They are as follows: l. Please find attached a highlighted section from the Geo-Tech report submitted by Consolidated Engineering. On page two of that document, Mr. Boughan states that the access road "will be accomplished with switch-backs or hair-pin curves". With one look at the site it is clear that the access road was built with a massive cut and fill rather than switchbacks. I consider this to be a violation of the MEP as the work done was not the work approved. The work occurred on property owned by Stephen Vizina (who was a party to the permit). 2. The earthen material that was cut from Mr. Vizina's property was used as fill on adjacent property owned by Richard Knight. This portion of the project was not covered by the MEP submitted by Mr. Broughton. In my opinion this is an unauthorized activity that should only have occurred under permit. It should be noted that Mr. Broughton probably has an easement to cross Mr. Knight's property, but that the actual location of the access road has been changed by the grading and might now lie outside of a described easement (research is needed). When I visited the site in late August with Alan Tahja, the necessary stormwater plan mitigation measures had yet to be done. I don't know what the status is now, but the conditions of Alan Tahja's August 20`h IDC need to be met. Please let me know if you need additional information. Thanks.
