Dear Mr. Rude and Mr. Macht,
In response to a complaint filed with this office, a site investigation at the
Blue Heron Resort Condominiums was done by the Mason County Enviromental
Health and Mason County Building Departments on April 23, 2002. As a result of
that inspection, I have enclosed copies of referenced permits and a copy of the
site investigation report done by the Building Department.
A number of issues need to be addressed at the site and are indicated
below:
❑ A soils/geotechnical engineering report by a Washington State
licensed engineer needs to be submitted to the building department
that addresses the ground movement occuring on site in addition to the
ground water. The majority of slab entries and walkways have
experienced shifting, the carport buildings and basement parking areas
are showing signs of failure and/or cracking, and there is some
significant ground water accumulation in the crawl spaces of some of
the residential buildings. The manager on site discussed some of the

ground water concerns with us and informed us of some attempts to
remedy the problem that had not been successful.
❑ After the fact re-roof permits must be applied for and issued for the
buildings that had roof work done in absence of the required permits
within the last few years. A requirement of the permit will be to provide
required venting in those areas.
❑ Renewal of expired permits and final inspections must be performed
on MIS96-0081 1(dock), BLD2001-001 00(manufactu red home),
COM2000-00086(spa).
❑ the floats proposed under MIS96-00613 were constructed without the
required permits, they are in violation of the Mason County Code, Title
14, Building and Construction. The permit submittal has expired and
C, will need to be reapplied for. If the floats were not constructed, please
notify this office so that we may note the file accordingly.
❑ Use of the carport buildings 8: 3 through 8 and building 4: 1 and 2 is
prohibited. These buildings are showing definate signs of failure. All
of the carports and basement parking areas/deck support walls in
general need to be evaluated by a structural engineer with structural
plans and design specifications submitted for repair permits as they all
appear to either be failing by movement, members possibly
overspanned or not tied in appropriately, and experiencing some rot
and/or overturning of wood members.
❑ The insulation in the crawl spaces of the units has been installed
backwards and needs to be corrected. Any wet or damaged insulation
needs to be replaced. The appearance of mold witnessed on the
insulation is indicative of moisture problems possibly due in part to the
drainage issues and inadequate venting in the crawl. Any structural
changes to provide adequate venting to the crawl area need to be
permitted.
❑ Maintenance items such as rotting trim boards at concrete patio entry
doors and at base of first floor units and in area of chimney chases
where the downspouts and gutters are discharging should be
addressed.
o In researching to file records, it does not appear that permits were
submitted or issued for the office building. Please provide any records
you may have for clarification.

Dear Mr. Macht,
In follow up to our telephone conversation yesterday, I am reiterating the
highlights of our discussion in writing. The non-structural work of adding the
exterior trim boards in the patio locations is exempt from the permit process
however, this office is now aware that there is a possible rot problem with the
floor joists in some locations. In reply to that, you stated that the Washington
State licensed structural engineer that you have retained to address other issues
on site will also be inspecting and providing possible corrections for that if
deemed necessary.
As indicated, I am leaving your file for my supervisor, Larry Waters, to
review on May 22, 2002 and determine if further action is necessary based upon
the new information provided. We also discussed that you were in the process of
responding to our notice of May 3, 2002. 1 would suggest that you address that
reply to Larry Waters, Lead Building Inspector as I will be out of the office until
June 4, 2002. Please contact Mr. Waters with any concerns or questions you
may have regarding this enforcement case. Please reference your case of
ENF2002-00091 in all correspondence.

On 5/16/03 We contacted Bruce Christian the Industrial Hygienist at
(360)902-5477. This is the State of Washington Dept. of Labor &
Industries. We ask if there has been any follow up inspection regards to
opporations and procedures, since the many serious violations one year
ago. There has been no furture inspections since 06/05/03. No
complaints, no inspection needed.

