Dear Applicant: Pursuant to your application, a site pre-inspection (SPI)was performed on your property. Below you will find comments made regarding the proposed development and its critical values. In some cases, setbacks for development from shorelines, steep slopes, streams, and wetlands must be included in your specific proposal; these setbacks are included as part of the comments listed below. This information is based on County and State regulations as they exist to date. These regulations may change and may affect the requirements for development of the subject property. Sincerely, Kell McAbo y Land Use Planner Mason County Planning Department 3/21/2005 1 of 3 SP12005-00050 Site Inspection 3/21/2005 Case No.: SP12005-00050 Comments: Pre-inspection for Mark & Geri Peake Purpose: To determine all the necessary setbacks from the shoreline buffer for remodeling or rebuilding the existing residence. Lot Description: The site inspected is the portion of the lot located on the north side of HWY 106 and on the south shore of Hood Canal. The lot is 70' wide and 50' deep. Sixty feet of the width to the west is on fill enclosed by a concrete bulkhead on the east, north and west. There is an existing single-wide mobile home, an uncovered deck and a concrete boat ramp. Footprint of the residence is 53' wide by 11' deep plus a covered entry for a total of 613 square feet. The existing bulkhead on the west, north and east is considered the Ordinary High Water Mark (OHWM). The residence is approximately 10 feet back from the OHWM on the north, approximately 7 feet from the OHWM on the west and 1' from the OHWM on the east. Shoreline Designation: Urban Zoning: The zoning designation for the site is Rural Residential 5 (RR5). Setbacks: Standard setbacks for this zoning are a 25 foot front yard setback and a 20 foot setback for side and back yards. The front yard refers to the lot line adjacent to the property access, including access easements. The setbacks are measured from structures above grade such as roof overhangs (roof gutters), and other structures/appurtenances, including heat pumps etc. When the lot width is less than 100 feet, setbacks would equal 10% of the lot width. In this case, where the back and side yards are adjacent to the Urban shoreline of Hood Canal, setbacks are a minimum of 15 feet per Mason County Shoreline Master Program (SMP) 7.16.080. Geological/landslide hazards: The purpose of this site pre-inspection does not address the steep slope on the landward side of the HWY. No other critical areas were present. Options: The minimum setback under the SMP is 15 feet, and the minimum buffer from a saltwater shoreline under the Mason County Resource Ordinance (17.01.110 figure 1) is 20 feet plus a 15 foot building setback for a minimum of 35 feet. Therefore, the existing house is considered as a legal non-conforming use since it rests entirely within the Resource buffer and within the Shoreline setback. The Fish & Wildlife Habitat Conservation Areas section 3/21/2005 2 of 3 SP12005-00050 Site Inspection 3/21/2005 Case No.: SP12005-00050 of the Resource Ordinance allows for the remodeling or rebuilding of an existing non-conforming structure plus 10% (17.01 .110 F.1 .a.) as long as it does not encroach further into the buffer. A second story is also allowed, but it too cannot encroach further into the buffer and must maintain the minimum 15-foot setback per the SMP. Since OHWM is on three sides of the property, this must be taken into account for side yards as well as the backyard (shore side). Given the current footprint of 613 square feet, the structure could expand to 674 square feet, plus a second story. The footprint can be modified from the current 53' wide by 11' deep to accommodate all the setbacks, allowing for a full second story. For example, 30' wide by 22.5' deep set 15' from the west and east bulkhead, 10' from the north bulkhead and 10.5 feet from the front access easement. The second story must be 15' back from the OHWM. A reduction in the required front yard setback can be given as an administrative variance of no less than 10 feet distance from the road access easement boundary per Mason County Development Regulations 1 .05.034 C., ONLY if the lot meets certain circumstances. The residences to the east and west both protrude over the OHWM, therefore, a second story proposal from this site does not conflict with the common line. General process: Future site development must include a site plan showing all setbacks from property and shore lines for building permit application submittal.
