1) Owner/Agent is responsible to post the assigned address and/or purchase and post private road signs in accordance with Mason County Title 14.28.

2) The international code requires a fire apparatus access road for every facility, building, or portion of a building that is more than 150' from an approved
access road. Roads are required to meet the minimum Mason County Fire Marshal standards for Fire Apparatus Access Roads up to the point where
such roads connect with a county maintained public road or to another fire apparatus access road which connects to a county maintained public road.

3) All exterior wall cavities exposed during construction or remodeling work shall be insulated to the full depth of the wall cavity and inspected prior to

4) The plan review check list and corrections are part of the approved plans and must remain thereto. It is the responsibility of the applicant to make the
corrections indicated on the plans. Once the plans are marked "APPROVED", they shall not be changed or altered without authorization from the Building
Official. The permit holder is responsible to retain the complete approved set of plans on site for the duration of the project. Failure to comply and/or
removal of app ved documents will result in failure of required building inspections.

18) CONSTRUCTION PROCESS TO BE FIELD CORRECTED AS REQUIRED PER MASON COUNTY BUILDING DEPARTMENT AND THE ADOPTED
BUILDING CODE.
The construction of the permitted project is subject to inspections by the Mason County Building Department. All construction must be in conformance

Per Mason County Code,"Title 14,Chapter 14.48 a stormwater site plan is required whenever a building application is
made for residential development, or redevelopment',with more than 2,000 square feet of impervious surface'.

REQUEST FOR ADDITIONAL INFORMATION

Comments: As shown on the most recent site plan dated June 23, 2009, the
proposed expansion will require a Resource Ordinance Variance.
The Fish & Wildlife Habitat Conservation Areas (F&WHCA) chapter of
the Mason County Resource Ordinance (MCRO) requires a 20-foot
buffer plus a 15-foot building setback for a minimum of 35 feet
(17.01.110 figure 1). Since the existing structure is located entirely
within the F&WHCA buffer and setback, it is considered legal
non-conforming.
The F&WHCA chapter of the MCRO allows for the remodeling or
rebuilding of an existing non-conforming structure plus 10% (17.01.110
F.1 .a.) as long as it does not encroach further into the buffer. Given the
current footprint of 540 square feet, the planning administrator can
approve an expansion up to 594 square feet. Anything greater than
that will require a variance from the MCRO. It appears as though this
highly constrained lot would meet all of the variance criteria as set forth
in Title 15, section 15.09.057. Resource Ordinance Variance
applications must be accompanied by a Habitat Management Plan per
MCRO 17.01.110 G.1.c.1.
A reduction in the required front yard setback can be approved by
administrative variance for no less than 10 feet from the edge of the
road right-of-way per Mason County Development Regulations
17.05.034 C.

Re: BLD2009-00084—Letter of Incompleteness
Dear Mr. Bayley:
Mason County Planning Department is currently reviewing your proposal to rebuild a cabin in its
existing footprint and add an 80 square foot addition. In 2007,planner Allan Borden conducted
a site review at the request of David Bayley. At that time it was unclear what form the proposal
would take. Mr. Borden provided an overview of the applicable regulations at that time, in
relation to the Shoreline Master Program. To the east of the small cabin, there is a concrete
bulkhead that runs from under the small structure, in an easterly direction to the end of the
property. This bulkhead also forms part of the support for the structure under the west wall, on
the waterward portion of that side of the structure. At street level there is a garage door set into
the south wall of the structure. The land slopes down to a lower level. The portion of the cabin
on the lower level is a single lower story(see attached photo).
This letter addresses how Shoreline Master Program, Resource Ordinance, and Development
Regulations regulations specifically apply to your project. Please note that where more than one
regulation applies to a particular proposal, each regulation must be met.
A. Mason County Shoreline Master Program(SMP): Mason County SMP Chapter 17.50
Residential Development section provides guidance for shoreline regulations which address
residential development. The shoreline designation is Urban Residential,which has a minimum
setback of 15 feet from the Ordinary High Water Mark. Where there is an adjacent residence or
residences within 150 feet laterally of the subject property,the shoreline setback common line
also applies. On this site, the property to the east protrudes further into the shoreline, so the 15
foot default setback would apply. To the west there is no residence on the waterward side of the
road. This means the 15 foot setback on the west side would be measured from the Ordinary
High Water Mark on the west side of the house, which is considerably landward of that on the
east side,because of the bulkhead angling back along the west side of the house.
--XTThe building permit application proposes to re-build the cabin in the same footprint,but adding
an upper floor to the portion of the cabin that is the waterward single story portion of the
structure. Several key issues affect the possibility of this proposal from the perspective of the
SMP.

nonconforming development cannot be expanded—i.e. by adding a second story. Mason
County Development Code section 15.09.055.B—Applicability to Nonconforming
Development states that"Expansion of a nonconforming development is prohibited."
Adding a second floor to the existing structure,waterward of the 15ft shoreline setback
would therefore be prohibited. As noted in(1) above, the structure can be maintained and
repaired—however it cannot be completely rebuilt from the foundation up as you have
proposed.
B. Mason County Resource Ordinance: Fish and Wildlife Habitat Conservation Area Chapter
17.01.110 also provides guidance in the review of development on the shoreline of the Hood
Canal. Under this chapter, the minimum setback from the Ordinary High Water Mark of
Hood Canal is 35 feet. The 20 feet closest to the shoreline is the shoreline buffer. If the
propose expansion of the existing footprint were proposed to an existing structure(rather
LAVAthan at rebuild). a 10%expansion would be allowed within the 35 foot shoreline setback, as
gas it met the 15ft minimum SMP setback,per section 17.01.110.F.1. Currently the
expansion to the footprint is greater than 10% and would not be allowed.
C. Mason County Development Regulations Section 17.05.034 provides for reduction of the 25
foot frontyard setback(road setback) under an administrative variance procedure. However
the minimum allowable reduction through that process would be down to 10 feet. Even
absent the Shoreline and Resource Ordinance regulations, the rebuild would have to meet the
10 feet.
As it is proposed, staff cannot approve your rebuild and expansion of the small cabin. However
we are available to answer questions on the regulations, so you can look at what might be
possible. In addition we would strongly suggest you contact the Mason County Health
Department about the status of the septic system. It appears to be an older 3-bedroom system
that already serves the 3-bedroom house on the lot to the east.

Comments: You will be adding 80sf of living space and changing the garage/storage to
living space. This will be an expansion of living space greater than 200sf. The
on-site septic system is closer than 100' to the shoreline. It will need to meet
current code. The exisitng system is a three bedroom with a three bedroom
home plus the cabin.
