NOTE: Washington Department of Fisheries (WDF) reviewed your
application received on September 22 , 1993 and reviewed plans
for the proposal received on November 17 1993 . The site of the
proposed project was inspected at low tiAe on the evening of
December 3 , 1993 .
WDF discourages the use of ilings, lumber, and other materials
treated with creosote and ocher wood preservatives and recommends
instead the use of steel, concrete, or recycled plastic.
1. This ro]]ect is apppproved as illustrated in your application,
subject to the following provisions.
2 . Work below the ordinaryy hi h water line shall not occur from
March 15 through June 14 o any year for the protection of migrating
juvenile salmonids.
3 . In addition work below the ordinary high waterline shall not occur
from September 15 through December 31 and from January 1 through
March 1 of any year for the protection of surf smelt spawning beds.
4 . All manmade debris on the beach at the project site shall be removed
and disposed of upland such that it does not enter waters of the
state.
5. The relocated float and associated moorings shall be located to
avoid shading of eelgrass.

6. The existing pier lengthened ramp, and relocated float structure
shall not exceed f00 feet in total length.
7 . Floatation for the structure shall be entirely enclosed and
contained to prevent the breakup or loss of the floatation
material into the water for the life of the structure.
8 . The five (5) existing pilings shall either be utilized for the
relocated float or shall be removed and disposed of upland such
that they do not enter waters of the state.
9. If five (5) new piling are to be utilized, they as well as all
lumber' and other materials treated with preservatives shall be
sufficiently cured to minimize leaching into the water or bed.
10. Project activities shall be conducted to minimize siltation of
beach areas and bed materials.
11. If a fish kill occurs or fish are observed in distress, the
project activity shall immediatel cease and WDF Habitat
Management Division shall be notified immediately.
12 . Debris or deleterious material resulting from construction shall
be removed from the beach area and project site and shall not be
allowed to enter waters of the state.
13 . Water quality is not to be degraded to the detriment of fish life
as a result of this project.

SUBJECT: Hydraulic Project Application - Float and Piling Relocation
- Hood Canal, Tributary to Admiralty Inlet, Section 35,
Township 22 North, Range 03 West, Mason County,
WDF Log No. 00-62376-01, WRIA 14.MARI
Dear Mr. Anderson:
Washington Department of Fisheries (WDF) received the above-
referenced Hydraulic Project Application on September 22 , 1993 , but
we are unable to complete processing at this time for the following
reason(s) :
Incomplete Application - Additional information is required.
Complete plans and specifications of the project relative to
Mean Higher High Water (MHHW) , (Datum, Mean Lower Low Water
[MLLW] = 0. 0) , must be submitted to facilitate evaluation of
potential impacts to fish resources. The drawings must
accurately depict existing conditions and shall include plan and
cross-sectional views of the proposed project, a vicinity map of
the project area, and accurate directions to the project site.
The location of all prominent natural features and manmade
improvements on the bank and beach in the immediate vicinity of
the project area shall be accurately represented. To aid us in
locating the project site, a photograph should be supplied.
Information synthesized from recent studies indicates that the
shadow cast by overwater and floating structures, as narrow as
eight feet in width, located in the intertidal and shallow
subtidal habitats can result in the loss of important marine
vegetation, such as eelgrass. To avoid this adverse impact,
overwater and floating structures shall avoid such vegetation.
If the proposed structures are located on the beach such that a
marine vegetation inspection cannot be undertaken by WDF during
a daylight low tide, the inspection shall be undertaken for the
applicant by a qualified biologist approved by WDF.

State Environmental Policy Act (SEPA) - Compliance with SEPA is
required by law prior to issuance of the Hydraulic Project
Approval. Please contact your local city or county planning
department for information regarding SEPA procedures. As soon
as the SEPA process has been completed, please provide written
notification of compliance from your local jurisdiction, so your
application may be processed in a timely manner.
Your proposal is placed on hold until we receive the above-identified
information. Your application will be processed after the
information has been received.
WDF, Department of Ecology (DOE) , Department of Health, Department of
Natural Resources, Department of Wildlife, and several local
jurisdictions are concerned about the use of creosote and other wood
preservatives in the aquatic environment. These concerns are
addressed in the enclosed Focus Sheet produced by DOE.
In particular, WDF is concerned about adverse effects on fin fish,
shellfish, benthic and epibenthic invertebrates, marine vegetation,
etc. , from the use of pilings treated with creosote and other wood
preservatives in the aquatic environment. DOE classifies some used
creosoted piles as a hazardous waste. For disposal, these piles must
be taken to a designated hazardous waste disposal site. The closest
site is in Arlington, Oregon.
A major portion of creosote is comprised of a variety of chemical
compounds known as polycyclic aromatic hydrocarbons (PAHs) .
Creosoted pilings in saltwater leach PAHs. As much as 20 percent
or more of a piling' s creosote leaches into the surroundings waters.
Since 50 to 100 gallons of creosote are used in the typical piling
depending on the piling size and level of treatment, the amount
leached can be significant. About 2/3 of the PAHs released are
adsorbed to bottom sediments and persist.
Most fishes metabolize PAHs, however, intermediate breakdown products
can be extremelycarcinogenic to a wide variety of organisms

(including fish) . Epidermal tumors and liver lesions in flatfishes
are two examples of cancerous affects which have been directly
related to high PAH levels in sediments. Other PAHs exhibit
significant acute toxicity to aquatic organisms but are non-
carcinogenic. PAHs can cause adverse effects at numerous biological
levels including enzymatic and immunological changes, tissue damage,
direct mortality, and community alteration. Bivalves (e.g. , mussels
and oysters) do not metabolize PAHs. High tissue concentrations have
been found in these organisms in association with PAH contaminated
substrate (piles and sediments) .

Because of the above-identified effects of PAHs on the environment,
their sources should be reduced or eliminated wherever possible.
Preferred non-toxic alternatives to creosote include concrete, steel,
or recycled plastic piles. The additional cost of these alternatives
can be offset by their benefits. These include longer product life,
increased structural support capability, reduced disposal costs,
lower costs of driving, and fewer piles. WDF recommends that these
alternatives be utilized to reduce adverse affects on fish life.
We appreciate your cooperation in our efforts to protect, perpetuate,
and manage the fish resources of the state of Washington.
