RE: Arcand proposal to install rock bulkhead waterward of State Highway 106 at Parcel No.
322355202003, Street address 40 E Merrimount Dr, Union, WA 98592.
Dear Mr. Severson:
Mason County is contacting you regarding the above proposal to install a rock bulkhead waterward of
State Highway 106. Because it is so close to the highway as built we are concerned that it may encroach
on the 60 foot right of way. In cases such as this the County contacts the DOT so you have the
opportunity to conduct a site review and make that determination.
We also recognize that you may require that the property owner have the site and adjacent right-of-way
surveyed to ensure that it is not an encroachment.
We have included a copy of the application materials for your information, and indicated to the property
owner that your review would be required in order for us to proceed with the application.

Hi Dale,
I have a proposal to place a rock bulkhead waterward of Highway 106"to save what is left of our beach".
I have concerns that it might be in the 106 right of way, or that at least you will need to review it and
determine if it is doable per DOT.

on our website, then click on the"world" in the upper right, and the map will come up, then turn on layers
on the left hand side.
Site address is 40 E Merrimount Dr Union WA 98592. From 106 driving east,just before Merrimount, look
uphill to see the gabion baskets holding up the slope. That's the parcel. The ownership extends to the
waterward side. According to our records there was a slide there in the 90s, hence the rock.
Owner is Arcand.

Good Morning Kim,
Below is an email string between the County and Art Sporseen of DOT re: a phone message I got from
DOT about the location of the Arcand bulkhead - relative to the DOT right of way.
To make a long story short, whenever we have a project like this we have to include the DOT in the
review. A copy of the application was sent to DOT, which generated the phone call and email
conversation. They want to do a site visit(see below) and would like the bulkhead location staked, and to
meet someone on site. Do you have an email address for Patti Arcand, so she could be included in this
email string and you/she could communicate with Art Sporseen? Thanks in advance, pambc

Pam,
I think Our Maintenance guy and I can figure out if the bulkhead of any
associated work will be within ROW or not if we can get the proponent to
stake out the proposed location. If they call me, I can let them know
when we will be there so they can be there as well. If you would pass on
my contact info, that will be fine.
Thanks for keeping us informed. It is important to us to keep abreast of
development which might potentially affect our highway system and we do
appreciate your efforts in this effort.

Got your phone message when I came back from the WRIA meeting at 4:30.
1 thought you would want to take a look at this one. I already told
them I was sending you the info. I am going to write another letter to
the applicant letting them know you have concerns about whether this
would be within the DOT right of way and need to conduct a site visit.
And give them your contact information too? In cases like this, do you
need a survey to confirm if they are contesting your site decision?