The Blue Heron Resort Condominium is a "Time-Share" facility, where there
are 22 units, each unit has 6 owners. The owners use their unit, rent their
unit, some belong to an exchange company called" RCI", where people from
all around the world trade their timeshare for a stay at the Blue Heron Resort
Condominiums, at Hood Canal in Mason County.
These 22 units are housed in 3 buildings. there is a recreational building,
office and resident managers quarters, on ten acres, 3 lawn terraces.
There is a swimming pool, spa, 2 saunas, pool table, fooseball, ping pong
table, 2 tennis courts, 2 volleyball courts, teatherball, basketball, horseshoes
and a 400' beachfornt on Hood Canal, with a dock, float, picnic tables, small
boats &tie up not to mention the oyster beds and great fishing and crabing.
Needless to say this is a beautiful piece of property, that lots of people want
to go see and enjoy. Possibly, it has not been properly maintained by the
"Property Management Company", there has been a lot of known cover ups
in the construction projects requested to be done(either by the insurance
company for Blue Heron or request by the County. Please see pictures of
rotten boards under floor of units, being covered up with brand new boards,
just to please the outside look. The area mentioned unfortunatly are in the
entrys that have tile, and there is Not much good wood left under the tiles.
Look at building 4 unit 6 & 7. These units and buildings are so rotted in so
many areas, water still sits under the units, mold, ect. The ground movement
occuring on site in addition to the ground water, this is why the majority of
the slab entries and walkways have experienced shifting.
Who watches out for the health and safte y concerns in a public facility,
where there are so many issues of possible liability? We would like to request
an inside investigation as to the progress with the toxic mold abatement
project, if there is abatement. We also would like to request an investigation
on the property management company as they have been the party that was
paid to over see the Blue Heron property and liability issues for the
Homeowners association for 20+years. What happened?We are concerned
with liability and who is to be held accountable for the violations, and for not
addre
ssing the problem prior to it getting to this point of an unhealthy
environment for those who become VICTIMS(employees, the owners, and
unknowledgable innocent renters & exchanges. RCI had stopped the inbound
exchanges for a few months, due to the previous Resident Manager giving
the RCI Co knowledge of the environmental issues and the mold report.
After the previous resident managers were fired due to their knowledge and
health concerns of others, the RC I Exchange started sending inbounds.
There is a great demand for Timeshare Units in Washington State, since
there are only 3 on the Western side, and aprox 1/3 - 1/2 of the owners of the
Blue Heron belong to R C I a timeshare world wide exchange company.
We believe the facility should be Temporarily Closed. It should be considered
an unhealthy environment until all the required mold& abatement as well as
any other liability, water run off problems addressed at all 4 buildings and
strucural rot removed and replaced to code as requested by authorities. Prior
to re-opening the facility the units should be retested by an environment
specialist and a final inspection should be in order, by the County (Health
Dept., Environmental Dept., Building& Code Enforcement, and the State
Washington Drinking Water Opporations inspection for code compliances.
Please help save innocent victims from exposure.
Please keep in mind that we are just a few of many concemed citizens. We
do not wish to get into trouble for informing you of the serious situation at
the Blue Heron Resort Just hope you will consider looking into it for best
intrest to others. Thank you for your time and we will be in touch with you.

1. Spotty mold growth on underside of reef decking in Buildings 4, 8 and Clubhouse.
2. Significant water and moisture below Buildings 4 and 8.
3. Water on concrete s!ab at carport level of Building 1.
4. Limited areas of water and/or mold staining in some bathrooms.
Laboratory Results:
1. When compared to outdoor air most indoor sampling locations had elevated levels of
Aspergillus/PenictUiuin,CWosporium sp.and UlocWiurn sp. fungi.
2. Levels highest in the one attic space sampled.
S. Levels also high in the two crawlspaces sacipled-no visible fungi observed.
4, Levels in units generally exceeded outdoor levels.
Recommendations
i. Locate and alleviate the source of water to the goof decking,crawlspaces and Building I concrete
slab_ In some castor it may necessitate changes to drainage and groundwater drainage pattems.
2. Remove and replace all non-structural mold contaminated building materials. Clean and
encapsulate mold affected structurai building materials.
3. Perform mold abatement activities in accordance with industry protocols to protect occupants,
and unaffected areas from exposure to elevated levels of mold spores.
4. Perform a clean-up,using appropriate techniques,of all units and contents.
7. Perform clearance inspections and air sampling to monitor abatement work.

