The expansion includes an 8'X7' float as an extension of an existing 8'X24' float and construction of an 8'X32' float at an "L" to the 8'X7' float extension. Install 3 chemonite treated wood piling. This permit, with conditions, is granted pursuant to the Mason County Resource Ordinance excuse the applicant from compliance with 1 MCC. Nothing in this permit shall ex pp P (Chapter 17.0 ) g any other federal, state, or local statutes, ordinances, or regulations applicable to this project. This permit may be rescinded if the permitee fails to complete the project as proposed or fails to comply with the standards of this ordinance. Authorized Local Government Official Date 1 Mason Environmental Permit 7/10/2009 Case No.: MEP2009-00010 Conditions: 1.) All construction and demolition debris must be removed from the beach after project completion. Proper disposal of construction debris must be on land in such a manner that debris cannot enter or cause water quality degredation of State waters. 2.) Water quality is not to be degraded to the detriment of the aquatic environment as a result of this project. 3.) Recreational piers shall be no higher than 11 feet above MHHW. Floatation for the structure shall be entirely enclosed and contained to permanently prevent the breakup or loss of the floatation material into the water. Orient the floatation so that it does not obstruct the grating. 4.) Pressure treated wood must be completely dry prior to placement in water. Use of creosote or pentachlorophenol is prohibited. Install plastic wear strips between the float and the pilings to reduce treated wood chafe. 5.) Any discharge of sediment-laden runoff or other pollutants to waters of the state is in violation of Chapter 90.48, Water Pollution Control and WAC 173-201A, Water Quality Standards for Surface Waters of the State of Washington and is subject to enforcement action. 6.) Proper erosion and sediment control practices must be used on the construction site and adjacent areas to prevent upland sediments from entering shoreline waters. Erosion control measures must be in place prior to any clearing, grading, or construction. These control measures must be effective to prevent soil from being carried into surface water by stormwater runoff. Sand, silt, and soil will damage aquatic habitat and are considered pollutants. Any discharge of sediment-laden runoff or other pollutapollutants to waters of the state is in violation of Chapter 90.48 RCW, Water Pollution Control, and WAC 173-201A, Water Quality Standards for Surface Waters of the State of Washington, and is subject to enforcement action. Any work in or adjacent to waterways that will adversely affect water quality must receive specific prior authorization from the Department of Ecology pursuant to WAC 173-201A-110. A short-term water quality standards modification may be issued if the proponent agrees to a number of specific construction practices and techniques designed to minimize water quality impacts. All areas disturbed or newly created by construction activities must be revegetated using bioengineering techniques, clean durable riprap, or some other equivalent type of protection against erosion when other measures are not practical. 7.) Temporary erosion control measures must be implemented to prevent water quality degradation of adjacent waters or wetlands. Silt fencing must be installed and maintained until upland vegetation has become established. 8.) All trenches, depressions or holes created in the intertidal area shall be backfilled prior to inundation by tidal waters. All stormwater discharges must be constructed in a manner that will not cause scouring on the beach. 9.) Best management practices are to be implemented. 10.) All facilities are to be constructed and maintained in a safe and sound condition. Abandoned or unsafe docks and piers shall be removed or repaired promptly by the owners. Where any such structure constitutes a hazard to the public, the county may, following notice to the owner, abate the structure if the owner fails to do so within a reasonable timeand may impose a lien on the related shoreline property in an amount equal to the cost of the abatement. 11.) All mitigation proposed by both applicants within the habitat Managment Plan prepared by Marine Surveys and Assessments and dated 2/9/09 must be implemented and maintained on the structure and the uplands. 12.) The submitted joint-use agreement between the adjacent property owners must be recorded within the Mason County Auditor's Office under each applicant's parcel. Approved per dimensions and setbacks on submitted site plan. 14.) Title notification of Habitat Management Plan (HMP) must be recorded with the Mason County Auditor and a copy submitted to the Planning Department prior to work being started. 15.)
