The SUP is approved 10 with conditions. I I ORAL TESTIMONY 12 Kell McAboy, Mason County planner, summarized the proposal. She stated the applicant wishes to convert 624sf of an existing detached garage into an accessory 1 dwelling unit. There is an approved 2-party well and a 3-bedroom septic system. 14 There is adequate parking on site. In response to the examiner, Ms. McAboy stated the existing garage is located within a wellhead protection zone. No exterior 15 expansion of the structure is proposed. 16 Christal Farster, applicant, stated the house is 2-bedroom. No new septic tank is needed for the existing 3-bedroom design to allow for the addition of the ADU. The 17 Mason County Health Department has already approved the septic. 18 Leslie Nuttman, neighbor, spoke in opposition to the application stating Ms.Farster is 19 a bad neighbor. Though she won't try to block the application, she requested a solid fence be built along the property line at the applicant's expense. She stated she is 20 concerned the septic is inadequate. She also asked whether MCC 17.04.223, the 21 limitation on the size of lots, is applicable to this lot. 22 Des Arnsby, neighbor, stated he had requested information regarding the applicant's septic design. In 2010 the applicant installed a curtain drain within 15 feet of the drain 23 field.He wasn't sure this was a permitted action. 24 John Mark Nuttman, neighbor, also asked about the applicability of MCC 17.04.223. He stated he didn't want to see the ADU become a rental. He said the new septic 25 system was in response to a prior well leak which flooded the drain field. He believes the applicant's septic system and drain field have failed and appear to be contaminating a nearby ditch. SUP/ADU P. I Findings,Conclusions and Decision II Lola Ayers, applicant's mother, sated the ADU was being built for her. Her husband 1 had recently passed after a long illness. She herself is disabled. The ADU will be 2 accessible for her wheelchair. The ADU will allow her to live near her kids. She has financed repairs to the exterior of the garage structure already including new fascia and a roof. She stated the drainage was an eyesore prior to the new septic system. It used to be stagnant water.After the curtain drain installation,the area dried up. 4 Kell McAboy stated the County allows up to 7-foot solid fences but does not want to see this as a condition of approval since the impacts to neighbors is minimal. With 6 respect to MCC 17.04.223, the County allows one ADU per substandard lot when all other code requirements are met.The proposal meets this threshold. She stated though 7 the Shoreline Master Plan limits the occupancy types of ADU in the shoreline jurisdiction, there are no such codes outside the shorelines. Ms. McAboy noted 8 subsequent to the SUP, the applicant will need building permit approval and environmental review. The proposed utilities must be approved by the Department of 9 Health prior to occupancy of the ADU. 10 1 1 EXHIBITS 12 The seven exhibits identified in the Case Index of the May 11, 2017 staff report were 1> admitted into the record during the hearing. 14 FINDINGS OF FACT 15 Procedural: 16 1. Applicant. The applicant is Christal Farster. 17 2. Hearing. A hearing was held on the application on May 24, 2017, at 1:00 18 p.m., in the Mason County Board of Commissioners Meeting Chambers. 19 Substantive: 20 3. Site/Proposal Description. The applicant is converting 624sf of an existing 21 detached garage into an ADU. The applicant lives in the primary dwelling. The applicants' mother will live in the ADU. The lot is 0.72 acres located on Chronquist 22 Road off the Grapeview Loop Road near Case Inlet. 23 The site is developed with an existing 2-bedroom home and detached garage. The 24 existing driveway is long and there is adequate parking for both the ADU and the primary dwelling unit, even with conversion of the existing garage into an ADU. The 25 ADU will be located approximately 25 feet from the principal dwelling (Ex. 3). The site is outside of shoreline jurisdiction. SUP/ADU p. 2 Findings, Conclusions and Decision Both the house and garage are within the 100-foot wellhead protection area. No 1 exterior expansion of the garage structure is proposed. 2 The property has a two-party well and a 3-bedroom septic system. There are two bedrooms in the existing residence and one proposed bedroom in the ADU. The existing septic system is adequate to serve both units. Drainage on the site flows 4 toward the road. The septic system and drain field are located between the road and the house.No clearing or grading is proposed. 