Dear Mr. Flores:
Thank you for the opportunity to comment on the determination of nonsignificance to repair a dock by
replacing the old decking and 4 x 12 foot beams spanning along the new piles and repair a 14 x 12 foot
deck by installing a 2 x 12 foot joist and new decking(Case No. SEP96-0286), located at East 9511
Highway 106 as proposed by James Phillips. We reviewed the environmental checklist and have the
following comments:
Shorelands:
It is unclear from the checklist whether the proposed development;
a) qualifies for repair per Section 7.13.020 of the Mason County Shoreline Master Plan or
b) if expansion is being proposed which is prohibited under the same provision.
Expansion may not be allowed even if the structure is eligible for repair as non-conforming development.
The proposed project must be consistent with all applicable policies and other provisions of the Shoreline
Management Act, its rules, and the local shoreline master program.
Water Quality:
Any work in or adjacent to waterways that will adversely affect water quality must receive specific prior
authorization from the Department of Ecology pursuant to WAC 173-201A-110. A short-term water
quality standards modification may be issued if the proponent agrees to a number of specific construction
practices and techniques designed to minimize water quality impacts. The construction schedule will be
tied to the schedule on the Hydraulic Project Approval(HPA).
The proposed project must be consistent with all applicable policies and other provisions of the Shoreline
Management Act, its rules, and the local shoreline master program.

other information on file with the Lead Agency. This information is
