendix A,Photos 12-15). A seawall is located at the shoreline and defines the ordinary high water mark(OHWM) (Appendix A,Photos 28,31,32,36-38). Concrete stairs traverse between the top of the seawall and the shoreline(Appendix A,Photos 17,18,21,39). The shoreline and seabed consist of gravel(Appendix A,Photo 21-27,33-39). Vegetation at the shoreline consists of the non-native species Scotch Broom(Cytisus scoparius)and other non-native plants(Appendix A,Photo 29 &30). r Ernrco Page 2 8 September 2021 Engelbert Dock Project Biological Evaluation Neighboring docks are visible from the subject property facing north at the shoreline(Figure 2; Appendix A,Photos 9-11, 14, 19,23,24,28,35,37). An off-site floating platform is visible from the shoreline of the subject property(Appendix A,Photo 37). Neighboring properties consists of single-family residential lots with access to the shoreline similar to that of the subject property. Neighboring residences contain seawalls and docks. Some of the neighboring residences contain boat launches and other recreational amenities. The neighboring beaches are used for recreational purposes. Boating activity is abundant in Case Inlet within visual range of the subject property. 2.1.2 Existing Project Area The proposed project area consists of a graveled marine substrate(Appendix A,Photos 23-27, 33-35). No vegetation occurs at the project site. No marine vegetation or complex sea life occurs at the project site. 2.1.3 Topography Topography on the subject property is relatively flat above the bluff and on the marine shoreline. A steep marine bluff occurs on the property with stairs diagonally traversing the slope. Topography at the proposed project is relatively flat other than slightly declining toward the marine waters. 2.1.4 Vegetation The subject property is sparsely vegetated other than landscape plants with some salal (Gaultheria shallon)and lawn grasses(Appendix A,Photos 1-8,29,30). Douglas fir (Pseudotsuga menziesii)stands occur on the property periphery. 2.1.5 Drainage No drainages were identified on the subject property. 2.1.6 Vicinity The site is located on the western shoreline of Case inlet(Figure 1). The shoreline on the neighboring properties consists of single-family residences. Recreational boating occurs near the west bank and throughout Case Inlet. Many of the neighboring properties contain personal docks. Coniferous forests in this zone are typically dense,tall,and among the most productive in the world,with dense understories. Constituent tree species are Sitka spruce(Picea sitchensis), Western red cedar(Thuja plicata),Douglas fir(Pseudotsuga menziesii),Grand fir(Abies grandis),and Pacific silver fir(Abies amabilis). Red alder(Alnus rubra)is abundant on recently disturbed sites,and Shore pine(Pinus contorta)is common along the ocean. Some heavy machinery,namely one pile driver and crane,would be hauled in by barge. Stockpiling No stockpiling of materials is anticipated. Materials would be either pre-assembled or assembled immediately upon arrival on the subject property. Refueling Areas All on-site equipment would be monitored for leaks and receive regular preventative maintenance to reduce the chance of leakage. Construction equipment would be fueled off site. If on-site fueling were necessary,procedures would comply with BMP S 1.11 of the DOE Stormwater Management Manual for Western Washington 2000,Volume IV or as amended. The following practices would be followed for spill prevention and cleanup if some on-site fueling would occur: 1. Manufacturers' recommended methods for spill cleanup would be clearly posted and site personnel would be made aware of the procedures,and the location of the information and cleanup supplies. 2. Materials and equipment necessary for spill cleanup would be kept in the material storage area on site. Equipment and materials would include,but not be limited to,brooms, dustpans,mops,rags,gloves,goggles,kitty litter, sand,sawdust, straw bales,and plastic and metal trash containers specifically for this purpose. Also included in the material storage area would be extra pads and socks for hydrocarbon absorption. 3. In the unlikely event of discharge of oil, fuel,or chemicals into State waters,or onto land with a potential for entry into State waters,containment and cleanup efforts would begin immediately and be completed as soon as possible,taking precedence over normal work. Cleanup would include proper disposal of any spilled material and used cleanup materials. 4. A visible sheen from petroleum in fresh or marine waters would evoke a cleanup response. 5. The spill area would be kept well ventilated,and personnel would wear appropriate protective clothing to prevent injury from contact with a hazardous substance. 6. A phone list would be maintained that cites phone numbers for emergency notification. 7. Any spill of toxic or hazardous material would be reported to the appropriate State or local government agency,regardless of its size. s 046 for Page 5 8 September 2021 Engelbert Dock Project Biological Evaluation 8. Following any unlikely spill,a description of the spill,what caused it,and the cleanup measures would be included. 9. The construction manager would coordinate spill prevention and cleanup. 2.3.2 Proposed Work Timing The construction sequence for the dock installation project will commence upon receipt of the required building permits. Work should be completed within the work window. To protect fish and shellfish habitats at the job site,work below the ordinary high water line would occur from July 15 and February 15 in compliance with WAC 220-660-330--Authorized work times in saltwater areas for Tidal Reference Area#2,which includes Case Inlet(Table 2). Table 2. Project Work Window Tidal Juvenile Salmonid Surf Smelt Spawning Reference Migration,Feeding and Beds Herring Spawning Beds Area R Areas 2 July 15-February 15 April 1 -June 30 April 1 -January 15 Due to the lengthy spawning period for surf smelt in this portion of Puget Sound,work should also be allowed from April 1 through December 31 and January 1 through June 30 of any year if a biologist trained by the Department of Fish and Wildlife confirms lack of surf smelt spawn during a site inspection. Work would begin within seventy-two(72)hours of survey. The biologist must follow the department-approved intertidal forage fish spawning protocol and use the standard department data sheets when conducting forage fish spawning beach surveys. All work will occur in receipt of permits. The most current erosion control and water quality BMPs will be implemented to control erosion and sedimentation,and to prevent water quality degradation during construction(see Section 8.0 for"Conservation Measures"). Construction sequencing is provided in Table 3. Table 3. A silt curtain will be used to contain potential turbidity. One(1)crane will be used to install dock pieces. One(1)barge will be used to deliver equipment and materials. 3.0 ACTION AREA According to the ESA Consultation Handbook, Section 4.1 A(USFWS and NMFS, 1998),"the Action Area should be determined based on consideration of all direct and indirect effects" [59 CFR 402.02 and 402.14(h)(2)]. The Action Area is defined as all areas to be affected directly and indirectly by the project. In this case,direct impacts are related to construction noise and activities,and no specific indirect effects have been identified. The Action Area at the construction site is defined by the extent of 1)terrestrial and underwater noise from construction activities,2)potential turbidity,and 3)terrestrial and underwater noise specifically from pile driving,which was determined by the noise assessments discussed above. Terrestrial noise is not expected to extend above the bluff. The project site is located at the toe of a bluff where noise would be largely contained. Underwater noise from pile driving may exceed background noise for a short distance and over a limited period of time but will be largely attenuated through soils prior to entering the water. Background noise may exceed construction noise during recreational boating season. Because of the gravelly substrate,turbidity generated from construction is expected to be minimal to negligible and largely confined to the work area. Because of minimal noise impacts the Action Area is defined as(Figure 5): • Marine Action Area: OHWM to one tenth(1/10)of a mile(528 feet)waterward. • Terrestrial Action Area: OHWM to top of bluff. 