6 The proposed ADU has one bedroom, one bathrooms, a living room, a utility/storage room and a kitchen. The proposed ADU is not a recreational. Once approved, the 7 proposed ADU will be the only ADU structure on the property. A parking area for the proposed ADU will be provided. 8 4. Characteristics of the Area. The area is a low-density platted residential 9 subdivision. Properties to the east of the subject and across Chronquist Road are 10 vacant. The property to the west is a large, undeveloped tract. Properties to the north and south are developed with large lot single family homes. 11 5. Adverse Impacts of Proposed Use. According to the information provided 12 by staff in its report and testimony, there does not appear to be an impact on surrounding properties for traffic, parking, or drainage. This is apparent from the site 13 plan and aerial photograph, which diagram the surrounding area adjacent to the 14 subject parcel (Ex. 3). The ADU will be within an existing structure and no significant visual impact beyond the existing conditions is anticipated. Given the 15 spacing of homes in the neighborhood, the increase in density proposed by the applicant should not be noticeable to surrounding residences. An existing and 16 adequate septic system and 2-party well are in place. Staff reports that the proposal 17 will not lower level of service standards below adopted minimums for parks or transportation facilities. Given these factors, the proposal creates no discernable 18 adverse impacts. 19 CONCLUSIONS OF LAW 20 Procedural: 21 1. Authority of Hearing Examiner. MCC 15.03.050(10) and 17.05.42 22 provide the Examiner with the authority to review and act upon Special Use Permits. 23 Substantive: 24 2. Zoning. The area is zoned Rural Residential-5. 25 3. Review Criteria and Application. MCC 17.03.029 governs ADUs in rural lands. Under MCC 17.03.029, ADUs in rural lands shall be subject to a Special Use Permit, unless they are located in the shoreline jurisdiction, in which case they are SUP/ADU p. 3 Findings, Conclusions and Decision subject to a shoreline permit. The proposed ADU is not within 200 feet of the I shoreline and, therefore, shall not be reviewed per the Shoreline Master Program 2 policies and use regulations. The review criteria for the Special Use Permit application are governed by MCC 17.05.044. These criteria, in addition to 3 miscellaneous criteria for all Hearing Examiner decisions, are quoted and addressed below. 4 MCC 17.05.044 SPECIAL USE REVIEW CRITERIA: 5 6 (1) That the proposed use will not be detrimental to the public health, safety and welfare. 7 4. There are no significant adverse impacts associated with the proposal as 8 determined in Finding of Fact No. 5. Given these factors, there will be no detrimental 9 impact to the public health, safety, and welfare as a result of the proposed ADU. 10 (2) That the proposed use is consistent and compatible with the intent of the Comprehensive Plan. 11- 5. The ADU is consistent and compatible with the intent of the 12 Comprehensive Plan. Chapter 9 of the Mason County Comprehensive plan provides that ADUs should be permitted "when minimal impact would occur to surrounding 3 areas. The cumulative impact of like structures on neighboring properties must be 14 considered." As noted in the Findings of Fact, the size of the proposed ADU is relatively small, but it will be in an area characterized by relatively large lots 15 compared to the size of the ADU being proposed. Due to the large lot sizes, no adverse cumulative impacts are anticipated. As further found,the ADU will not create 16 any adverse impacts and hence will have minimal impacts on surrounding areas. 17 Given these factors, the approval of other ADUs in the area also will not create any cumulative adverse impacts. 8 (3) That the proposed use will not introduce hazardous conditions at the site that 19 cannot be mitigated through appropriate measures to protect adjacent properties and the community at large. 