Design, sizing, placement, inspection and maintenance of stormwater management systems shall be the responsibility of the owner/agent of the developed parcel. Under the requirements of Mason County Stormwater Ordinance, either private ditches and drains will meet requirements of the • stormwater ordinance or prior approval will be granted to use an existing utility and drainage easement dedicated for that specific purpose. Bovey 12536 SE 70"' Street Newcastle WA 98056 RE: Building Permit BLD2009-00087 on Parcel Number 12229-50-02040 Dear Mr. Bovey This letter is to bring to your attention an issue that will affect the further review of your building permit and the location of your proposed residence on the subject property located along Grapeview Loop Road. Staff made a site inspection for the building permit was made on Friday February 20, 2009. At that time, staff verified the location of the proposed residence on the property and noted the presence of surface water and ground seepage in the footprint of the proposed building. Staff checked office records on past permitting or reviews done on the subject parcel. A site pre-inspection was done on this property in May 2002 [SPI2002-00058] that described certain wetland characteristics on the property at the time of inspection and that a wetland study be completed prior to further development. A subsequent case was begun in October 2004 that was in response to filling and grading on the property done without county review [ENF2004-00424]; this case remains outstanding as the property owner needed to submit a wetland study and vegetation restoration plan that addresses the past filling and site corrections. An additional site pre-inspection SPI2008-00105 was done in June 2008 to state current standards for development on the property, and no mention of this pending 2004 enforcement case was made by the property owner at that time. The current issue is to resolve this enforcement case ENF2004-00424 regarding the affected wetland or shoreline vegetation buffer as Mason County reviews the proposed residence under permit number BLD2009-00089. As part of the proposal review, you need to have a qualified biologist prepare a wetland report that delineates the wetland edge, characterizes the wetland category, and determines the proper vegetation buffer using the information from Mason County Resource Ordinance Chapter 17.01.070 Wetlands. Proposed development near the wetlands and shoreline shall have the vegetative buffer determined by the biologist, and proposed buildings must be set back an additional 15 feet from the outer edge of that buffer. The wetland and vegetation buffer currently contain gravel fill but some surface water and ground seepage is still present. The Wetlands Chapter offers management standards for restoring and enhancing wetland and buffer areas. Some tree limbs in the buffer may be trimmed for view improvement on a limited basis in accordance with the Wetland chapter standards. Once the biologist assists you in preparing a site plan that includes the wetland and vegetation buffer areas, you will need to show the locations of your proposed improvements (buildings, decks or balconies, patios, sewer connection, yard areas) on that site plan, which will be used for the review of your building permit and for future permit inspections. You must include that all development must be landward of the shoreline setback that is the diagonal line crossing the subject property from northeast to southwest as noted in the findings of SPI2008-00105; the exception to this standard is decks or patios built at grade within the 15-foot building setback forward of the shoreline setback.
