property from the road access.he was unable to drive on this area before the fill.first a load of gravel was spread just inside the asphalt
sleeve,then a large black tarp with gravel placed on top of this straight east toward the water.unknown preparation/drainage under the
tarp/gravel.he gradually filled enough to park a motor home furthest out East toward the water,then closer in a boat on a trailor and

then his truck closest to the road.Off to the right(south)he has filled enough to park a travel trailor.Further to the right(south)is the site
of an illegal fill done by the previous owner to create a dry road access off the NW comer of our property.(in 2000-2001).He did know it
was our property at the time.There was a hearing held for this violation and the dirt ordered to be taken out.Almost all/if not all the dirt
is still there.The current occupant has been very gradually filling on this same road area with what I would guess is wheelbarrow loads of
dirt since it is so gradual.This fill is extending far enough south to intrude back onto our property following the location of the older road
fill violation.This maintaining and enhancing of the road then approaches and accesses northbay Rd by foot only.He was initially told by
the actual current owner of the property that there was an easment to her property from the north comer our our lot.There never has
been an easement and none is recorded.He was initially asked to not use our property and has not honored this request.He was told in
his preinspection from Mason County to get permits for any development and has failed to get ANY permits.He now has power to the
property.A sewer connection is available on the property placed by previous owner but I do not know if he has paid to hook up to take
care of his sewage.Multiple calls have been placed to the planning dept of the county to inform them of the continued activity but no
action has been taken as far as we can see.

Caller has had no response to the original complaint sent in on 612/14 and is wondering what IF anything is going on. As I(Connie
Juneau)was entering this information I noticed the road was spelled incorrectly and the wrong parcel number was given. I've made the
correction on this report above.

Dear Mr. Borden, I am writing to you to describe the traditional and historical uses and previous
development of the property at 1190 E. North Bay Rd,Allyn Wa.
The property has been used as a log boom, evidenced by historical records and local knowledge,there
are remnants of infrastructure consistent with this past use. It has been used as a shellfish farm,
evidenced by oyster bays built and still existing to an extent in the adjacent tideland. Based on the
orchard and garden, and pieces of old china plates I have found therein, consistent with local legend, it
was also a homestead at one point. Most recently it has been used as a recreational property and for
the agricultural aspects of existing fruit bearing trees.And of course the bees I am keeping in
conjunction with same.
My proposed project is a small and minimal impact development consisting of existing infrastructure
and a reasonable residence utilizing existing driveways, sewer, bulkhead and other previous
infrastructure. I believe the project is well suited to the site, the zoning and the area. I appreciate your
time in previously inspecting the property and look forward to a point when I am financially ready to pull
permits and begin construction. In the meantime I intend to erect two small, exempt storage sheds, one
for tools and one for materials and agricultural uses both consistent with current on site uses and
previous development.Thank you again for taking time to meet with us. I regret that you/we have been
repeatedly harassed by my neighbors, who built a 4000 sq ft concrete and asphalt development and
intentionally burned down the old house in order that they did not have to pay to demolish it.Their
selfish and self motivated agenda has nothing to do with the environment. It is instead an illegal
intention to interfere with the permitting process for reasonable use of the property between them and
the park. I trust that you will not allow their ill wishes to influence the ongoing permitting process I have
followed since the beginning. Enclosed please find the letter and map from State of Washington
biologist Mark Eckhart regarding the distances to the vegetative buffer we discussed at your first and
second visits to the property.Thank You again for your time.

Hi Connie,
Allan Borden and I conducted a site visit to the property today. We met briefly with the tenant and
explained the allegations in the report related to potential wetland fill and lack of permits. The tenant has
agreed to another meeting in the next two weeks to more thoroughly inspect the site and discuss
permitting and other regulatory issues related to the existing development and future proposals. Allan
will be scheduling that site visit.
Based on a cursory inspection of the developed footprint, it does not appear that the tenant has placed
any fill or structures in wetlands. The vegetation surrounding the development footprint includes bigleaf
maple, Western Hemlock, red elderberry and Himalayan blackberry. In addition, Mason County staff s
pre-inspection report indicates that the fill footprint is within a previously established driveway and
parking pad.
The ERTS complaint references an unauthorized fill that was the subject of a violation in Mason County
in 2002-3. It is unclear to me whether the fill for the driveway is the fill that was the subject of an
earlier enforcement action. Resolution of this issue rests with the County.