4.0 HABITAT AND SPECIES INFORMATION This section addresses potential occurrence of Federally-listed species and habitat conditions in the Action Area and identifies the species of concern and forage species that would inhabit the Action Area. The identification and evaluation of habitat,forage species, and species of concern are essential in the analysis of"take"and"determination of effect'. Below,the environmental conditions are compared with the documented habitat preferences of the listed species. Both project construction and operation are reviewed in light of this evaluation to determine possible environmental impacts on waters within the Action Area. s Envif o for Page 7 8 September 2021 ov vir u5.s.f or Engelbert Dock Project Biological Evaluation 4.1 WDFW PHS Database Freshwater,marine,and estuarine wetlands have been mapped at the shoreline of the subject property(Appendix D). A surf smelt(Hypomesus pretiosus)breeding area is identified to occur on the shoreline at the subject property. 4.2 Habitat Information 4.2.1 Critical Habitat for Salmonids On 16 February 2000,NOAA Fisheries designated Critical Habitat for 19 Evolutionarily Significant Units(ESUs)of Chinook,chum,and sockeye salmon, as well as steelhead trout in Washington,Oregon, Idaho and California. On 30 April 2002,the U.S. District Court for the District of Columbia approved a NMFS consent decree withdrawing a February 2000 Critical Habitat designation for 19 ESUs,including Chinook salmon(Threatened)(Appendix E). This action may not significantly affect the protection of listed salmon and steelhead species because: 1)the Endangered Species Act(ESA)status is unchanged,2)Sections 4,7, 9 and 10 of the ESA involving protective actions remain in effect,and 3)the designation of Essential Fish Habitat (EFH)(addressed below)overlaps most of the withdrawn Critical Habitat area. 4.2.2 Essential Fish Habitat The Magnuson-Stevens Fishery Conservation and Management Act(MSA),as amended by the Sustainable Fisheries Act of 1996,requires all Federal agencies to consult with NOAA Fisheries on all actions that may adversely affect Essential Fish Habitat(EFH). On 27 September 2000, NOAA Fisheries approved Amendment 14 to the Pacific Coast Salmon Fishery Management Plan designating marine and freshwater Essential Fish Habitat for Pacific Salmon. The EFH provisions of the Magnuson-Stevens Act were developed to minimize both fishing and non- fishing effects on EFH. The provisions were developed to prevent future habitat problems so that salmon,steelhead and other fish and shellfish stocks that depend on healthy habitats avoid further declines. Chinook,pink salmon,and Coho all have Essential Fish Habitat(EFH)for adults and juvenile fish within Puget Sound(U.S.G.S Hydrologic Unit 17110018). 4.2.3 Salmonid Habitat in the Action Area Nearshore Habitat Juvenile salmonids may migrate along the shoreline or utilize nearshore habitat at the subject property. Although no spawning habitat occurs in the Action Area,juvenile salmonid may utilize the nearby migrate through the Action Area. Miaratory Habitat Salmonids may utilize the marine Action Area as migratory habitat. Out-migrating juvenile salmonids may pass through the Action Area on their way to the ocean from their natal rivers and streams. Page 8 8 September 2021 •nr.sE rsaaa�a►N Engelbert Dock Project Biological Evaluation 4.2.4 Bocaccio Rockfish Habitat Bocaccio is most common between one hundred sixty(160)and eight hundred twenty(820)feet (50-250 m)depth but may be found as deep as 1,560 feet(475m). Adults generally move into deeper water as they increase in size and age but usually exhibit strong site fidelity to rocky bottoms and outcrops. Juveniles and subadults may be more common than adults in shallower water, and are associated with rocky reefs,kelp canopies,and artificial structures,such as piers and oil platforms. None of these structures occur in the Action Area. 4.2.5 Marbled Murrelet Habitat The marbled murrelet was listed as threatened in California,Oregon, and Washington on 1 October 1992 by the US Fish and Wildlife Service(USFWS). The USFWS also designated Critical Habitat for the marbled murrelet in 1996. The USFWS identified thirty-two(32)Critical Habitat units in Washington,Oregon and California,with eleven(11)units occurring in Washington. The proposed project lies within the Puget Sound(Zone 1)geographic zone for marbled murrelets,as identified in the recovery plan for this species(USFWS 1997b). However, the Action Area is not located within a Critical Habitat Unit. Within the Critical Habitat Units(areas essential for successful nesting),the USFWS focused on two primary constituent elements: 1) Individual trees with potential nesting platforms,and 2) Forested areas within 0.8 kilometer(0.5 mile)of individual trees with potential nesting platforms,and 3) A canopy height of at least one-half the site-potential tree height. This includes all such forests,regardless of contiguity. These primary constituent elements were considered essential to provide and support suitable nesting habitat for successful reproduction of the marbled murrelet. Within the boundaries of designated Critical Habitat,only those areas that contain one or both primary constituent elements are,by definition, Critical Habitat(Appendix F). Areas without any primary constituent elements are excluded by definition. No constituent elements of marbled murrelet Critical Habitat occur in the Action Area. No Critical Habitat was designated in the marine environment. Potential nest trees are large trees,preferably old growth,generally more than eighty-one(81) centimeters(32 inches)diameter at breast height with the presence of potential platforms or deformities,such as large or forked limbs,broken tops,dwarf mistletoe infections,witches' brooms,or other formations providing platforms of sufficient size to support adult marbled murrelets(USFWS, 1997). No nesting habitat occurs on the subject property or within the Action Area. The nesting period extends from approximately April 1 to September 15 (WDFW, 1991). r Erlvir0 Page 9 8 September 2021 OP11-1 I1$ $11..OB Engelbert Dock Project Biological Evaluation 4.2.6 Marine Mammal Habitat No preferred marine mammal habitat occurs in the Action Area. Larger marine mammals, such as the killer whale,could wander into the Action Area. Killer whale Critical Habitat is mapped in the Action Area(Appendix I). No marine mammals were observed in the Action Area during the site reconnaissance. However,killer whale sightings are common in the area and sea lions were spotted further offshore than the Action Area during the site evaluation(Appendix A, Photos 41 &42). The sea lions were too far from the shore to identify if they were stellar sealions even at 40x zoom on the camera. 4.2.7 Yellow-billed Cuckoo Western yellow-billed cuckoos breed in dense willow and cottonwood stands in river floodplains. This species is found in dense willow-cottonwood forests and marshy bottomlands with scattered thickets of willows. Nests are built on horizontal branches located four(4)to fifteen(15)feet above the ground. Dense foliage, especially within thirty(30)feet of the ground is a more important habitat component than tree height or dispersion. This species apparently requires larger tracts of habitat compared to other birds of comparable size. Yellow-billed cuckoos feed exclusively on insects. Cuckoos prefer large,green food items, such as katydids and sphinx moth larva.Foraging typically occurs in riparian areas and orchards. The breeding season for yellow-billed cuckoos is from mid-June to mid-August.Availability of food during this time may limit this species.Yellow-billed cuckoos do not establish breeding territories,a behavior which may allow birds from different nests to share in food that is locally available for a limited time period. No dense willow or cottonwood stands in river floodplains preferable to the yellow-billed cuckoo occur within the Action Area. 43 Species Information The Action Area may contain a variety of anadromous salmonid species,including Chinook salmon(Oncorhynchus tshawytscha),Coho salmon(O. kisutch),pink salmon(O.gorbuscha), steelhead trout(O. mykiss),chum salmon(O. keta),and coastal cutthroat trout(O. clarkii) (Williams