Project Description:
Construction of approximately 280 lineal feet of I-beam pile and wood bulkhead on
two neighboring lots on Lake Cushman. Construction is within a Fish & Wildlife
Habitat Conservation Area and a Landslide Hazard Area.
AMENDED 7/22/09: New proposal is to construct only 180 lineal feet on the
Deleo/Smith parcel. The bulkhead will be constructed of I-beam pile and wood. Holes
for the piles (six feet in depth and 2 feet in diameter) will be augered by hand and
filled with concrete. The structure shall have a maximum above grade height of 14
feet. Tieback steel cables and concrete anchor blocks shall be utilized to reinforce
the bulkhead. The bulkhead will be backed with a layer of filter fabric, then backfilled
with gravel and topsoil suitable for growing native vegetation, which will be planted
along the top. Existing Gabion baskets along the bluff toe will be removed from the
site. The existing beach access stairs shall be relocated to accommodate the new
bulkhead.

This permit, with conditions, is granted pursuant to the Mason County Resource Ordinance
(Chapter 17.01 MCC.) Nothing in this permit shall excuse the applicant from compliance with
any other federal, state, or local statutes, ordinances, or regulations applicable to this project.
This permit may be rescinded if the permitee fails to complete the project as proposed or fails
to comply with the standards of this ordinance.

Conditions:
1.) All provisions of the Habitat Management Plan shall be enacted.

the bulkhead as identified in the HMP. X

(approximately May 26th through October 1st).

5.) ACZA treated wood used in the project shall undergo one or more of the following BMP's
to minimize leaching of contaminants:
1. Aqua-Ammonia Steaming Cycle (AASC);
2. Post Treatment Kiln Drying;
3. Minimum Plant Holding Time (MPHT). In addition to recommendations for the ACZA
BMP's-Amendment#1 for MPHT treatment, all ACZA treated wood shall be held under
cover a minimum of 3 weeks at constant temperature that meets or exceeds 60 degrees
F. If the ambient temperature is less than 60 degrees F., then ACZA treated wood must
undergo the Post Treatment Kiln Drying, noted above;
4. In-Retort Ammonia Removal Plus Plan Holding Time, as conditioned in previous
section (3), but held under cover for a minimum of 1 week, at constant temperature that
meets or exceeds 60 degrees F;
5. ACZA wood treatment methods shall be verified by providing a signed and dated
certification from a third party.

6.) Aquatic friendly sealant shall be applied to the concrete used in the project.

7.) Geosynthetic filter fabric shall be used to"back" the bulkhead as identified in the HMP.

8.) Residential developers and individuals shall be required to control erosion during
construction. Removal of vegetation should be minimized and any areas disturbed should
be restored to prevent erosion and other environmental impacts.

9.) Debris or deleterious material resulting from construction shall be removed from the
beach area and project site and shall not be allowed to enter waters of the State.

10.) Water quality is not to be degraded to the detriment of the aquatic environment as a result

RE: Habitat Management Plan Comments Received from the Skokomish Tribe —
MEP2009-00004
Dear Ms. Deleo, Mr. Smith, and Mr. & Mrs. Latham:
Enclosed please find a copy of the comments received from the Skokomish Tribe:regarding the
proposed joint wood bulkhead located at 60 & 61 N. Gull Place, Hoodsport, WA. The Mason
County Resource Ordinance 17.01.110 Fish & Wildlife Conservation Areas allows for a 28-day
comment period for the Habitat Management Plan review. The Skokomish Tribe has determined
there may be multiple negative impacts to the Skokomish Tribe and/or their resources. Please
respond as to how these impacts can be avoided, minimized and/or mitigated. They have also
suggested some mitigation proposals that may be incorporated as conditions of permit approval.
It is important that these concerns be addressed prior to issuing any permits.

Project Name: Deleo & Latham Bulkhead Project
Description of Proposal: Construction of approximately 290 lineal feet of I-beam pile
and wood bulkhead on two neighboring lots on Lake Cushman.
Location: Lots 60 &61 N. Gull Place, Lake Cuslunan, Hoodsport, WA.

Dear Ms Wright,
It has been determined that the above project will have multiple negative
environmental impacts to the Skokomish Tribe and/or their resources, including multiple
Federal and State listed species. These impacts are listed in detail below and should be
thoroughly considered before any permits are issued by the permitting agencies and/or
construction begins.
• Bulkheads may disrupt the migratory and rearing behavior of juvenile salmonids
• Bulkheads prevent the recruitment of native sediment to the lake,resulting in a
loss of heterogenous substrate, and resulting in shoreline erosion at the toe or
along the shore downwind of the bulkhead. This could affect the availability of
spawning and rearing habitat, and the forage base for a variety of fish species.
• Bulkheads eliminate shallow-water habitat,which is critical as refuge and foraging
habitat for juvenile salmonids and other small fish.
• Bulkheads reflect wave energy at the shoreline, resulting in the scour of sdirnent
oat the bulkhead toe, and creating an inhospitable high-energy environment for
juvenile fish.
• The removal of vegetation during bulkhead construction could eliminate a
potential source of cover and food for juvenile salmonids, forage fish and native
char. Vegetation removed is typically not replaced with native woody species
that could provide a future source of woody debris to the lake thereby reducing
the availability of complex refilge habitat for small fish, and attaclunent surfaces
for periphyton.
• The temporary turbidity associated with bulkhead construction may reduce water
quality to the detriment of juvenile fish species.
• Pile driving may disrupt the distribution and behavior of, or injure juvenile fish
species.
• Best Management Practices instituted by the Western Wood Preservers Institute
(WWPI) should by employed for the use of ACZA treated wood when used in the
aquatic environment.
• A key to the treating process for ACZA treated wood is the presence of ammonia,
which facilitates carrying the active ingredients into the cell structure of the wood
during treatment. Evaporation and removal of the ammonia following treatment
is critical for the remaining ingredients to become stabilized, thereby minimizing
the opportunity for leaching from the product in its end use.
• It is recommended that several key pieces of large woody debris (LWD) depicted
in the enclosed Habitat Management Plan (HMP)be anchored appropriately along
the shoreling to further deflect wave energy away from the proposed struture.
• In addition it is recommended that the concrete for the proposed piles have an
aquatic friendly sealant applied to them.
• The west slope of the proposed properties is the most stable according to the
enclosed geo-report. This slope should be preserved as a Best Management
Practice(BMP) for this site's stormwater runoff. Dispersing stonnwater into
vegetated areas of the yard should be employed as the primary stonnwater BMP
for this site and location.
• The existing bare slope above the proposed retaining wall location should receive
a cover of geosynthetic filter fabric to keep the natural hillside soils in place and
allow the seeping of groundwater through the gravel backfill mater that will be
installed between the completed retaining wall and the existing hillside slope.
• All proposed work is to be accomplished during the lake's low level period in the
late Winter and early Spring before Tacoma City Light raises the lake's water
surface elevation for summertime recreational purposes.
• The Smith-DeLeo/Latham properties,though in the vicinity of slopes identified as
hazard areas by Mason County terminology, is stable in its present condition as
indicated in the Tahja Engineering accompanying report.
The Skokomish Tribes Tribal Historic Preservation Officer(Kris Miller)will be
providing comment as to the potential cultural impacts of this document and you should
not move forward with the above project until you receive those comments. Thank you
