Your permit authorizes the expansion of an existing single use pier, ramp and float from 100-feet long to a I I5-feet long joint-use facility by adding an 8-foot by 7-foot float extension to the existing float, and an 8-foot by 32-foot float as an 'L'. All work will occur within shoreline jurisdiction of Case Inlet/South Puget Sound (Chapter 90.58, RCW). By law, local governments must review all SDPs for compliance with the following: • The Shoreline Management Act (Chapter 90.58 RCW) • Ecology's Substantial Development Permit approval criteria(Chapter 173-27-150 WAC) • The Mason County Shoreline Master Program Local governments, after reviewing the SDP for compliance, are required to submit the SDPs to Ecology for filing. Before you begin activities authorized by this permit, the law requires you to wait at least 21 days from the date we received the decision letter from County/City on 7/16/2009. This waiting period allows anyone who (including you) disagrees with any aspect of this permit, to appeal the decision to the state Shorelines Hearings Board. You must wait for the conclusion of an appeal before you can begin the activities authorized by this permit. If no appeal is submitted you may begin activities any time after 8/6/2009. The Shorelines Hearings Board will notify you by letter if they receive an appeal. We recommend, however, you contact the Shorelines Hearings Board before you begin permit activities to ensure no appeal has been received. They can be reached at(360) 459-6327 or http://www.eho.wa.gov. If vou want to appeal this decision, you can find appeal instructions (Chapter 461-08 WAC) at the Shorelines Hearings Board website above. Joint Use DeOn and Construction: The current and future Joint Use Owners agree to and recognize the requirements for construction,use, and mitigation requirements associated with the joint use pier, ramp, and float structure located on Parcel# 1223240001040 , fiften feet from the north property line. The current and future Joint Use Owners shall have and undivided one-half interest in the joint use pier,ramp, and float structure and the water area contained within the structure area attached hereto as Exhibit D. 3. Expenses: All expenses concerning the joint use pier,ramp, and float structure shall be shared equally. Such costs include, but are not limmited to,the following: a. Application and permit fees; b. All taxes; c. Design and construction costs; d. Maintenance and repair costs; and e. If applicable,premiums for the property insurance at replacement value or other insurance stipulated. 4. Repairs and Maintenance: The Joint Use Owners agree to keep the joint use pier, ramp, and float structure in good order and repair. Improvements: Any improvements shall be discussed prior to commencement of construction and the sharing of costs shall be by further agreement. Such improvements are subject to all applicable governmental permits and approvals. 6. Access Rights: The Joint Use Owners herby convey and warrant to the owners and future owners of the affected parcels an access easement over and across the affected parcels as is reasonable and desirable to gain ingress and egress to the joint use pier,ramp, and float structure. 7. Exclusive Use: The joint use pier,ramp, and float structure and any of its improvements are for the exclusive and sole use and benefit of the Joint Use Owners and future owners of the affected parcels.No Joint Use Owner shall grant rights of any kind whatsoever concerning the use and benefit of the joint use pier,ramp, and float structure without the prior written consent of the other Joint Use Owners.No Joint Use Owner shall occupy more than their respective one-half of the water space located within the joint use pier,ramp, and float structure area, including bumpers and/or pads, whether located on the joint use pier,ramp, and float structure itself or on the boat. All boats moored at the joint use pier,ramp, and float structure shall be kept seaworthy and shall be kept maintained by the Joint Use Owner mooring the boat.No boats shall be used as live- aboards while moored at the joint use pier,ramp, and float structure. 8. Waiver of Responsibility: All Joint Use Owners shall carry and show proof of adequate liability and casualty insurance for himself/herself and any authorized individuals, and will be required to sign a liability waiver. The Joint Use Owners agree to keep the joint use pier,ramp, and float structure and premises clean,orderly and as free as possible from all flammable substances. Each Joint Use Owner shall indemnify and hold all other Joint Use Owners to this agreement harmless from any loss, damage, injury, cause of action or claim resulting from any and all acts or omissions of that Joint Use Owner,his or her agent, guest, or other persons or entities on or utilizing the premises at the Joint Use Owners request. 9. Binding Effect: This agreement shall be binding upon and insure to the benefit of the current and future Joint Use Owners,their heirs, successors and assigns of the affected parcels,and all covenants contained herein shall run with the land and this joint use agreement shall be recorded on the deed or title for each parcel. 10. In the event either Joint Use Owner to this agreement fails to pay his share of costs and expenses, such share shall be a chare and lien on the property of the person liable and also the personal obligation of the person who was the owner of the property at the time the costs were incurred. Such chare and lien may be enforced by any Joint Use Owner to this agreement. There shall be added to the amount of such charge all costs,expenses and attorneys' fees reasonably incurred in enforcing the same. The lien provided for by this paragraph shall be subordinate to the lien of any institutional mortgage or deed of trust. 11. In the event of any legal action or proceeding by either of the Joint Use Owners to enforce any part of this agreement,the prevailing Joint Use Owner shall be entitled to its reasonable costs and expenses of such action or proceedings, including reasonable attorneys' fees. 12. In the event of any dispute between the Joint Use Owners as to the necessity for repairs and maintenance,the matter shall be referred to arbitration under the rules of the American Arbitration Association and the result shall be binding on the Joint Use Owners.The prevailing Joint Use Owner shall be entitled to his cost and expenses and reasonable attorneys' fees. 14.
