completion of the work described and in accordance with Scope of Work below

All material is guaranteed to be specified and the above work to be performed in accordance with the below Scope of Work
Payments shall be made according to the agreed payment schedule(see below) Progress payments not received within thirty
(30)days of the due date shall accrue interest at the rate of 18%per annum from the date such payment was originally due until
the full amount then-owing is paid

SCOPE OF WORK
offer labor and materials to design, build and install a replacement marine rail at your
place on Hood Canal, near Hoodsport.
The new marine rail system would be approximately 100 feet long, and built with
galvanized steel elements, including:
• 3-inch, schedule 40 steel pipe piling pneumatically driven to refusal to support the
rails(6 minimum)
• Twin 4-inch steel channels running the entire length,with cross members spaced
at 10 feet
• 1,000-pound electric winch with 3/16" stainless steel cable
Our Scope of Work would include:
• Engineered design drawings
• Provide and install piling
• Fabricate and install rail structure
• Remove existing rail system, but retaining cart t �>�

Qualifications and exclusions include:
• Permits are by others.
• Electric service to the winch is by others
• All bulkhead work is by others
2. Any final balance that remains unpaid thirty(30)days after substantial completion(when the project is sufficiently complete in
accordance with this Contract so that the Owner can occupy or utilize it for its intended use)shall accrue interest at the rate of
18%per annum from the date of substantial completion until amounts owing are paid
3. if a lien release is requested and all payments due and owing have been made in full,a lien release will be issued on the tenth of
the month following date of completion
4. If either party becomes involved in a legal dispute arising out of or relating to this Contract or the performance thereof,the court
or arbitrator involved in such litigation or arbitration shall award all reasonable attorneys'fees,costs and expenses incurred to
the substantially prevailing party In the event of litigation,venue shall be in the Thurston County Superior Court of Washington,
and shall be governed by Washington law
5. Contractor is registered with the State of Washington,Registration No. WATERC1899JJ as a general contractor and has
posted with the State of Washington a bond or cash deposit of$]2,000.00 for the purpose of satisfying claims against the
Contractor for negligent or improper work or breech of contract in the conduct of the Contractor's business This bond or cash
deposit may not be sufficient to cover a claim which might arise from the work performed under this Contract If any supplier of
materials used in the above construction or any employee of the Contractor or any subcontractor hired to perform work
hereunder is not paid by the Contractor or subcontractor for yourjob,your property may be subject to lien to force payment If
you wish additional protection,you may request the Contractor to supply you with the original"lien release"documents from
each supplier or subcontractor on your project Contractor is required to provide you with further information if you request it
Additional information is also available from the Department of Labor and Industries,State of Washington
6. Any alteration,deviation or other changes from the work specified in paragraph I,above,shall constitute a material change in
this Contract,and shall be performed only upon the Owner's execution of a written change-order,which shall serve to modify
this Contract insofar as such changes vary from the terms and conditions herein,including time of completion and contract price
No extra or different work will be performed in the absence of an executed change order agreed upon and signed by both parties
7. The Contractor does not bearthe risk of,and the Contract price and time for completion of the Work shall be equitably adjusted
for changes in the Work resulting from(a)the existence of unknown concealed conditions of an unusual nature and differing
materially from those ordinarily encountered in work of the character provided for in this Contract;(b)unknown conditions
differing materially from conditions indicated in this Contract;(c)orders or directions of any governing agency other than orders
or directions resulting from Contractor's violation or failure to comply with applicable orders,regulations,laws,permits,or
other legal requirements of the governing agency;(d)adverse weather that could not reasonably have been expected and that has
an adverse effect on the scheduled construction;or(e)any acts of God or other force majeure that wholly or partially damages or
destroys the Work.
8. Contractor represents and warrants that(a)all materials and equipment furnished by it will be of standard quality,unless
specified otherwise,and will be installed or applied in a good and workmanlike manner;and(b)all Work will be performed in a
good and workmanlike manner and in compliance with the Contract This warranty excludes any damage or defect caused by
abuse,modifications not executed by the Contractor,improper or insufficient maintenance,improper operation,or normal wear
and tear or normal usage If within one year after substantial completion,any Work is found to be not in compliance with the
requirements of the Contract,the Contractor shall correct it promptly after receipt of written notice from the Owner to do so
unless the Owner has previously given the Contractor written acceptance of the condition During the one-year correction
period,if the Owner fails to notify the Contractor and give the Contractor an opportunity to make the correction,the Owner
waives the right to require correction by the Contractor and to make a claim for breach of warranty.
9. Contractor reserves the right to lien to any and all structures and realty involved in the above-described location Under
Washington State law,including RCW 60 04 et seq,those who furnish labor,professional services,equipment or material for
the repair,remodel or alteration of the above-described project and who are not paid,have a right to enforce a claim against the
above-described property Owner acknowledges that failure to make timely payments pursuant to the agreed payment schedule
may result in the Contractor filing a lien against the property,and Owner agrees that in addition to any applicable interest
accrued on late payments,Owner shall also be liable to Contractor for Contractor's costs and fees associated with filing and
recording the lien Although not required for work where Contractor contracts directly with the owner/occupier of existing
residential property,Owner acknowledges receipt of the attached Notice to Owner