et al., 1975;Washington Department of Fish and Wildlife, 2003; and Washington Department of Fish and Wildlife,2010). Bull trout(Salvelinus confluentus)may occur migrating through the Action Area(Washington Department of Fish and Wildlife, 1998b). However unlikely,individual bull trout could possibly stray into the Action Area in search of foraging opportunities during the proposed construction period. Marine mammals may occur in the shallow waters of the Action Area. The marbled murrelet may forage within the Action Area,although no nesting habitat occurs in the Action Area. Page 10 8 September 2021 Engelbert Dock Project Biological Evaluation 4.3.1 Listed Species 4.3.1.1 Puget Sound Chinook (Oncorhynchus tshawytscha) Puget Sound Chinook are listed as threatened under the Endangered Species Act(ESA)(USDC, 2000; Table 4). Chinook is known to occur in Case Inlet. Although no Chinook spawning streams occur in the Action Area,Chinook may use the marine Action Area as a migratory corridor. Foraging opportunities and shelter may attract some out-migrating juveniles. These out-migrating juveniles may pass through the nearshore habitat in the Action Area. No Chinook salmon streams have been identified to occur in the Action Area. Fall Chinook typically out-migrate immediately after emerging from the gravel and rear in estuaries before leaving out to sea(Wydoshi and Whitney,2003). It is likely that no juvenile Chinook will be in the work area during the work window. The WDFW PHS database does not identify Chinook salmon presence in the Action Area (Appendix D). Spawning typically occurs from mid-August through mid-November. No spawning streams are located within the Action Area. Fall Chinook typically migrate from mid-March to mid-July. Migrating juveniles may forage and take shelter in the Action Area from March to July. Juvenile fall Chinook salmon may occur in Estuaries year-round,and thereby, it is possible that Chinook may occur in the Action Area year-round. Both species inhabit high glacially-fed watersheds or cold perennial springs. Anadromous Bull trout,as with Dolly Varden,can occur in estuarine waters of natural rivers. Bull trout throughout the coterminous United States were listed as a Federally threatened species on 1 November 1999(USDI, 1999;USFWS,2002). Based on similarity of appearance to threatened Bull trout, Dolly Varden was proposed for listing(Federal Register 9 January 2001). Although Bull trout/Dolly Varden are not likely to regularly inhabit the Action Area because of limited suitable habitat, some individual sub-adults may wander into the waters of the Action Area to forage or to take shelter. Although the USFWS (2015)Recovery Plan for the Coterminous United States Population of Bull Trout(Salvelinus con,/luentus)identifies Case Inlet as located within the larger Coastal Recovery Unit,no `Core Areas' within the Recovery Unit occur in the Action Area or in Case Inlet. Spawn is assumed to occur from mid-September through December in upper reaches of these river systems when water temperatures drop below nine degrees Celsius(90C). Peak spawning generally occurs between mid-October and mid-November. No bull trout spawning occurs in the waters of the Action Area. No bull trout Critical Habitat occurs in the Action Area(Appendix G). 4.3.1.3 Bocaccio Rockfish Species Description Bocaccio are large Pacific coast rockfish that reach up to three(3)feet(1 m)in length. They have a distinctively long jaw extending to at least the eye socket. Their body ranges in color from olive to burnt orange or brown as adults. Young Bocaccio are light bronze in color and have small brown spots on their sides. Rockfishes are unusual among the bony fishes in that fertilization and embryo development is internal,and female rockfish give birth to live larval young. Larvae are found in surface waters and may be distributed over a wide area extending several hundred miles offshore. "Fecundity" in female Bocaccio ranges from 20,000 to over 2 million eggs,considerably more than many other rockfish species. Larvae and small juvenile rockfish may remain in open waters for several months,being passively dispersed by ocean currents. Larval rockfish feed on diatoms,dinoflagellates,tintinnids,and cladocerans,and juveniles consume copepods and euphausiids of all life stages. Adults eat demersal invertebrates and small fishes,including other species of rockfish,associated with kelp beds,rocky reefs,pinnacles,and sharp drop offs. Approximately fifty(50)percent of adult Bocaccio mature in four(4)to six(6) years. Bocaccio are difficult to age but are suspected to live as long as fifty(50)years. Habitat 4,4*0 Page 13 8 September 2021 Ea Ut ,..o Engelbert Dock Project Biological Evaluation Bocaccio are most common between 160 and 820 feet(50-250 m)depth,but may be found as deep as 1,560 feet(475m). Adults generally move into deeper water as they increase in size and age but usually exhibit strong site fidelity to rocky bottoms and outcrops. Juveniles and subadults may be more common than adults in shallower water,and are associated with rocky reefs,kelp canopies,and artificial structures,such as piers and oil platforms. Distribution Bocaccio range from Punta Blanca, Baja California,to the Gulf of Alaska off Krozoff and Kodiak Islands. They are most common between Oregon and northern Baja California. In Puget Sound,most Bocaccio are found south of Tacoma Narrows. Population Trends Recreational catch and effort data spanning twelve(12)years from the mid-1970s to mid-1990s suggests possible declines in abundance in Washington. Additional data over this period show the number of angler trips increased substantially and the average number of rockfish caught per trip declined. Taken together,these data suggest declines in the population over time. Currently there are no survey data being taken for this species,but few of these fish are caught by fishermen and none have been caught by Washington state biological surveys in 20 years, suggesting a very low population abundance. They are thought to be at an abundance that is less than ten(10)percent of their unfished abundance. A 2005 stock assessment by NOAA Fisheries suggests Bocaccio there have higher populations than was thought to be the case. Threats Bocaccio are fished directly and are often caught as bycatch in other fisheries,,including those for salmon.Adverse environmental factors led to recruitment failures in the early-to mid-1990s. Conservation Efforts Various state restrictions on fishing have been put in place over the years. Current regulations in the state of Washington,where the species is most at risk, limit the daily rockfish catch to three rockfish total(of any species). Because this species is so slow-growing,late to mature,and long- lived,recovery from the above threats will take many years,even if the threats are no longer affecting the species. Critical Habitat Critical habitat was designated for Bocaccio rockfish in the Puget Sound/Georgia Basin in November 2014. NMFS proposed designation of critical habitat in August 2013. Designated Critical Habitat occurs within the Action Area(Appendices H). Marbled murrelet has the ability to forage in Case Inlet. According to Jeff Davis,WDFW Habitat Biologist,(pers.com., 18 March 2003)foraging is more likely to occur at times of low human use,namely in the morning and evening. However, during winter months,low use of the near shore area by boaters, fisherman,and people seeking recreational opportunities may allow conditions favorable for mid-day foraging. No documented Marbled murrelet nests occur on the site or in the vicinity of the site,based on the WDFW Priority Habitats and Species database(Appendix D). No marbled murrelet individuals were observed on the site or in the Action Area during the site reconnaissance. No Marbled murrelet nests were identified on site or in the Action Area during the site reconnaissance. No marbled murrelet Critical Habitat occurs in the Action Area(Appendix F). 