20 21 6. No hazardous conditions are expected, nor have any been identified as a result of the proposed ADU.No adjacent properties, nor the community at large, will 22 be impacted by the introduction of hazardous conditions from the ADU. 23 (4) That the proposed use is served by adequate public facilities which are in place, or planned as a condition of approval or as an identified item in the County's Capital 24 Facilities Plan. 25 7. As determined in Finding of Fact No. 5, individual water and septic systems are in place to serve the proposed ADU. According to the staff report, the addition of an ADU should not lower the level of service of transportation or SUP/ADU p. 4 Findings, Conclusions and Decision neighborhood park facilities below applicable minimum standards and there is no 1 evidence to the contrary. The criterion is met. 2 (5) That the proposed use will not have a significant impact upon existing uses on 3 adjacent lands. 4 8. As determined in Findings of Fact No. 5, no significant impacts are 5 expected to result from this proposal, including impacts on adjoining properties. 6 (6) If located outside an Urban Growth Area, that the proposed use will not result in the need to extend urban services. 7 9. The addition of an ADU and its use by a single family should not result in 8 a need to extend urban services. The site is accessed from existing roads. The ADU will be served by individual septic system and well. Therefore, the project will not 9 result in the need to extend urban services. MISCELLANEOUS CRITERIA FOR ALL HEARING EXAMINER REVIEW: 11 MCC 15.09.055(C): Required Review: The Hearing Examiner shall review 12 proposed development according to the following criteria: 1' 1. The development does not conflict with the Comprehensive Plan and meets 14 the requirements and intent of the Mason County Code, especially Title 6, 8, and 16. 15 2. Development does not impact the public health, safety and welfare and is ' in the public interest. 16 17 3. Development does not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the 18 Comprehensive Plan. 19 10. According to staff, the proposed development complies with the Mason County Code, including Title 6 and 8. The project is not subject to Title 16, which 20 only governs subdivisions. As confirmed by staff in the staff report, the proposed 21 ADU with one additional residence should not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards 22 established within the Comprehensive Plan. The project will also have no adverse impact upon health, safety and welfare since it will not create any significant adverse 23 impacts as determined in Finding of Fact No. 5. 24 The ADU meets the specific requirements for ADUs in rural lands as laid out in MCC 25 17.03.029 because the owner of the proposed ADU will occupy the primary residence; the size of the ADU is less than 1000 square feet and is less than 80% of the primary residence; only one ADU will result from the project; adequate parking is provided for the ADU; the ADU is located within 150 feet of the primary residence; SUP/ADU p. 5 Findings, Conclusions and Decision according to staff all setback requirements are satisfied; and the ADU will be served 1 by County approved water and septic. 2 DECISION 3 The proposed ADU is consistent with all applicable SUP standards as outlined above 4 and is approved subject to the following conditions. 5 1. Prior to issuance of a certificate of occupancy for the ADU, the applicant must 6 have approval from the County Environmental Health Department to ensure the two-party well and existing septic system are adequate to serve the principal 7 dwelling and accessory dwelling unit and meets all health and safety requirements. 8 2. Introduction. This report evaluates a proposal for the conversion of a detached garage to an Accessory Dwelling Unit. The completed unit will be 624 square feet of living space. Staff recommends approval of the Special Use Permit. II. Applicant. Christal Farster. III. Property Location. 441 E. Cronquist Rd.; Allyn, WA 98524. The proposal is to convert 624 square feet of an existing detached two-car garage into an Accessory Dwelling Unit on a parcel with an existing main residence that is approximately 925 square feet. See site plan (Exhibit 3). V. Evaluations. A. Characteristics of the site. The 0.72 acre lot is approximately 100' wide X 315' deep located on Chronquist Road off the Grapeview Loop Road near Case Inlet. The property is surrounded on all sides by residential zoning and residential development, except for the west property line, the adjacent property is vacant and undeveloped. Currently the property is developed with a single story principal residence, an existing detached two-car garage and a small detached storage shed. The site is relatively flat and there are no critical areas on or near the property. B. Characteristics of the area. The area is characterized by low-density platted residential development in the Grapeview