Hood Canal. 10191 State Route 106. Unpermitted float. Dear Mr. Larson, This letter constitutes an administrative order and decision regarding the unpermitted float located at the above noted property. This structure has been place without the required shoreline Substantial Development Permit, Mason County Building Permit, United States Army Corps of Engineers approval, and Hydraulic Project Approval from the Washington Department of Fish and Wildlife. RCW 90.58.145(2) states, "A substantial development shall not be undertaken on shorelines of the state without first obtaining a permit from the government entity having administrative jurisdiction under this chapter." A substantial development is defined as those developments exceeding $2,500.00 in value, as valued using the construction fee schedule for Mason County barring developments which are explicitly exempt under the MCSMP. Piers, docks, and floats are valued at $8.50 a square foot. At a minimum your float is valued at $5,100.00. If you wish to retain and have use of the float you must get an after-the-fact shoreline substantial development permit, in addition to the other permits mentioned above. All after-the-fact permits are charged triple the customary fee per the Mason County DCD Fee Ordinance 1-93. The customary fee for the SDP is $320.00 and $100.00 processing fee for State Environmental Policy Act Review, which is not triple fee. A building inspector recently evaluated the float and said that in order to get a building permit the decking, floats and some hardware would need to be replaced in addition to other code regtdrement. If you do not wish to pursue this course of action then the float must not be placed in the water. The float must also be moved to a suitable upland location either for storage or disposal. You have 30 days from the date of this letter to respond in writing as to your intention. Please find enclosed a Shoreline Permit Packet with all the necessary information for application. BOX 578 of �1864 SHELTON,WA 98584 • (206)427-9670 To Whom It May Concern: On August 4, 11994 , I was present on behalf of the Mason County Department of Community Development at the following location: 10191 State Route 106, Hood Canal While at the above site, I observed the following: An unpennitted floating dock with 100% of floatation grounding on beach Float measuring approx. 6' x 100' As a result of the above, the Department of Community Development has reason to believe that these activities have occurred in violation of the Mason County Shoreline Master Program and RCW 90.58 and applicable rules and ordinances. By this letter, we are informing you that continuation of these activities may result in Mason County taking enforcement action against you. Such action may include requiring you to: restore the site; pay civil penalties of up to $1,000 per day for each day the violation occurs; and face possible criminal prosecution. If you or your agents or employees proceed with these activities, you do so at your own risk. We encourage you to immediately suspend all activities at the site until you contact Jason Manassee of Mason Cty. Planning Dept. by phoning 427-9670 , and/or contacting the undersigned of the Department of Community Development in order to determine whether you need a shoreline permit and are otherwise in compliance with the law.