In response to your complaint against Blue Heron Resort Condominiums, an
inspection was conducted on 2 May 2002 .
Regarding the allegations in your complaint, the employer was cited for
the following:
• Not providing an emergency eyewash despite the use of corrosive
chemicals.
• Not requiring the use of eye protection during the mixing and use
of corrosive chemicals.
• Lack of a Chemical Hazard Communication Program and a list of
chemicals.
• Lack of an Accident Prevention Program.
• Not maintaining a Material Safety Data Sheet (MSDS) for each
hazardous chemical present.
• Not providing training regarding the hazards of the chemicals used
by employees.
• Improper labeling of hazardous chemicals.
• Lack of information regarding asbestos containing materials at the
facility.
• Not providing training to housekeeping and maintenance staff in
regards to asbestos at the facility.
• Improper wiring and ventilation in the boat motor storage room.
• Not providing required information to voluntary respirator users.
• Not documenting a personal protective equipment hazard assessment.
• Not conducting health and safety meetings.
In addition, an informational message was sent regarding the presence of
mold contamination in parts of the facility.
If you have any questions concerning this inspection, please contact me
immediately. You have the right for further review by submitting a
written statement of position to me at the regional office noted above.
In addition, Washington State law (RCW 49.17.160) provides protection
against discrimination for employees who are involved in protected
safety and health related activity. If you are an employee of the
employer and you believe that you are being treated differently or
action is being taken against you because of your safety or health
activity, you may file a complaint with the Department of Labor and
Industries. You should file this type of complaint as soon as possible,
since RCW 49.17.160 (2) requires alleged discrimination complaints to be
filed within 30 days of the alleged discriminatory action. For more

Dear Larry,
Following is our proposed course of action, in response to a site visit by Tami
Griffey on 4/23 and her related correspondence of 5/3 and 5/17 regarding the Blue
Heron Condominiums, E. 6520 Hwy 106 in Union, #ENF2002-00091.
I met last week with a geotechnical engineer on the site to review the issues of
ground water/ground movement. I expect him to complete his report by the end of
this week and we will forward a copy to you. We will address issues of
moisture/water in the crawl spaces based on his findings.
Within the next few weeks we will apply for after the fact permits for the office
building and for the recent roofing work and we will address the requirements for
additional venting at that time. We will also request final inspection on the dock,
spa and manufactured home projects. The proposed floats were not constructed
and there is no plan to do so at this point.
As you are aware, we are in the process of performing maintenance of trim boards
and chimney chases and we acknowledge that the replacement of structural
elements such as rotten floor joists requires a permit. We will be using the services
of a structural engineer to assist us in these repairs. We will also have a structural
engineer examine the condition of the carports for building 4 and 8 as well as the
decks over the parking area for building 1. We understand that these repairs are to
be permitted also. _

