Below you will find comments made regarding the proposed development and its critical values. In some cases, setbacks for development from shorelines, steep slopes, streams, and wetlands must be included in your specific proposal; these setbacks are included as part of the comments listed below. This information is based on County and State regulations as they exist to date. These regulations may change and may affect the requirements for development of the subject property. Sincerely, 4 &Xtz_" Allan Borden Land Use Planner Mason County Planning Department 2/3/2009 Page 1 of 5 SP12004-00351 Site Inspection 2/3/2009 Case No.: SP12004-00351 Comments: Pre-inspection for Jack & Jacqueline Holl on Jan. 6, 2005: The pre-inspection was made to evaluate additions to a single family residence on a 5.03 acre parcel located on the west shoreline of Case Inlet. The depth of the parcel ranges from 900 to 1050-foot deep along the 250-foot wide parcel. Most of the upland property has some evergreen or deciduous trees and an area developed with residence, carport, outbuildings, and pole building near the shoreline. The parcel has some low slopes throughout and a 15-foot high saltwater bank in the east part of the property. The proposed development would be located at the proper setbacks based upon this inspection. These findings state regulations in effect at inspection time, unless noted otherwise. Development Regulations standards: The site is in Rural Residential 5 zone. Standard building setbacks are 25-foot front yard setback, and 20-foot side property line and rear yard setbacks. These setbacks are measured from structures above grade such as roof overhangs, stairs, balconies, decks, heat pumps, storage buildings, and fuel tanks. _Y_ An administrative variance may be requested to reduce these setback distances from property lines, to as low as 5 feet (side yard), if the size, shape, or features of the property constrain development from the proper setbacks. This process requires application and review at the time of the building permit submittal. Resource Ordinance Standards: _Y_ Slope or Landslide hazards: Slopes greater than 15 percent adjacent to or within 300 feet of a proposed project, that are the result of wave erosion and undercutting, were observed along the shoreline area of the property. When proposing development, the applicant shall have a qualified geologist or engineering geologist visit the subject parcel and prepare a site analysis to determine whether a geologic special report is needed during development review. _Y_ Slope or Landslide hazards: If the geologist confirms the need for a special report when slopes are over 40 percent, a Geotechnical Report would be needed to address slope stability, site conditions, and the other requirements of the enclosed landslide hazard chapter 17.01.100 section E. 5. as required by the Mason County Resource Ordinance. The report must include all Resource Ordinance requirements and a submittal checklist 2/3/2009 Page 2 of 5 SP12004-00351 Site Inspection 2/3/2009 Case No.: SP12004-00351 noting where these requirements are found in the study document. _Y_ Slope or Landslide hazards: The prepared special report shall be specific to proposed site development (logging and site preparation) on the subject parcel by addressing clearing, grading, driveway and building location, retaining walls, and stormwater control. This special report would be submitted and evaluated at the time of building permit submittal. The study shall address the presence of the septic system on site stability conditions. _N_ Wetland critical area: Planning staff confirmed that the parcel does not contain certain wetlands, which are regulated under Mason County's Wetlands chapter 17.01.070 of the Mason County Resource Ordinance. The applicant will not need a wetlands special report during development review. _N_ Stream setbacks: No seasonal or perennial drainage flows through the subject property; the outlet drainage of Eberhardt Cove is much farther south. The proposed development is greater than 200 feet from the any stream management area covered by the standards of this critical area. _Y_ Shoreline setbacks: The shoreline designation for Case Inlet is Urban Environment per the Mason County Shoreline Master Program and development setbacks would be determined by the Mason County Resource Ordinance. The shoreline setback is determined by averaging the distance of setback from the roofline of the adjacent residence on each side of the subject parcel to the ordinary high water mark (OHWM) of the Case Inlet shoreline. Any portion of the new structure, including decks, balconies, and rooflines, must be behind this common line. Shoreward of this line for 15 feet toward the shoreline is an area that may be used for lawns, patios or landscaping (development at grade level). From that point toward the shoreline is considered to be a required vegetated buffer that must remain and is regulated by the Mason County Resource Ordinance Fish and Wildlife Habitat Conservation Areas Chapter. Within this chapter are those activities listed that can be done both with and without a Mason Environmental Permit; proposed tree limbing and limited cutting of trees in the buffer for view improvement are reviewed by the area permit planner prior to starting these type of activities. Staff measured the proportional setback from the OHWM of the Case Inlet shoreline to a proposed building site. There is no residence less than 150 feet to the south of the subject parcel; the default shoreline setback is 100 feet. The shore setback of the 2/3/2009 Page 3 of 5 SP12004-00351 Site Inspection 2/3/2009 Case No.: SP12004-00351 roofline of the residence to the north is 35 to 40 feet from the saltwater OHWM. The proportional setback for a structure on the subject parcel is [(100 + 40) / 2 =] 70 feet from the Case Inlet OHWM; this distance would be composed of 55 feet vegetation buffer along the saltwater and a 15-foot building setback on the upland side of the vegetation buffer. As stated above, all development above grade in height (additions, new covered patios, gazebos, pools, spas, fencing) must be behind this distance as shown on enclosed drawing. Staff measured the actual setback from the OHWM of the Case Inlet shoreline to the existing buildings. As noted on the attached drawing, the setbacks from south to north are: SE corner of cabin is 25 feet to the OHWM, SE corner of covered deck is 20 feet to the OHWM, and NE corner of covered deck is 30 feet to the OHWM. The carport extending southwest has its closest corner situated 62 to 65 feet from the saltwater OHWM. The existing cabin and a portion of the carport are forward of the stated shoreline proportional setback. The Mason County Resource Ordinance does provide for replacement of the residence, as long as the new structure occupies no more than the square footage of the existing footprint of the existing structure(s) in the buffer; a ten percent increase in footprint is allowed as long as it does not intrude into the shoreline buffer any closer than the existing structure(s). An accurate drawing of the layout of existing structures on the property in regard to the shoreline and property lines will aid in presenting a replacement or new structure proposal. A proposal could include a second story to the existing structure, but such development must meet all setbacks as noted in the text above. Two precautions should be noted: 1) that the siting of new buildings and structures shall far enough away from unmodified shorelines so that shoreline protection measures is not needed in the future; and 2) a setback determination may change if the adjacent property owners submit applications and are granted permits for new or remodeled residences established at proper shoreline setbacks. You would need to confirm with the Environmental Health Department what their septic system standards are to make sure about the adequacy of supplying a septic disposal for the proposed development. Will an event permit be required where there is less than 1000 people? Is the 1000 people a daily total or an event total? #2. Is$250.00 enough of a fee for all the parties involved? It seems the amount of personal it will take to process one of these plus the field inspections that$250.00 is no where near a large enough fee to cover expenses. Will the pre-app fee be in addition to the event fee? What about charging a minimum fee of$250.00 per day? Will the incoming cash stay in DCD? #3. On 5.18.050 we may want to use the word consumed instead of served. #4. 5.18.060 leaves very little time to make adjustments if not approved. At denial time so close to opening the customer may have a lot of money time and effort into the project. (Fix word must in 2nd paragraph) #5. 5.18.090 does the 500'include the distance to parking,if not it should or you may find people parking all over in residential area. #6. Which dept. in DCD will be conducting primary review? Applicant will need to be made aware that if temporary structures are being used an inspection(s)will be required by the fire marshal or representative prior to opening. (E.H.too when food involved) Note: Many of these events take place on the weekends which means staff will need to work in order to conduct needed inspections at time of setup unless permit is conditioned that setup is to be completed during our business hours and inspections arranged for.
