Township 22 North, Range 3 West , Mason County. Washington . The Stop Work order was posted because the concrete ramp extending from the top of the northeast side of the bulkhead to the beach is in violation of the Shoreline Master Program and was not an approved portion of the building permit issued to reconstruct the bulkhead . The concrete ramp along with the piling supporting it and the footing must be removed . Please submit plans for the removal of the ramp, piling and footing to our office within 15 days of the date of this letter. We look forward to hearing from you . In this letter we requested that you submit plans for the removal within 15 days of the date of the letter. Because this deadline has not been met, it is necessary to remind you that the concrete ramp extending from the top of the northeast side of the bulkhead to the beach is in violation of the Shoreline Master Program and was not an approved portion of the building permit issued to reconstruct the bulkhead. According to the Shoreline Master Program, boat ramps shall not exceed 18 inches in height at the line of ordinary high water or the toe of the bulkhead. This regulation was made a condition of the building permit. According to the Mason County Code, "Any person violating any of the provisions or failing to comply with any of the mandatory requirements of resolutions or ordinances of the County is guilty of a misdemeanor. Any person convicted of a misdemeanor under the resolutions or ordinances of the County shall be punished by a fine of not more than five hundred dollars, or by imprisonment not to exceed ninety days, or by both, unless otherwise required by state law. Each such person is guilty of a separate offense for each and every day during any portion of which any violation of any provision of the resolutions or ordinances of the County is committed, continued or permitted by any such person, and he shall be punished accordingly. " If the Planning Department does not receive an adequate response within ten ( 10) days of the date of this letter a citation will be issued on November 7, 1989 and the matter will be turned over to the Prosecuting Attorneys Office. Box 186 Shelton, WA 98584 Re: Maurer matter Dear Ms. Marken: This is a letter to confirm our phone conference Friday, November 3. I have been retained by Mr, and Mrs. Grant Maurer, and Mr, and Mrs. John Tinsman to respond to Mason County's complaint that a portion of the Maurer's south shore Hood Canal improvement is out of compliance with the Shoreline Master Program, and the building permit which was issued for that particular project. Mr, and Mrs. Maurer and Mr, and Mrs. Tinsman do not believe that the improvement constructed is out of compliance with the Master Program. To this end, I would like an opportunity to view the Shoreline Master Program. Enclosed please find my office's check for $8 .75 , tendered as payment for a copy of the plan. Please forward it to my office. My clients also believe that various people in the building department knew of , and authorized, construction of the improvement as built. Your letter of October 26 , 1989 suggests that the county will be issuing a criminal citation on this matter on November 7 , 1989. I recognize that the county must make its own choices about how to proceed in this particular case. I suggest, however, that it might be useful to explore the factual background, and the issues, in this case before launching into a criminal and/or civil proceeding. The Stop Work Order was posted because the concrete ramp extending from the top of the newly constructed bulkhead down to the beach is in violation of the Shoreline Master Program, Section 7. 16. 170, #19 and #20 and the issued building permit *24025, issued July 7, 1989, special conditions : ramp can not exceed 18 inches in height at the toe of the bulkhead. Furthermore, the location of the ramp differs from the plans submitted with the building permit application for the replacement bulkhead. -On Oct. 2, 1989 a certified letter was sent to Mr. Maurer explaining the violation and the posting of the Stop Work Order. The letter also stated that the concrete ramp, supporting piling and footing be removed and that plans for the removal of them be submitted to the Planning Office within 15 days of the date of the letter. -On Oct. 26, 1989 another certified letter was sent to Mr. Maurer because the Planning Dept. had not received adequate response from the first letter. This letter reminded Mr. Maurer that the first letter requested that he submit plans within 15 days of the date of the letter and that he had not done so. It goes on to restate the violation, how violations may be processed according to the Mason County Code and that the matter will be turned over to the Prosecuting Attorneys Office if the Planning Department has not received adequate response within 10 days of the date of the letter. -On Nov. 3, 1989 Lenore Marken, Planner received a telephone call from Mr. Russ Hartman the attorney for Mr. Maurer requesting a copy of the plans and the Shoreline Master Program. -On Nov. 7 1989 Lenore Marken attempted to reach Grant Maurer by phone to discuss the violation. He was not available and she left a message. Later that same day, Russ Hartman called saying he had sent a letter and he was verbally requesting an extension. Planning Staff had not received a letter as of that date. -On Nov. 15, 1989 Mike Byrne, Erik Fairchild and Lenore Marken discussed and reviewed the violation and determined that adequate information had not been received by the Planning Staff and that the matter should be turned over to the Prosecuting Attorneys Office.