4.3.1.5 Yellow-bellied Cuckoo Historical Status and Current Trends Historically,the yellow-billed cuckoo bred throughout much of North America. Available data suggests that within the last fifty(50)years the species'distribution west of the Rocky Mountains has declined substantially. Loss of streamside habitat is regarded as the primary reason for the population decline. The species was probably never common in Oregon. Historical records for the state show that breeding cuckoos were most often sighted in willow bottoms along the Willamette and Columbia Rivers;there are few records of cuckoo sightings in eastern Oregon. Habitat Associations Western yellow-billed cuckoos breed in dense willow and cottonwood stands in river floodplains. Description and Life History The yellow-billed cuckoo is a medium sized brown bird, about twelve(12)inches long and weighing about two ounces. The bird's most notable physical features are a long boldly patterned black and white tail and an elongated down-curved bill which is yellow on the bottom. Yellow-billed cuckoos are migratory;historically,cuckoos arrived in Oregon in mid-May and flew south to their wintering grounds in September. Although many species of cuckoos are brood parasites (laying their eggs in other birds'nests),the yellow-billed cuckoo usually builds its own nest and raises its own young. The distinct call of the cuckoo has been described as sounding like"cow,cow,cow, cow,cow,cow..." a series of clucks that become slower and run down the scale at the end.The yellow-billed cuckoo is sometimes called the Raincrow or Stormcrow,because it often calls before a rainstorm. E t.•0 Engelbert Dock Project Biological Evaluation Food The bird primarily eats large insects including caterpillars and cicadas and,occasionally, small frogs and lizards. Breeding coincides with the emergence of cicadas and tent caterpillar. Reasons for Decline Available data suggests that the yellow-billed cuckoo's range and population numbers have declined substantially across much of the western United States over the last 50 years. In Oregon,cuckoos,although never common,have become even more rare with the loss of floodplain forests along the Willamette and Columbia Rivers. The last confirmed breeding records in Oregon were in the 1940s. Most of the recent records of cuckoos are from eastern Oregon at Malheur National Wildlife Refuge in Harney County,and from Malheur and Deschutes Counties. The greatest threat to the species has been reported to be loss of riparian habitat. It has been estimated that ninety(90)percent of the cuckoo's stream-side habitat has been lost. Habitat loss in the west is attributed to agriculture,dams,and river flow management,overgrazing and competition from exotic plants such as tamarisk. Conservation Measures In 1998,the USFWS received a petition to list the western yellow-billed cuckoo as an endangered species. The USFWS concluded that the western yellow-billed cuckoo is a distinct population segment(DPS)of the yellow-billed cuckoo in North America. The USFWS determined that the western yellow-billed cuckoo DPS was warranted for listing,but was precluded by other higher priority listing actions,and the USFWS placed the species on the candidate list. The USFWS will conduct an annual review of the species' status and may propose to list the species at a later date. The USFWS will encourage state and federal agencies as well as other parties to give consideration to the species in environmental planning. Activities which alter or destroy riparian habitat are of particular concern,including unmanaged cattle grazing that contributes to the loss of sub-canopy vegetation and cottonwood regeneration. Critical Habitat Although the yellow-billed cuckoo is known to occur in Washington State and particularly in Mason County,no Critical Habitat is proposed for Washington State at this time. 43.1.6 Killer Whale Species Description Weight. Males can weigh up to 22,000 pounds(10,000 kg); females can weigh up to 16,500 pounds(7,500 kg) Length. They also occur,though at lower densities, in tropical, subtropical,and offshore waters. Killer whales are generally considered monotypic(belonging to one species). However,genetic studies and morphological evidence have led many cetacean biologists to now consider the existence of multiple species or subspecies of killer whales worldwide. The species shows considerable size"dimorphism". Adult males develop larger pectoral flippers, dorsal fins,tail flukes, and girths than females. Female killer whales reach sexual maturity when they grow to about fifteen(15)to eighteen(18) feet(4.6 m-5.4 m) long, depending on geographic region. The gestation period for killer whales varies from 15-18 months. Birth may take place in any month--there is no distinct calving season. Calves are nursed for at least one(1)year and may be weaned between one(1)and two (2)years old. The birth rate for killer whales is not well understood,but,in some populations,is estimated as every five(5)years for an average period of twenty-five(25)years. Killer whales are highly social animals that occur primarily in relatively stable social groups that often range in size from two(2)to fifteen(15)animals. Larger groups(rarely as large as several hundred individuals)occasionally form but are usually considered temporary groupings of smaller social units that probably congregate for seasonal concentrations of prey, social interaction,or mating. Single whales,usually adult males,also occur in Bigg's killer whale populations(as discussed below). Differences in spatial distribution, abundance,behavior,and availability of food resources probably account for much of the variation in group size among killer whale populations. Efl1l� Page 17 8 September 2021 Engelbert Dock Project Biological Evaluation Populations and Social Organization Scientific studies have revealed many different populations--or even potentially different species or subspecies--of killer whales worldwide. These different populations of killer whales may exhibit different dietary needs,behavior patterns, social structures,and habitat preferences. Therefore,interbreeding is not expected to occur between different populations,in spite of the overlap between home ranges. The most well-studied killer whale populations occur in the eastern North Pacific Ocean. Three (3)distinct forms,or ecotypes,of killer whales are recognized: • Resident • Transient,or Bigg's • Offshore The three(3)types differ in morphology,ecology,behavior,and genetics. A recent genetic study suggests the transient type has been separated from all other killer whales for approximately 750,000 years and might represent a separate species or subspecies,known among researchers as Bigg's killer whales. All three types of killer whales share at least part of a home range,yet they are not known to intermix with one another. The resident and transient types both have multiple populations within their range. Resident Killer Whales are noticeably different from both transient and offshore forms.The dorsal fin is rounded at the tip and curved and tapering,or"falcate". Resident whales have a variety of saddle patch pigmentations with five different patterns recognized. They've been sighted from California to Russia.Resident whales primarily eat fish. Resident killer whales in the U.S.North Pacific consist of the following populations: • Southern residents • Northern residents • Southern Alaska residents • Western Alaska North Pacific residents Resident type killer whales occur in large social groups called"pods," groups of whales that are seen in association with one another over fifty(50)percent of the time. The pods represent collections of matrilines,their fundamental social unit. Southern Resident killer whales are the only known resident population to occur in the U.S. Southern residents are comprised of three pods: J,K,and L pods. The Southern Residents are considered one"stock"under the Marine Mammal Protection Act(MMPA)and one"distinct population segment"(therefore, "species")under the Endangered Species Act(ESA). The Southern Resident Killer Whale population is currently estimated at about 80 whales, a decline from its estimated historical level of about two hundred(200)during the late 1800s. Beginning in the late 1960s,the live-capture fishery for oceanarium display removed an Envir Page 18 8 September 2021 oftctor Engelbert Dock Project Biological Evaluation estimated 47 whales and caused an immediate decline in Southern Resident numbers. The population fell an estimated 30%to about 67 whales by 1971. By 2003,the population increased to 83 whales. Due to its small population size,this segment of the population was listed as endangered under the Endangered Species