10. Contractor and Owner waive claims against each other for all consequential damages,including damages incurred by the Owner
for rental expenses,for losses of use,income,profit,financing,and busirless and reputation;and damages incurred by the
Contractor for principal office expenses,for losses of financing,businesta and reputation,and for loss of profit except anticipated
profit arising directly from the work
11. This offer shall automatically become void if not signed by Owner withiq thirty(30)days after signed by Contractor In
addition,prices quoted in this Contract for materials are subject to adjustment if work does not begin within 30 days of date
signed by Contractor or as otherwise specified.
ACCEPTANCE OF PROPOSAL
The above prices,specifications,and conditions are satisfactory and are hereby accepted Contractor is authorized to do the work as
specified,and payment will be made as specified above I understand and acknowledge that f have had the opportunity to have this
Contract reviewed by an independent legal counsel of my choosing prior to sigtring This Contract contains the entire agreement
between the parties with regard to the matters herein set forth and supersedes aM prior and contemporaneous negotiations,
commitments and agreements with respect to its subject matter This Contract may be amended or modified only by an agreement in

Applicants of projects requiring Special Inspection or Testing per Chapter 1704&1705 of the International
Building Code, as amended by Washington State. Please acknowledge and return this form to the Mason
County Permit Center.
THESE INSPECTIONS ARE NOT PERFORMED BY THE BUILDING DEPARTMENT AND MUST BE
PERFORMED BY QUALIFIED SPECIAL INSPECTORS, HIRED BY THE OWNER AND APPROVED
BY THE COUNTY PERMIT CENTER. Individuals certified in a special inspection category by
Washington Association of Building officials(WABO)or individuals employed by a recognized testing
laboratory and under the direct supervision of a Registered Professional Engineer are typically
considered qualified at the discretion of the local jurisdiction having authority for enforcement.
BEFORE A PERMIT CAN BE ISSUED: The Owner or his/her representative, on the advice of the
responsible Project Engineer or Architect, shall fill out completely, sign and submit two (2) copies of the
attached "Structural Tests and Inspection Schedule"to this Department for review and approval including
any requirements related to the Mason County Municipal Code.
The Owner, General Contractor, and Inspection/Testing Agency, where applicable, shall also
acknowledge the following conditions applicable to Special Inspection and/or Testing.
1. Inspection/Testing Agency shall submit names and qualifications of on-site Special Inspectors
to the Building Inspection Permit Center for approval PRIOR TO PERMIT/S BEING ISSUED.
2. All Special Inspections shall be noted on the approved plans or attached approved
documents.
3. All special inspections shall be approved by the County or as recommended by the Engineer
of Record (EOR).
4. It is the responsibility of the General Contractor to review County approved plans for additional
inspection or testing requirements that may be noted or required per IBC as noted on
approved plans.
5. The General Contractor is responsible for proper notification to the Inspection/Testing
Agency for items listed on this form.
6. Special Inspectors shall provide detailed reports on company letterhead to the Building
Inspector of all required inspection activities. These may also be provided when the inspector
visits the jobsite for the scheduled inspection but must be completed before the subject of
inspection is approved by the building inspector.
7. Copies of all ongoing laboratory and testing reports shall be sent directly to the Building
Inspector by the Inspection/Testing Agency or other responsible party within a reasonable
time to test results.
8. BEFORE A CERTIFICATE OF OCCUPANCY APPROVAL CAN BE ISSUED: The
Inspection/Testing Agency shall submit a FINAL REPORT LETTER stating that all items
requiring testing and inspection have been fulfilled and reported and a final inspection report
shall be provided. A copy of the statement is to be maintained at the jobsite for the Building
Inspectors review prior to final inspections.

A failing concrete bulkhead(and its concrete stairs)was replaced with a pre-cast concrete wall with
inset stairs at the end of 2022, A marine rail was connected to the northern portion of the bulkhead,but
was disconnected due to the bulkhead replacement work.The tail had been in use up until it was
disconnected.The replacement rail will be installed in the same footprint and supported by 3-inch steel
pin piles.