area, upland from Case Inlet off of the Grapeview Loop Road. C. Shoreline Designation. Not Applicable. D. Comprehensive Plan Designation /Zoning. The Mason County Comprehensive Plan designation for the site is Rural and the zoning is Rural Residential 5. VI. SEPA Compliance. Project is SEPA exempt per WAC 197-11-800 (1)(b)(i). VII. Other Permits/Approvals. The proposal will require a Mason County Building Permit for the residential (ADU) conversion. A Notice of Application and Public Hearing (Exhibit 4) was posted in the Mason County Journal on 5/11/2017 (Exhibit 6). Notice was posted on site on 5/11/2017 (Exhibit 5) and mailed to neighboring properties on 5/8/2017 (Exhibit 6). A single comment letter with multiple signatures from the neighborhood has been received as of the date of this report (Exhibit 7). Vill. Analysis. A Comprehensive Plan Review: Type III review for permit applications require that the Hearing Examiner evaluate the proposal for consistency with the County's Development Code, adopted plans and regulations. The Hearing Examiner shall review the proposal according to the following criteria: 1) The development does not conflict with the Comprehensive Plan and meets the requirements and intent of the Mason County Code, especially Title 6, 8 and 16. The development does not conflict with the Comprehensive Plan and meets all the requirements and intent of the Mason County Code. 2) The development does not impact the public health, safety and welfare and is in the public interest. The development proposal will not impact the public health, safety or welfare. The development proposal will not lower the LOS for transportation or neighborhood park facilities. This proposal requires a Special Use Permit due to the requirements of the Mason County Development Regulations, dated June 2, 2009, section 17.03.029. Applicable Development Regulations as listed under section 17.03.029 are: A. The ADU shall be subject to a special use permit, unless in the shoreline jurisdiction it is subject to a shoreline permit. B. The owner of the ADU must reside on the lot in either the principal residence or ADU. C. The ADU shall be located within 150 feet of the principal residence or shall be a conversion of an existing detached structure (i.e. garage). D. The ADU shall not exceed 80% of the square footage of the habitable area of the primary residence or 1,000 square feet, whichever is smaller. E. All setback requirements must be met by the ADU. F. All applicable health district standards for water and sewer must be met by the ADU. G. No recreational vehicles shall be allowed as ADUs. H. Only one ADU is allowed on any property. I. An additional off-street parking space must be provided for the ADU. The ADU as proposed meets all of the above criteria A —1. Applicable Special Use review criteria: 1. Will the proposed use be detrimental to the public health, safety and welfare? The placement of the ADU meets all county setbacks and assures adequate off street parking. No potential detrimental effects have been identified. 2. Will the proposed use be consistent and compatible with the intent of the Comprehensive Plan? The proposed use is consistent and compatible with the Comprehensive Plan. Rural Residential 5 zoning does allow for one ADU per parcel. 3. Will the proposed use introduce hazardous conditions at the site that cannot be mitigated through appropriate measures to protect adjacent properties and the community at large? No hazardous conditions are expected as a result of the proposal. 4. Is the proposed use served by adequate public facilities, which are in place, or planned as a condition of approval or as an identified item in the County's Capital Facilities Plan? If located outside an Urban Growth Area, will the proposal result in the need to extend urban services? The addition of an ADU would not result in a need to extend urban services. Project Analysis: Based upon these policies and regulations, the project conforms to the policies and use regulations of the Mason County Development Regulations with regards to Accessory Dwelling Units. IX. Conclusions. As designed the project is consistent with the Mason County Development Regulations. Staff recommends approval. X. Choices of Action. 1. Approve. 2. Approve with conditions. 3. The next door neighbor to the south called yesterday voicing concerns that the p 9 Y Y 9 septic drain field is not sufficiently sized for both a house and an ADU and thinks that the drain field might even be failing for the existing residence.