Act(ESA)in 2005 and designated critical habitat in 2006. Their range during the spring, summer,and fall includes the inland waterways of Washington State and the transboundary waters between the United States and Canada. Relatively little is known about the winter movements and range of the Southern Resident stock. However,in recent years,they have been regularly spotted as far south as central California during the winter months and as far north as southeast Alaska,through the Northwest Fisheries Science Center's satellite tagging work. More information on Southern Residents can be found on the West Coast Region's website. Bigg's(Transient)Killer Whales occur throughout the eastern North Pacific and have primarily been studied in coastal waters. Their geographic range overlaps that of the resident and offshore killer whales. The dorsal fin of transient whales tends to be straighter at the tip than those of resident and offshore whales. Saddle patch pigmentation of transient killer whales is restricted to two patterns,and the large areas of black color don't mix into the white of the saddle patch that is seen in resident and offshore types. Transient type whales are often found in long-term stable social units of less than ten(10)whales,smaller than resident social groups. Transient killer whales feed nearly exclusively on other marine mammals. AT I Transients were one of the most frequently encountered groups and, in the 1980s,were sighted year-round in Prince William Sound. The AT group was made up of at least twenty- two(22)whales but has been reduced by more than half since the 1989 Exxon Valdez oil spill. Several confirmed deaths of AT killer whales have been recorded since the 1990s,while other missing animals are presumed dead.Nine(9)in June 2004,the ATI group of transient killer whales was designated as a depleted stock under the MMPA. Scientists estimate there are only seven(7)killer whales remaining in this group. Offshore Killer Whales are similar to resident whales,but can be distinguished generally by features such as their: • rounded fins with multiple nicks on the edge • smaller overall size • tendency for males and females to be more similar in size(less "sexual dimorphism") Offshores have the largest geographic range of any killer whale community in the northeastern Pacific and often occur nine(9)miles(15 km)or more offshore. But they also visit coastal waters and occasionally enter protected inshore waters. Animals typically congregate in groups of twenty(20)to seventy-five(75) animals with occasional sightings of larger groups up to two hundred(200)whales. They are presumed to feed primarily on fish,though they have been documented feeding on sharks. Genetic analyses indicate that offshore killer whales are reproductively isolated from other forms of killer whales. Offshore killer whales are among the least observed and understood of all killer whale populations. Killer whales produce three(3)categories of sounds: • clicks • whistles • pulsed calls Echolocation clicks are believed to be used primarily for navigation and discriminating prey and other objects in the surrounding environment but are also commonly heard during social interactions and may have a communicative function. Whistles and pulsed calls are believed to be used for communication and during social activities. Whistles are frequency modulated sounds(pitch changes with time)with multiple harmonics. Pulsed calls are the most common type of vocalization in killer whales and resemble squeaks, screams, and squawks to the human ear. Most calls are highly distinctive in structure and are characterized by rapid changes in tone and pulse repetition rate. Killer whales of different populations have distinct calls and whistles. In resident killer whales of the eastern North Pacific,each pod possesses a unique repertoire of discrete calls— representing community dialects which are learned and culturally transmitted among individuals. These calls serve as family badges and are used to maintain group cohesion. In instances with high levels of noise,killer whales are known to increase the amplitude(i.e.,volume)of their calls. Habitat Killer whales are most abundant in colder waters,including Antarctica,Norway,and Alaska. However,Killer whales can also be abundant in temperate waters. Killer whales also occur, though at lower densities,in tropical, subtropical,and offshore waters. Following the listing of the Southern Residents as an endangered species in 2005,critical habitat was designated in November 2006. In February 2015,a 12-month finding on a petition to revise critical habitat was issued for Southern Residents. This finding outlines the next steps of how the NOAA Fisheries intends to proceed with the requested revision. Distribution Killer whales are the most widely distributed marine mammals, found in all parts of the oceans. They are most abundant in their natural habitat though will also venture to lower densities, in tropical,subtropical,and offshore waters in search of food. Population Trends The most recent estimate places the global population at a minimum of about 50,000 animals. In the northeastern Pacific(from California to the western Aleutian Islands and Bering Sea),the population is estimated around 2,500 killer whales. Threats Historically • commercial hunting • live capture for aquarium display,particularly of the Southern Resident stock(some live capture still occurs in Russia) • culling due to depredation of fisheries Currently • contaminants (e.g.,PCBs) • depletion of prey due to overfishing and habitat degradation • ship collisions • oil spills • noise disturbance from industrial and military activities • interactions with fishing gear • whale-watching can be a threat if not conducted responsibly Outside U.S.waters,directed catch of killer whales still occurs,though these levels are presumed low. Conservation Efforts A final recovery plan for the Southern Resident killer whales was published on January 24,2008. The Recovery Plan for Southern Resident Killer Whales was based on the Proposed Conservation Plan for Southern Resident Killer Whales(under the MMPA),after comments on it were addressed and required ESA elements incorporated into it. The proposed ESA recovery plan was released for comment in November 2006. Public and peer review comments as well as new research results and references were then incorporated into the final Southern Resident recovery plan. Erne Page 21 8 September 2021 ornrte as �:.e uo Engelbert Dock Project Biological Evaluation Conservation measures in the plan include to: • Support salmon restoration efforts in the region including habitat,harvest,and hatchery management considerations and continued use of the existing authorities under the ESA and Magnuson-Stevens Fishery Conservation and Management Act to ensure an adequate prey basis. • Clean up existing contaminated sites,minimize continuing inputs of contaminants harmful to killer whales,and monitor emerging contaminants. • Continue evaluating and improving guidelines for vessel activity near Southern Resident and evaluate the need for regulations or protected areas. • Prevent oil spills and improve response preparation to minimize effects on Southern Resident and their habitat in the event of a spill. • Continue agency coordination and use of existing MMPA mechanisms to minimize potential impacts from anthropogenic sound. • Enhance public awareness,educate the public on actions they can participate in to conserve killer whales,and improve reporting of Southern Resident sightings and standings. • Improve responses to live and dead killer whales to implement rescues,conduct health assessments,and determine causes of death to learn more about threats and guide overall conservation efforts. • Coordinate monitoring,research,enforcement,and complementary recovery planning with international,Federal,and state partners. • Conduct research to facilitate and enhance conservation efforts. Continue the annual census to monitor trends in the population, identify individual animals,and track demographic parameters. • Cooperation and coordination of the Washington and British Columbia communities to conservation of the Southern Resident stock is required for long term recovery. The Plan was developed with input from a variety of stakeholders,including federal and state agencies,tribes,non-profit groups,industries,the academic community, and concerned citizens. The ATl stock of the North Pacific transient killer whale was designated as depleted under the MMPA after its drastic decline after the 1989 Exxon Valdez oil spill in Prince William Sound, Alaska. In November 2005,the Southern Resident population was listed as endangered under the ESA. NOAA designated critical habitat in November 2006 for the Southern Resident population. In February 2015,NOAA issued a twelve(12)month finding on a petition to revise critical habitat for Southern Residents. In 2011,the NOAA Northwest Region developed vessel regulations in Washington State(76 FR 20870)to prohibit vessels from approaching killer whales within two hundred(200)yards. Critical Habiat Killer whale Critical Habitat occurs in the marine Action Area(Appendix I). 