The major problem on the site appears to be ground movement and a lot of ground water. All of the residential buildings inspected appear to be in need of maintenance in regard to providing adequate
venting in the crawl spaces,removal of wet insulation and insulation that was installed backwards in the crawl and blocked venting in the attic spaces where the vaulted ceilings are. There is some major
cracking on the concrete slab entries and walkways as well as rotting of the trim board at the base of the structures. The gutters on some of the buildings upperfloors discharge or divert roof runoffadjacent
to the chimney chase where rot is also evident.There is also some downspouts that don't be into drains and instead discharge at the base of the structure. The crawl space venting that is provided is deficient
and at that partially blocked. There is significant problems with the carport structures and they should not be used until permits for the repairs are issued.,111Q,jpist beams are oywurninu;n C ate+Bldi!
4-1&2 and the side wall appears to be leaning. The carport bldg 8:3-8 is taped off and is not in use presently. The concrete wall is leaning,slab has signicant cracks,beams are bowed and some of the posts
have failed and temp.support posts have been placed. At the present time,the building department w0 r e the following:
1. A complete soils/geotechnical engineering report that addresses the soil and ground movement in relation to that which is occurring on the site both as it effects the carports as well as the entry slabs,
walkways and parking basements. Of concern is also the ground water that appears to be present on the site.2. After the fact re-roof permits for the buildings that had new roofing within the past 2 years 3.
Use of carport buildings has been revoked until structuraf plans accompanied by full structural engineering for repair has been submitted.4.Renewal of permits;MIS96-008 I l(dock),BLD2001-00100
(Manufactured Home),COM2000-00086(Spa)and final inspection of all. A permit for floats(MIS96-00613)was applied for in 1996 but never issued. There is also no record of permits for the office
building itself. All of these issues need to be addressed.

The major problem on the site appears to be ground movement and a lot of ground water. All of the residential buildings inspected appear to be in need of maintenance in regard to providing adequate
venting in the crawl spaces,removal of wet insulation and insulation that was installed backwards in the crawl and blocked venting in the attic spaces where the vaulted ceilings are. There is some major
cracking on the concrete slab entries and walkways as well as rotting of the trim board at the base of the structures. The gutters on some of the buildings upperfloors discharge or divert roof runoff adj scent
to the chimney chase where rot is also evident.There is also some downspouts that don't tie into drains and instead discharge at the base of the structure. The crawl space venting that is provided is deficient
and at that partially blocked. There is significant problems with the carport structures and they should not be used until permits for the repairs are issued. The joist beams are overturning in Carport Bldg
4-1&2 and the side wall appears to be leaning. The carport bldg 8:3-8 is taped off and is not in use presently. The concrete wall is leaning,slab has signicant cracks,beams are bowed and some of the posts
have failed and temp.support posts have been placed. At the present time,the building department will require the following:
1. A complete soils/geotechnical engineering report that addresses the soil and ground movement in relation to that which is occurring on the site both as it effects the carports as well as the entry slabs,
walkways and parking basements. Of concern is also the ground water that appears to be present on the site.2. After the fact re-roof permits for the buildings that had new roofing within the past 2 years 3.
Use of carport buildings has been revoked until structural plans accompanied by full structural engineering for repair has been submitted.4.Renewal of permits MIS96-00811(dock),BLD2001-00100
(Manufactured Home),COM2000-00086(Spa)and final inspection of all. A permit for floats(MS96-00613)was applied for in 1996 but never issued. There is also no record of permits for the office
building itself. All of these issues need to be addressed.

approved for 833 gpd and the last system was approved for 1400gpd.He didn't have a problem with the replacement of the mobile home as long as the manager approves the connection and the tanks are

Dear Mr. Macht,
Your letter of May 20, 2002 was referred to me today. At the time it was
written, you indicated that you had met with the geotechnical engineer and
expected a copy of the report by the end of the week or May 24, 2002, and
stated that you would forward a copy immediately. As of today, I have not
received a copy of the report or any mitigation measures. If you could make
arrangements to submit another copy of that report by June 21, 2002, it would be
appreciated.
Also mentioned within the letter was your intent to have a structural
engineer assess the floor rot damage in the units and the stability of the carports
and parking areas with decking above however, you did not give a timeline as to
when this inspection will occur. It is imperative that this situation be addressed
immediately and I am requesting that the inspection occur no later than June 30,
2002 and that the structural assessment report be forwarded to this office within
2 weeks of the inspection date.
The permits for the office building and roofing projects have not yet been
received and the final inspections on the dock, spa and manufactured home have
not yet been arranged. I will also ask that these items be completed prior to June
30, 2002. Since you stated that these issues would be taken care of in a few
weeks, as of your May 20, 2002 letter, this should be consistent with the time
schedule you had referred to.
