Dear Mr. Esteban:
I recently conducted a"drive by"site inspection of the above mentioned tax parcel number in
response to a complaint received by the Mason County Planning Department. The complainant
alleged that a brush collecting business with approximately fifteen employees is operating from
the metal pole building located on the parcel.
I did observe the large metal shop with a significant number of vehicles and individuals on the
property. I have been informed by the Building Department that the metal shop is an existing
structure with no permit records and no prior approval for any type of commercial use. The
parcel's land use designation is Rural Residential 5, meaning that land use activities are limited to
those listed in Mason County Development Regulations section 1.04.222. I have enclosed a copy
of that section for your reference.
As the parcel does not have a primary residential structure,the operations cannot be reviewed as a
permissible"cottage industry"or hobby farm. Rather, no commercially related activities can take
place in the metal shop. I will advise the complainant that you have been made aware of the
applicable regulations.
If you have questions regarding this matter, or if you feel that you have received this letter in
error, please contact me at(360)427-9670 ext. 593. So that I may resolve and close this
enforcement case, please provide a written statement by August 5, 2002 documenting that the use
of the structure is not, and will not, be for commercial purposes. If a response is not received by
August 5, 2002,the enforcement file will remain open and further action will be pursued. If this
matter proceeds to a hearing,you may be found responsible for costs incurred by the County in
addition to fines assessed. Thank you for your anticipated cooperation.

Dear Mr. Esteban:
Thank you for contacting me in response to the letter dated July 22, 2002. As a result of
our July 31, 2002 phone conversation, I am closing the enforcement file. During our
conversation, you indicated that you stopped buying and working with salal on your
property in April 2002. You also indicated that no employees work on the site, and that
any work-type vehicles are your personal vehicles that are used off-site for your work
with Christmas trees.
