Box 47440 Olympia,Wa 98504-7440 Dear Pasco, Please be advised that by virtue of conversations with Ed Sharp, it is my understanding that it was Ed Sharp's letter of recommendation to you that prompted the $10,000.00 Bond referenced in your January 5, 1993 Letter to Don Brush, Planner. Ed Sharp recited the fact that he was recommending a bond based upon the fact that "the D.O.T. had to clean mud out of a ditch just north of the subject property" E.C. File No 92695-M. I explained that the individual responsible for such negligence was a homeowner who had piled soft fill on top of brush and other debris, next to or on the D.O.T. right-of-way. Such negligence was without the advise of an engineer and was not in any way a part of any responsible development. Further, Ed Sharp recited other slides in the area. The cause of the "other slides" as recited in "Washington Geologic Newsletter Volume 2 - Number 3" are more realistically as follows: 1. "Lilliwaup has been subject to slides and flows since deglaciation about 13,500 years ago;" 2. "Approximately 15 percent of U.S. 101 has been destroyed or buried by landslides at least once in the past 25 to 50 years;" 3. "The Department of Highways has taken one or more of the following actions each time U.S. 101 has been blocked.........placing riprap or building bulkheads to prevent further movement of the slide; unloading the slide by cutting trees and removing material; or installing horizontal, perforated drains to dewater the slide." 4. The causes of the landsliding along the west shore of Hood Canal....... are numerous. The stratigraphy in the area of most of the slides consists of outwash overlying lakebeds. The outwash is permeable sand and gravel, whereas the lakebeds are composed if impermeable silty sediment. During the rainy winter months, pore pressure builds up in the potential landslides because ground water percolates into the outwash but cannot escape through the lake beds. Excessive pore pressure results in outward flowing of the toe of the landslide and downward slumping of the upper portion of the landslide. Once activated, landslides such as the Jorstad Creek Slide generally flow and slide each winter until the slope is greatly reduced naturally, or until the Department of Highways undertakes engineering modifications such as installing drains and placing riprap." Therefore, since slides admittedly may be a frequent occurance in the project area, it would be difficult to determine whether the cause of a slide was caused by development or the natural causes recited in the above Washington Geologic Newsletter Volume 2 - Number 3 Report. Further, your time may be better utilized taking advantage of the opportunity to negotiate a joint D.O.T./Developer effort to effectuate the "unloading" of the potential slide area by cooperating in the removal of the material situated immediately above the potential slide area situated on the project site. Page 1 of 2 Further, contrary to one of the causes of slides recited in the above report you stated that "surface water runoff directed to the state highway right-of way must not exceed pre- development runoff." Normally the developer would ordinarily install dry sumps along the roadways which would intercept the surface water and allow drainage at a normal winter time rate into the underground "lakebeds." Consistent with the above report, our recommendation would be to discourage water from entering the underground lakes, by virtue of D.O.T./Developer joint effort interceptor drainage pipes running down the hillside into the ditch area closest to the drainage under Hwy 101 into Hood's Canal thus removing the potential of pressure at the toe of the hill during the winter season. Therefore, as a "Planning Engineer" you may want to investigate the above information in more detail and call me at 947-6767 or write me at the address first recited above. Further, this letter is my sincere invitation to visit the site with me to discuss any mutual advantages. If you elect to refuse to reconsider the mandate of the $10,000.00 bond, consider the hereinbelow portion of this letter a REQUEST FOR NOTIFICATION AND ACCESS under the FREEEDOM OF INFORMATION ACT AND PRIVACY ACT. 1. This is a request under the Freedom of Information Act, 5 USC 552 or any regulations thereunder, and the Privacy Act, 5 USC 552a or any regulations thereunder. This is my firm promise to pay fees and costs for duplicating the documents and information requested below, ultimately determined in accordance with 26 CFR 601.702 (f) provided all fees charged are enumerated in a writing, to the requester, in advance. 2. If some of this request is exempt from release, please furnish me with those portions reasonably segregtable. I am waiving inspection of the requested records. If some of the requested documents are exempt from release, please furnish me with those portions reasonably segregatable, and provide me with an indexing, itemization and detailed justification concerning information which you are not releasing. 3. This request pertains to the years 1972 through the current date 1993. 4. Please send me an accounting of all requests concerning the demand for performance bonds in the Lilliwaup slide area based upon the construction of roads, driveways or walkways. 5. Please send me copies of all new regulations passed between 1972 and the current date requiring performance bonds in the Lilliwaup slide area. 6. Please send me a list of all developments that have constructed roads, driveways or walkways in the Lilliwaup slide area not required to have performance bonds. If not so required, please detail why. 7. Please send copies of all interoffice communication(s), memos, wires, memorandums of conversations (phone or otherwise), transmittals, information and data in the D.O.T.s possession past, present and future, regarding the Lilliwaup slide area as it may appertain to the above recited project.
