An Environmental Impact Statement (EIS) is not required under RCW 43.21 C.030(2)(c). This decision was made after review of a completed Environmental Checklist and other information on file with the Lead Agency. This information is available to the public upon request. Appeal of this determination must be filed within a 14-day period following this final determination date, per Mason County Code Chapter 15.11 Appeals. -7I7(0 Authorized Local Government Official Date MITIGATED DETERMINATION OF NONSIGNIFICANCE (WAC 197-11-350) SEP2009-00039 CONDITIONS OF THIS DETERMINATION 1) Water quality is not to be degraded to the detriment of the aquatic environment as a result of this project. X 2) A Hydraulic Project Approval from the Washington Department of Fish and Wildlife shall be obtained prior to work on the banks of or within the waters of the State. X 3) Debris or deleterious material resulting from construction shall be removed from the beach area and project site and shall not be allowed to enter waters of the State. X 4) All other necessary permits from Mason County, Washington State and/or Federal Agencies that are required for this proposed development and construction must be obtained PRIOR TO SAME DEVELOPMENT AND CONSTRUCTION. X Erosion control measures must be in place prior to any clearing, grading, or construction. These control measures must be effective to prevent soil from being carried into surface water by stormwater runoff. Sand, silt, clay particles, and soil will damage aquatic habitat and are considered pollutants when discharged to waters of the state. X Any discharge of sediment-laden runoff or other pollutants to waters of the state is in violation of Chapter 90.48, Water Pollution Control, and WAC 173-201A, Water Quality Standards for Surface Waters of the State of Washington, and is subject to enforcement action. X During construction, all releases of oils, hydraulic fluids, fuels, other petroleum products, paints, solvents, and other deleterious materials must be contained and removed in a manner that will prevent their discharge to waters and soils of the state. The cleanup of spills should take precedence over all other work on the site. Do you have any plans for future expansion, or further activity related to or connected with this proposal: if yes, explain. No. 8. List any environmental information you know about that has been prepared, or will be prepared, directly related to this proposal. None has been prepared. 9. Do you know whether applications are pending for governmental approvals of other proposals directly affecting the property covered by your proposal? If yes, explain. No. MASON COUNTY ENVIRONMENTAL CHECKLIST 2 10. List any government approvals or permits that will be needed for your proposal, if known. A Mason County Shoreline exemption and building permit, and an HPA from the WDFW. 11. Give a brief, complete description of your proposal, including the proposed uses and the size of the project and site. There are several questions later in this checklist that ask you to describe certain aspects of your proposal. You do not need to repeat those answers on this page. (Lead agencies may modify this form to include additional specific information on project description.) Shoreline protection shall be constructed using large angular rock along approx. 110 to 120 lineal feet of frontage, landward the toe of the bank at the site, including one set of beach access steps. Height of the bulkhead to be a maximum of 6 feet above the existing beach grade. Base rock to be keyed into beach a minimum of 18-24" below the existing beach grade. Entire length of the bulkhead to be backed with 4-8" quarry spalls and filter fabric. Bulkhead to be constructed landward of MHHW. Minimal vegetation shall be disturbed and existing woody debris to be anchored to the beach. All man-made debris on beach will be removed from the site, including concrete and asphalt. Equipment shall be driven to the site. 12. What is the location of the proposal? Give sufficient information for a person to understand the precise location of your proposed project including a street address, if any, and section, township, and range, if known. If a proposal would occur over a range of area, provide the range or boundaries of the site(s). Provide a legal description, site plan, vicinity map, and topographic map, if reasonably available. While you should submit any plans required by the agency, you are not required to duplicate maps or detailed plans submitted with any permit applications related to this checklist Take Hwy. 3 north. Near Belfair, turn left(at the light) onto SR Hwy 106. Site is just west of Merrimount Drive, on the Hood Canal, immediately adjacent Hwy 106. B. ENVIRONMENTAL ELEMENTS: 1. EARTH: a. What is the steepest slope on the site (approx. percent slope)? The bank slope at the site is approx. 70 to 90 degrees. C. What general types of soils are found on the site (for example, clay, sand, gravel, peat, muck)? If you know classification of agricultural soils, specify them and note any prime farmland. Sand, clay, rock, and gravel. d. Are there surface indications of history of unstable soils in the immediate vicinity: If so, describe. Erosion from wave and tidal action is occurring at the site. e. Describe the purpose, type, and approximate quantities of any filling or grading proposed. Indicate source of fill. No filling or grading shall be done. f. Could erosion occur as a result of clearing, construction, or use: If so, generally describe. No. g. About what percentage of the site will be covered with impervious surfaces after project constructions (for example, asphalt or buildings)? The project will not add any new impervious surface to the site. The rock bulkhead will be pervious to water. h. AIR: a. What types of emissions to the air would result from the proposal (i.e. duct, automobile, odors, industrial wood smoke) during construction and when the project is completed? A provision for replacing the LWD if washed away by stones or other factors needs to be in place in the mitigation measures before permiting this project. A provision for adding additional surf smelt gravel if it is washed away due to wave energy from the new bulkhead needs to be in place in the mitigation measures before permitting this project. If the following provisions are meet the Tribe agrees with your determination of nonsignificance. However,the Skokomish Tribes Tribal Historic Preservation Officer will be providing coiminent as to the potential cultural impacts of this SEPA and you should not move forward with the above project until you receive those comments.
