Lead Agency: MASON COUNTY
The Lead Agency for this proposal has determined that it does not have a
probable significant adverse impact on the environment . An Environmental
Impact Statement (EIS) is not required under RCW 43 .21C. 030 (2) (c) . This
decision was made after review of a completed Environmental Checklist and
other information on file with the Lead Agency. This information is
available to the public upon request . MITIGATION MEASURES ARE

Conditions of this Case are listed below:

1) MITIGATION #1 : The applicant is required to submit a Geo-tech
report due to steep slopes within 100' of site. The geo-tech
report must be done by a licensed engineer in the State of
Washington. The geo-tech report must address timber harvesting
and road access placement. The geo-tech report must be submitted
to Mason County Department of Community Development(DCD) and Mason
County Public Works. The waiver will not be approved until Mason
County Public Works has reviewed and comments sent to DCD.
2) MITIGATED CONDITION #2: A Stormwater Site Plan (SSF) will be
created and implemented prior to development, clearing, grading,
or construction of any portion of the site.

3) MITIGATED CONDITION #3: Emergency vehicle apparatus access roads
shall conform with the requirements of the Uniform Fire Code and
Mason County Title 16. If the access road cannot conform, special
conditions will be placed on any building pei mit issued on
property that is served by a non-conforming access road. Contact
the Mayon County Fire Marshal for details.
4) INFORMATIONAL ONLY: Water quality is not to be degraded to the
detriment of the aquatic environment as a result of this project.

5) INFORMATIONAL ONLY: Residential developers and individuals shall
be required to control erosion during construction. Removal of
vegetation should be minimized and any areas disturbed should be
restored to prevent erosion and other environmental impacts.

6) INFORMATIONAL ONLY: Storm drainage facilities are required by the
County for residential development projects. Facilities shall
include, but not be restricted to vegetated swales, retention
ponds and use of artificial or natural wetlands PROVIDED no
adverse impacts to the receiving wetlands would occur and are
subject to Mason County approval.

7) INFORMATIONAL ONLY: Storm drainage facilities shall be separate
from sewage disposal transport facilities and include provisions
to prevent uncontrolled and untreated direct entry of surface
water runoff into receiving waters. Storm drainage facilities
shall include, but not be restricted to vegetated swales,
retention ponds and artificial and natural wetlands PROVIDED no
adverse impacts to the receiving wetlands would occur and shall be
subject to Mason County approval.

Dear Mr. & Mrs. Marsh:
The Mason County Department of Community Development would
like to thank you for responding to the SEPA notice that was
posted on the Biehl property.
This department relies on neighboring property owners to
identify problems and possible solutions in areas of our County
that need to be addressed. As to your comments in your letter of
November 10, 1998 . First of all I would like to say that I am
sorry for not getting a response to you immediately, I have been
on vacation for two weeks.
We understand the problems that you are having in your
neighborhood with run-off, slides and the harvesting of timber on
neighboring properties. In Mr. Biehl' s case, he didn' t get a
permit to harvest the timber on his site, but Mr. Biehl has
indicated that he was given mis-information as to the
requirements for the harvesting of timber and requirements that
were in place prior to his harvesting of timber.
Mr. Biehl is going through the moratorium waiver process
which is allowed through County Ordinance #108-98 . The
moratorium has been placed on parcel "D" of Short Plat 1545.
This moratorium does not allow any development permits to be
issued for 6 years. Development permits are identified as
building permits, sewage permits, well permits, permanent access
permits and any permits that are not required for the harvesting
of timber.
As to problems roblems with run-off, slides and excess

building, Mr. Biehl has been required to develop a geo-tech
report that addresses the hazardous slopes that exist within 600'
of his property, per Mason County Ordinance #77 -93 . The geo-tech
report must be done by a licensed engineer in the State of
Washington and must meet the standards of this Ordinance. At
this time the County is waiting for a geo-tech that will meet
these standards. In conjunction with the geo-tech report Mr.
Biehl is required to submit a Stormwater Plan for his site that
will mitigate any activities on his property. This plan must
meet the Department of Ecology's Technical Stormwater Manual,
that has been adopted by Mason County as a guideline for
developing stormwater plans.

We can not address your concern with the amount of building that
is going on in your neighborhood since a property owner is,
allowed to construct a residence on their property as long as its
permitted and meets Mason County Building Standards, per the
adopted Uniform Building Code (UBC) and other regulations.
Having read other letters submitted to this department
pertaining to the Biehl project, we understand the problem that
you are having with the community access road and limited funds
collected for your road maintenance fees. This problem is outside
of the Counties jurisdiction, as it is a private road. We hope
that as more property owners build, they will also contribute to
your road maintenance fund.
We have attached to this letter the SEPA checklist that you
have requested and as soon as we receive the mitigation
information, we will be sending this to you and the others that
have submitted letters to this department.