4.3.2 Candidate Species No Candidate species are addressed under this BE. 5.0 EFFECTS OF ACTION This section will address potential short-term impacts typically associated with construction and long-term impacts typically associated with the operation of the facility. 5.1 Potential Short-term Construction Effects Construction impacts may result from the release of turbid runoff,exhaust from heavy machinery,and from noise and vibrations as a result of the proposed project. 5.2 Impact Assessment(Noise) Background information involving noise-impact assessments are explained more fully in the WSDOT Advanced Biological Assessment Manual(May 2006). Erwir�ri Page 23 8 September 2021 Engelbert Dock Project Biological Evaluation 5.2.1 Underwater Underwater noise and vibration as a result of the proposed construction is not expected to exceed background levels with noise attenuation measures applied. Noise and vibration from construction will be diminished by daily boating activities passing nearshore at the subject property. Eight(8)of the ten(10),eight(8)-inch hollow, galvanized steel piles proposed would be installed out of the water or in very shallow water during low tide for noise attenuation. Pier piles of the neighboring docks are out of the water or in vary shallow water during low tide similar to that of the proposed dock(Appendix A,Photos 9-11, 14, 19,23). Only two(2), eight(8)inch hollow,galvanized steel piles securing the float will be driven into the substrate under a water level that could transmit appreciable noise levels waterward. When conducting an in-air noise assessment involving impact driving of hollow steel piles, USFWS currently recommends assuming a noise level of 115 dBA Lmax at fifty(50)feet(for thirty(30)-inch piles)(Visconty 2000) as a worst-case scenario,where Lm=is the maximum value of a noise level that occurs during a single event(WDOT,2006). Most of the documented studies have maximum decibel levels between ninety-five(95)and one hundred fifteen(115) dBA,with only one documented level above one hundred fifteen(>115)dBA. Noise assessments by WSDOT have documented maximum levels of one hundred three(103)dBA Lmax for twenty-four(24)-inch piles and one hundred ten(110)dB Lmax for thirty(30)-inch piles each measured at a range of 11 meters(Illingworth and Rodkin 2010). If site-specific information is available,or smaller diameter piles are used,it may be appropriate to substitute lower values(WDOT,2006). The proposed piles are only right(8)inches in diameter and would generate significantly lower levels of noise. Generally,pile driving can be as noisy as a rock concert(110 dBA)according to WDOT(2006) (Insert 1). However,Average Maximum Noise Levels fifty(50)feet from a vibratory hammer is reported as one hundred one(101)dBAL.(Insert 2). This noise travels further in water than in the air(Inserts 3 &4). Some of this sound will be attenuated as it travels through soils prior to entering the water,considering that most of piles would be driven in the dry during low tide. A vibratory hammer would be applied to reduce noise and minimize noise impacts. Assessments by WSDOT have documented un-weighted RMS levels for a vibratory hammer to be between eighty-eight(88)dB (18-inch pile)and ninety-eight(98)dB (30-inch pile)at fifty(50)feet (Laughlin 2010b). Thereby,driving eight(8)-inch piles would logistically produce less noise than the eighty-eight(88)dB generated from driving an eighteen(18)inch pile,bringing the noise levels down to hair dryer or business office based on the table in Insert 1. Background Noise. Daily background noise is generated by recreational boating. RCW 79A.60.130 prescribes effective mufflers limiting the minimum decibels for motor propelled vessels at eighty-eight(88) to ninety(90)dB. Considering that driving an eighteen(18)inch pile using a vibratory hammer may generate eighty-eight(88)dB,a vibratory hammer driving eight(8)inch pile would generate noise less than recreational boating in the vicinity. Direct Impacts: • Slight potential for runoff containing suspended-sediment concentrations. • Potential for pollutants or turbid water from construction areas. • Potential for increased underwater noise levels from vibratory pile driving. Indirect Impacts: • Additional noise from boating activity at the subject property. 5.2.2 Terrestrial Noise is not expected to exceed background levels over land above the bluff. The proposed project is located at the toe of a steep bluff. Noise impacts are unlikely to extend over the bluff. Noise is not expected to exceed background levels over existing recreational boating activities. Direct Effects: Potential direct effects of the project to listed species and/or their habitats are summarized below. Noise impacts from construction were estimated and are discussed in greater detail above. • Increased noise levels from construction. • Potential visual and noise disturbances from construction activities. • Potential for air pollution to enter the terrestrial environment from construction equipment. Stockpiles of materials during construction will be located outside of sensitive areas. 5.2.4 Effects Associated with Interrelated Activities Interrelated actions are a part of a larger action for their justification and would only occur if the project occurs. No effects associated with interrelated activities are anticipated. No additional construction or activity is anticipated associated or interrelated to the proposed action because the area is already built out. The installation of the dock will not affect any other development actions. Clearine of Vegetation No vegetation will be removed or disturbed. No impacts to habitat potentially used by the marbled murrelet or the yellow-billed cuckoo are expected to occur as a result of this project. No impacts to terrestrial habitat are expected to occur as a part of this project. Exhaust No significant amount of potential air quality degradation is expected to occur as a result of construction equipment within the Action Area during the proposed work. Temporarily degraded air quality could adversely impact foraging activities of marbled murrelet or other air- breathing species. However,exhaust from construction equipment would be very short lived during normal working day operations for an estimated two days of work. The source of exhaust would come from hauling materials and from a pile driver. This exhaust is expected to be within the range of normal daily operations of vehicles and boats of within the Action Area. 5.2.5 Potential Long-term Operational Effects This section examines operational impacts within the Action Area. No new potential long-term operational effects to the environment,habitat,listed species,or its Critical Habitat is expected to occur as a result of this proposed land use action,other than additional recreational boating from the one residence during boating season or when the weather allows. This boating activity would be limited to one single-family residence for recreational use. During post project work,no appreciable change from environmental baseline conditions is expected to occur within the Action Area as a result of this project. No appreciable temperature increase is expected in waters of the Action Area. No long-term direct effects on listed species or their habitats are expected to occur beyond baseline from operation of the dock. Marine Habitat No loss of or long-term impacts to maride habitat is expected to occur as a result of this dock project. The dock floats on the water's