Dear Mr.MacSems:
Thank you for the opportunity to comment on the mitigated determination of nonsignificance for
the 2762 Hwy 302 Project(SEP2016-00032) located approximately a half a mile north of Victor
on Highway 302 as proposed by Cedarland Forest Resources. The Department of Ecology
(Ecology)reviewed the environmental checklist and has the following comment(s):
WATER QUALITY: Chris Montague-Breakwell(360)407-6364
Erosion control measures must be in place prior to any clearing, grading, or construction.
These control measures must be effective to prevent stormwater runoff from carrying soil
and other pollutants into surface water or stormdrains that lead to waters of the state. Sand,
silt, clay particles, and soil will damage aquatic habitat and are considered to be pollutants.
The following construction activities require coverage under the Construction Stormwater
General Permit:
1. Clearing, grading and/or excavation that results in the disturbance of one or more
acres and discharges stormwater to surface waters of the State;and
2. Clearing, grading and/or excavation on sites smaller than one acre that are part of a
larger common plan of development or sale, if the common plan of development or
sale will ultimately disturb one acre or more and discharge stormwater to surface
waters of the State.
a) This includes forest practices(including, but not limited to, class IV conversions)
that are part of a construction activity that will result in the disturbance of one or
more acres, and discharge to surface waters of the State; and
3. Any size construction activity discharging stormwater to waters of the State that
Ecology:
a) Determines to be a significant contributor of pollutants to waters of the State of
Washington.
b) Reasonably expects to cause a violation of any water quality standard.

If there are known soil/ground water contaminants present on-site,additional information
(including, but not limited to:temporary erosion and sediment control plans; stormwater
pollution prevention plan; list of known contaminants with concentrations and depths found;
a site map depicting the sample location(s);and additional studies/reports regarding
contaminant(s))will be required to be submitted.
You may apply online or obtain an application from Ecology's website at:
http://www.ecy.wa.gov/programs/wa/stormwater/construction/-Application. Construction
site operators must apply for a permit at least 60 days prior to discharging stormwater from
construction activities and must submit it on or before the date of the first public notice.
WATER RESOURCES: Vicki Cline(360)407-0278
Any ground water withdrawals in excess of 5,000 gallons per day or for the irrigation of
more than one-half acre of lawn or noncommercial garden, requires a water right permit from
Ecology.
All water wells shall be constructed in accordance with the provisions of Chapter 173-160
WAC by a driller licensed in the State of Washington. Well reports must be submitted to
Ecology within 30 days after completion of a well.
All water wells that may be drilled must be a minimum of 100 feet from any known,
suspected,or potential source of contamination. Wells shall not be located within 1,000 feet
of a solid waste landfill. WAC 173-160-171(1)The proposed water well shall be located
where it is not subject to ponding and is not in the floodway, except as provided in Chapter
86.16 RCW. (2)It shall be protected from a one hundred year flood and from any surface or
subsurface drainage capable of impairing the quality of the ground water supply.
The Growth Management Act(RCW 19.27.097)requires an applicant to submit evidence of
an adequate water supply before a building permit can be issued for any building requiring
potable water.
Ecology's comments are based upon information provided by the lead agency. As such, they
may not constitute an exhaustive list of the various authorizations that must be obtained or legal
requirements that must be fulfilled in order to carry out the proposed action.
If you have any questions or would like to respond to these comments, please contact the
appropriate reviewing staff listed above.

DETERMINATION OF NONSIGNIFICANCE
(WAC 197-11-350)
SEP2016-00032
Description of Proposal: This SEPA is associated with application to waive (for residential
use) about 1.4 acres of a 4.9 acre parcel from a six-year
development moratorium resulting from FPA 2418399. The parcel
contains steep (over 40%) slopes and an F-stream (150' buffer +
additional 15' building setback). A geotechnical report was
prepared by GeoResources LLC and the submittal checklist was
approved as complete. The waiver envelope will be entirely
outside of the stream buffer, but the access is via an old logging
grade, that lays within the creek buffer, that was rebuilt for the
FPA. The applicant has hired The Wetland Corps to prepare a
Mason Environmental Permit and a Habitat Management Plan for
the road work in the stream buffer. Those documents are still in a
"pending" status. A 12-point stormwater and erosion control
narrative was written by Angie Amidon which limits to one-acre the
area within the waiver envelope that can be stumped or graded.
The balance of the property will remain under the moratorium until
2/19/22.

Purpose of Checklist:
The State Environmental Policy Act(SEPA), chapter 43.21C RCW, requires all governmental agencies to consider the
environmental impacts of a proposal before making decisions. An environmental impact statement (EIS) must be
prepared for all proposals with probable significant adverse impacts on the quality of the environment. The purpose of
this checklist is to provide information to help you and the agency identify impacts from your proposal(and to reduce or
avoid impacts from the proposal)and to help the agency decide whether an EIS is required.
Instructions for Applicants:
Governmental agencies use this checklist to determine whether the environmental impacts of your proposal are
significant, requiring preparation of an EIS. Answer the questions briefly, with the most precise information known, or
give the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In most cases, you should be
able to answer the questions from your own observations or project plans without the need to hire experts. If you really
do not know the answer, or if a question does not apply to your proposal, write "do not know" or "does not apply".
Complete answers to the questions now may avoid unnecessary delays later.
Some questions ask about governmental regulations, such as zoning, shoreline, and landmark designations. Answer
these questions if you can. If you have problems, the governmental agencies can assist you.
The checklist questions apply to all parts of your proposal, even if you plan to do them over a period of time or on
different parcels of land. Attach any additional information that will help describe your proposal or its environmental
effects. The agency to which you submit this checklist may ask you to explain your answers or provide additional
information reasonably related to determining if there may be significant adverse impact.
There is a fee required, for the processing of the checklist, see above for the appropriate fee. Please make your check
payable to"Mason County Treasurer".
