Below you will find comments made regarding the proposed development and its critical values. In some cases, setbacks for development from shorelines, steep slopes,streams, and wetlands must be included in your specific proposal; these setbacks are included as part of the comments listed below. This information is based on County and State regulations as they exist to date. These regulations may change and may affect the requirements for development of the subject property. Sincerely, I Yvonne Dettlaff Land Use Planner Mason County Planning Department 8/20/2003 1 of 3 SP12003-00156 Site Inspection 8/20/2003 Case No.: SP12003-00156 Comments: A field inspection of the subject property was conducted on August 12, 2003 to assess critical area issues and setbacks. The primarily intent of the inspection was an assessment of the suitability of the parcel for building a small single family home. The subject property, parcel number 12220-54-00058 is located on East Lake Shore Drive in the Lakeland Village development. The property is roughly rectangular in shape with a maximum width of 97.63 and longest length of 297.82. The property is bordered by parcels roughly the same size. It is accessed from East Lake Shore Drive and fronts an inlet that flows into Anderson Lake. The property is primarily flat, and is covered with bushes, grasses, conifers and deciduous trees. Anderson Lake is subject to the regulations of both the Mason County Shoreline Master Program and the Mason County Resource Ordinance. Because the Mason County Resource Ordinance mandates greater setbacks, that one prevails. The Mason County Resource Ordinance (17.01.110 D2) addresses the setbacks for the subject property. The provisions used for setback are guided in part by existing development on adjacent properties that currently contain residential dwellings within 150 feet from the subject property line. The nearest residential dwelling on the right side (looking waterward) of the subject property is setback 45 feet from the Ordinary High Water Mark (OHWM). The residential dwelling to the left (looking waterward) is setback 57.5 feet from the OHWM. Because the subject parcel has a high degree of curvature, the average of the two measurements is used to compute the setback for the subject parcel. The resulting setback for the subject parcel is 51.25. Within that 51.25 feet setback, no structures may be constructed, but landscaping is permitted within 15 feet waterward of the setback. The 36.25 feet distance from the shore is defined as the buffer line. If the proposed development is forward (toward the shoreline) of your setback line, you need to apply for both the Mason County Resource Variance and the Shoreline Variance. These variances will require a Habitat Management Plan to support the variances. Please note that the planning staff, the Hearing Examiner, and finally the Department of Ecology review variance applications for consistency with all criteria required by Mason County. The subject property is zoned in the Urban Growth Area. The June 2003, Mason County Development Regulations require a 8/20/2003 2 of 3 SP12003-00156 Site Inspection 8/20/2003 Case No.: SP12003-00156 front yard setback of 10 feet, side and rear yard setbacks of 5 feet. The maximum building height is 35 feet. To summarize, if you can build away (from the shoreline) of the setback line, you will be required to apply for the routine Mason County Building Permit. If the proposed building includes areas shoreward of the setback, you will be required to apply for the variances described in the paragraphs above. Application for a variance does not guarantee approval.. The proposal must meet the specific criteria listed in the relevant regulation.