surface. The decking of the dock would not affect the marine habitat. s Envir Ot Page 28 8 September 2021 Engelbert Dock Project Biological Evaluation 6.0 IMPACT AVOIDANCE AND MINIMIZATION MEASURES The project has been designed to avoid and minimize impacts to species and habitats likely to be found in the vicinity of the project area. Erosion and sediment control BMPs will be implemented to minimize the potential for turbid runoff from construction areas. To minimize direct and indirect impacts from the project,the following precautions will be taken: • No debris will be allowed to enter the water during construction. • The contractor will follow the Washington Department of Ecology's Volume II— Construction Stormwater Pollution Prevention(WDOE 2005). • Operational BMPs from Volume IV—Source Control BMPs will be used(WDOE 2005). • Construction equipment will have properly functioning mufflers, engine-intake silencers, and engine closures according to federal standards. • As a contingency option,a silt curtain may be installed around the project site in areas of potential turbid runoff to contain turbid waters. • A vibratory hammer will be used to reduce potential noise impacts associated with pile driving. • Construction mats will be placed on the ground if construction equipment cannot be contained to a barge. 7.0 TAKE ANALYSIS With measures taken during the proposed work to minimize impacts associated with air and water quality, clearing of vegetation,and the size of the construction footprint and during operations,no significant potential for incidental take would be likely. Since measures will be taken to avoid and minimize impacts to Federally-listed species and their habitats,no incidental take is expected. The environmental baseline for the marine habitat in the vicinity of the project site is not expected to be adversely impacted by the proposed improvements. The effects of the proposed action during the construction phase(short-term)in relation to this environmental baseline shall be offset through the implementation of conservation measures(see Section 8.0;"Conservation Measures"). Conservation measures,including construction windows, erosion control and water quality Best Management Practices(BMPs) will be employed to minimize negative impacts within the Action Area and minimizing the probability of incidental take. Thereby,no incidental take is expected as a result of this proposed project. EnviroYbctor Page 29 8 September 2021 Engelbert Dock Project Biological Evaluation 8.0 CONSERVATION MEASURES 8.1 Proposed Project Conservation measures would be implemented to avoid and minimize potential impacts to water quality, shoreline habitat,marine habitat,and Federally-listed species in the Action Area(Table 4). Conservation measures are implemented within the design of the project, during construction, and during post construction to avoid and minimize potential project impacts (Table 5). These conservation measures include the application of erosion control and water quality Best Management Practices(BMPs)during and subsequent to construction. The measures will also include noise attenuation techniques to minimize noise generated impacts to terrestrial and marine environments with the Action Area. 8.1.1 Best Management Practices(BMPs) Erosion control and water quality BMPs will be implemented during construction to protect the water quality within the Action Area from possible impacts. During construction,a silt curtain will be installed around the construction area to minimize potential turbidity from entering marine waters. Implementing BMPs will act to minimize sedimentation and protect water quality in the Action Area during storm events. Silt fences, straw bales,and other structures will be installed to slow runoff and remove suspended sediments during construction. BMPs comply with the State Department of Ecology(DOE) Stormwater Management Manual of Western Washington,Volume II(DOE,2000)or as amended. BMPs will include,but will not be limited to: 1. The proposed dock activity will occur by excavator located on a construction mat placed on the graveled surface adjacent to the water or from a barge. Vibratory pile driver will be used to reduce noise impacts to background levels of recreational boating activities in the area. 8.2 Salmonids and Prey Species A silt curtain will be installed during the work to minimize the mobilization of suspended sediments. BMPs implemented during the proposed work are expected to prevent turbidity. Work will occur during WDFW prescribed work window to protect salmonids. Salmonid prey species that may occur in the Action Area primarily consist of surf smelt. Surf smelt are known to spawn in the Action Area. The proposed dock would occur during WDFW work windows to protect salmonids and their pray species. To protect fish and shellfish habitats at the job site,work below the ordinary high water line would occur from July 15 and February 15 in compliance with WAC 220-660-330---Authorized work times in saltwater areas for Tidal Reference Area#2,which includes Case Inlet(see Table 2). Due to the lengthy spawning period for surf smelt in this portion of Puget Sound,work should also be allowed from April 1 through December 31 and January 1 through June 30 of any year if a biologist trained by the Department of Fish and Wildlife confirms lack of surf smelt spawn during a site inspection. Work would begin within seventy-two(72)hours of survey. The biologist must follow the department-approved intertidal forage fish spawning protocol and use the standard department data sheets when conducting forage fish spawning beach surveys. 8.3 Marbled Murrelet No clearing will occur that would impact the marbled murrelet or its habitat. Majority of work will occur during mid-day when minimal marbled murrelet foraging activity is expected to occur in the Action Area. Page 32 8 September 2021 Engelbert Dock Project Biological Evaluation 8.4 Marine Mammals The same conservation measures taken for salmonids and the marbled murrelet would act to minimize impacts to marine mammals. Noise and vibration impacts would be minimal and occur for a very short period of time. If marine mammals were exposed to noise or vibrations from the dock,they would likely move away from the noise or vibrations. Conservation measures would limit noise and vibrations during normal work hours. The noise and vibrations would be minimal,and it is possible that any noise or vibrations associated with the action would not be detectable to marine mammals. 8.5 Yellow-billed Cuckoo The same conservation measures covering the marbled murrelet would act to minimize impacts to the yellow-billed Cuckoo. 8.6 Rockfish The same conservation measures taken for salmonids and marine mammals would act to minimize impacts to rockfish. 8.7 Operations No change in environmental characteristics from existing conditions is anticipated other than the footprint of the dock and mooring recreational boats at the dock. No clearing of vegetation is proposed for this project. Recreational boating would occur from the dock during boating season. Occasional boating during boating season would not likely increase noise levels beyond existing conditions within the Action Area. 9.0 ESSENTIAL FISH HABITAT 9.1 Background The Magnuson-Stevens Fishery Conservation and Management Act(MSA),as amended by the Sustainable Fisheries Act of 1996(Public Law 104-267),requires Federal agencies to consult with NMFS on all activities that may adversely affect Essential Fish Habitat(MSA 305(b)(2)). The 1996 amendments to the MSA resulted in a new emphasis on the sustainability of the nation's fisheries and established procedures designed to identify,conserve and enhance Essential Fish Habitat(EFH)for those species regulated under a Federal fisheries management plan(FMP). Essential fish habitat is defined as"those waters and substrate fish need for spawning,breeding, feeding,or growth to maturity"(NMFS,2001). The objective of this EFH assessment is to describe potential adverse effects to designated EFH for Federally-managed fisheries species within the proposed Action Area. It also describes conservation measures proposed to avoid,minimize,or otherwise offset potential adverse effects to designated EFH h resulting from the proposed project. Engelbert Dock Project Biological Evaluation 9.2 Identification of