MASTER PROGRAM PROVISIONS & SPECIAL CONDITIONS This permit is granted pursuant to the Shoreline Management Act of 1971 and nothing in this permit shall excuse the applicant from compliance with any other federal, state or local statutes, ordinances or regulations applicable to this project,but not inconsistent with the Shorline Management Act (Chapter 90 .58 RCW) . This permit may be rescinded pursuant to RCW 90 .58 . 140 (7) in the event the permittee fails to comply with the terms of conditions hereof . CONSTRUCTION PURSUANT TO THIS PERMIT WILL NOT BEGIN OR IS NOT AUTHORIZED UNTIL THIRTY (30) DAYS FROM THE DATE OF FILING THE FINAL ORDER OF THE LOCAL GOVERNMENT WITH THE REGIONAL OFFICE OF THE DEPARTMENT OF ECOLOGY AND THE ATTORNEY GENERAL, OR UNTIL ALL REVIEW PROCEEDINGS INITIATED WITHIN THIRTY (30) DAYS FROM THE DATE OF SUCH FILING HAVE TERMINATED.No permit authorizing construction shall extend for a term of more than five (5) years . Development shall be undertaken pursuant to the following additional terms and conditions : Date horized Dept . of Ecology Official SHR_PRMT, rev: 03/24/92 I CONDITIONS FOR SBR96-0008 VICTOR SEAMANS STEEL BEAM/CONCRETE SLAB AND RAILROAD CAR BRIDGE OVER THE UNION RIVER 1) Excess construction materials shall be removed from the shoreline area. 2) All excavation materials and soils exposed to erosion by all phases of construction shall be stabilized and protected by seeding, mulching or other effective means, both during and after construction. 3) Storm water runoff shall be controlled to reduce suspended solids and other pollutants before entering the creek. 4) Existing in-stream crossing to the north shall be removed from the site. 5) No further bank stabilization, such as rock, be installed on the site unless appropriate permits are obtained. 6) The bridge must be high enough (minimum of three feet above the 100-year flood elevation) to pass all expected debris and anticipated high water flows from a 100-year flood. 7) The applicant shall comply with the specifications of the Hydraulic Project Approval as finalized by the Washington Department of Fish and Wildlife Habitat Specialist. S) If the property is proposed for future subdivision by the applicant or owner, the bridge crossing would need to be reviewed for adequacy as part of that proposal.
