Conservation Easement
This Covenant is applicable to Tax Parcel No. 322353190050, described as
Tract 5 of Government Lot 3, excluding Tract 2 of Short Plat #1532, located in
Section 33, Township 22N., Range 3W.W.M., in Mason County, Washington. Said
property is hereby dedicated to open space and habitat protection, and shall not be
used for any structures or activity requiring a building permit, development permit, or
harvest permit under the laws of Mason County or the State of Washington. This
Covenant is subject to a water line easement recorded January 13, 1997 at Mason
County Auditor's File No. 640322. A portion of this water line crosses the above-
described parcel, but does not benefit either of the two parcels involved in this
Conservation Easement.
This Covenant is to be recorded coincident with the issuance of a building
permit for a residential structure on Tax Parcel #322353100030, described as Tract 3
of Lot 3 located in Section 33, Township 22N., Range 3W.W.M., in Mason County,
Washington, and benefits said parcel by providing habitat protection to mitigate new
construction.
This Covenant runs with the land on the two above-described parcels and shall
be binding on all successors-in-interest however title may be acquired; provided,
however, condemnation of all or any portion of the open space property for public
purposes shall not constitute a violation of this Covenant.