Essential Fish Habitat The Pacific Fisheries Management Council(PFMQ has designated EFH for the Pacific salmon fishery. The Pacific salmon management unit includes Chinook,Coho, and pink salmon(O. gorbuscha). The EFH designation for the Pacific salmon fishery is defined as"those waters and substrate necessary for salmon production needed to support a long-term sustainable salmon fishery and salmon contributions to a healthy ecosystem"(PFMC, 1999). Marine EFH for Pacific salmon extends from the nearshore and tidal submerged environments to sixty(60) kilometers(km)offshore of Washington,Oregon and California north of Point Conception. Chinook,pink salmon,and Coho all have Essential Fish Habitat(EFH) for adults and juvenile fish within Pickering Passage. EFH for Pacific coast groundfish is defined as the aquatic habitat necessary to allow for groundfish production to support long-term sustainable fisheries for groundfish and for groundfish contributions to a healthy ecosystem. The Pacific Coast groundfish FMP groups the various EFH descriptions into seven units called"composite"EFHs. This approach focuses on ecological relationships among species and between the species and their habitat,reflecting an ecosystem approach in defining EFH. Seven(7)major habitat types are proposed as the basis for such assemblages or composites. The Action Area has defined characteristics of the Rocky Shelf EFH composite zone. The Rocky Shelf is described as those waters,substrates,and associated biological communities living on or within ten(10)meters(5.5 fathoms)overlying rocky areas,including reefs, pinnacles,boulders and cobble,along the continental shelf,excluding canyons, from the high tide line(MHHW)to the shelf break(-200 meters or 109 fathoms)(NMFS,2001). Within this zone,numerous fish species utilize the Rocky Shelf(Table 6). In addition,a small portion of Estuarine EFH composite zone also occurs in the Action Area. The Estuarine EFH is described as those waters, substrates and associated biological communities within bays and estuaries of the coasts of Washington,Oregon,and California, seaward from the high tide line(MHHW)or extent of upriver saltwater intrusion. These areas are delineated from the U.S. Fish and Wildlife Service's National Wetlands Inventory(NWI)and supplemented from NOAA's Coastal Assessment Framework for the water portion of the Estuarine Drainage Areas for two small estuaries(Klamath River and Rogue River),the Columbia River,and San Francisco Bay. NWI defines estuaries as areas with water greater than 0.5 ppt ocean-derived salt.Within this zone,numerous fish species utilize the Estuarine EFH (Table 6). A summary of this determination is provided in Table 8. Table 8. Engelbert Dock Project Biological Evaluation 10.1 Effects on Chinook Salmon The proposed action with listed conservation measures should have "no effect"on Chinook salmon or their habitat. Juvenile Chinook salmon are not likely to occur in the work areas during the WDFW prescribed work window. No in-water work is proposed. Work would be performed during low tides when the majority of the work area would be above the tide line and in the dry. Outmigrating juveniles are not expected to occur in nearshore habitat during the work window. Potential impacts associated with noise and vibrations or from any unlikely turbid runoff are not expected to reach the juvenile chinook because none are expected in the Action Area during the in-water work window. Natural turbidity is generated from tidal action and from particulate matter washed down streams. Erosion control and water quality Best Management Practices(BMPs)will help to ensure that no significant impacts to waters within the Action Area occur as a result of this project. Conservation measures proposed during and after the proposed work are expected to maintain water quality. Avoidance mechanisms by adult fish would discourage occurrence near the work area in the unlikely event that an individual would wander near the site during the WDFW work window. No adverse impacts to Chinook habitat or prey base are expected to occur subsequent to the proposed dock because the float surface will not ground. Measures will be taken to protect forage fish and thereby no impacts to forage fish are anticipated. No effect to Chinook Critical habitat is expected because the float surface will not ground and any additional boating activity is not expected to exceed background noise levels of existing boating activities. 10.2 Effects on Bull Trout The proposed action with listed conservation measures should have "no effect"on bull trout or their habitat. In the unlikely event that an individual adult or subadult bull trout would access the Action Area during the proposed dock,conservation measures would minimize any potential impacts to that of insignificant levels. The same conservation and mitigation measures taken to protect Chinook salmon should also pertain to bull trout. WDFW(Rodrick and Milner 1991)advises the following management recommendations for streams that contain bull trout and steelhead: 1)maintain buffer zones along stream banks of at least the width of the height of the tallest tree or fifty(50)feet,whichever is wider,2)avoid road construction and maintenance activities, and 3)avoid in-stream structures, such as bridges, trestles,boat ramps, or culverts,that impede the natural movements of fish. These recommendations are intended to be implemented in smaller stream systems and do not necessarily apply to water of Puget Sound. Management recommendations for large bodies of water should be similar to that of Chinook salmon. No effect to Bull trout Critical habitat is expected because no Critical Habitat occurs in the Action Area. No alteration to their deep- water habitat is expected to occur as a result of this proposed action. No substantive change in the environment from existing conditions is proposed as a part of this dock project. No effect to Critical habitat is expected as a part of this proposed land use action. 10.4 Effects on Marbled Murrelet The proposed action with listed conservation measures should have "no effect"on marbled murrelet or its habitat. No breeding occurrence was documented within the Action Area. No Critical Habitat occurs within the Action Area. It is possible for the marbled murrelet to forage in the marine portion of the Action Area. Conservation measures will be applied to minimize construction noise and other potential impacts during times of possible foraging activities. No effect is expected to occur on Critical Habitat because no Critical Habitat occurs in the Action Area. 10.5 Effects on Yellow-billed Cuckoo The proposed action with listed conservation measures should have "no effect"on the yellow billed cuckoo or its habitat. No breeding occurrence was documented within the Action Area. No preferred riparian willow-dominated habitat occurs within the Action Area. No Critical Habitat occurs within the Action Area. Sightings of killer whales are not uncommon in Case Inlet. Although it is possible for killer whales to wander into the Action Area during construction activities,no construction noise or vibrations or exhaust by construction equipment is expected to occur greater than levels familiar to individuals of the species that frequent the Puget Sound area. Avoidance behavior would allow the whale to move off to other waters outside of the Action Area if annoyed by construction activities. The construction activities are not expected to affect prey species or the habitat of prey species. Sedimentation and erosion BMPs will be implemented to prevent turbid runoff that might affect prey species. No permanent change to existing environmental conditions is expected. No long-term impacts to killer whale habitat or to the habitat of its pry species is expected. No effect to Critical Habitat of the killer whale is expected to occur as a result of the dock proposal. No effect is expected to occur on Critical Habitat because the dock placement is too close to shore to affect killer whale habitat and because any future boating from the dock would not expect to exceed background levels. 10.7 Effects on Candidate Species No candidate species are included in this BE. 10.8 Effects on Essential Fish Habitat The proposed action with listed conservation measures will have "no effect"on Essential Fish Habitat(EFH).
