Thank you for the opportunity to comment on the mitigated determination of nonsignificance for the
Martin Erosion Control Bulkhead project(Case No. SEP2004-00034) located at 240 North Ayock Beach
Drive in Lilliwaup as proposed by Jane Martin. We reviewed the environmental check,ist and have the
following comments:
Federal Permit Coordinator:
If any work is proposed below the Mean Higher High Watermark(MHHW), an individ Lial or general
(nationwide pen-nit)may be required from the U.S, Army Corps of Engineers. We advi se the applicant to
contact the Corps in Seattle at(206) 764-3495 to determine if a permit is needed.
Water Quality:
Any discharge of sediment-laden-runoff or other pollutants to waters of the state is in violation of Chapter
90.48, Water Pollution Control, and WAC 173-201A, Water Quality Standards for Surf 5ce Waters of the
State of Washington, and is subject to enforcement action.
Erosion control measures must be in place prior to any clearing, grading, or constructioi 1. These control
measures must be effective to prevent soil from being carried into surface water by stor nwater runoff.
Sand, silt, and soil will damage aquatic habitat and are considered pollutants.
Proper disposal of construction debris must be on land in such a manner that debris can iot enter Hood
Canal or cause water quality degradation of state waters.

1) Water quality is not to be degraded to the detriment of the aquatic environment as a result

2) Debris or deleterious material resulting from construction shall be removed from the beach
area and project site and shall not be allowed to enter waters of the State.

the Shoreline Management Act, its rules, and the Mason County Shoreline Master
