The Lead Agency for this proposal has determined that it does not have a
probable significant adverse impact on the environment. An Environmental
Impact Statement (EIS) is not required under RCW 43 .21C. 030 (2) (c) . This
decision was made after review of a completed Environmental Checklist and
other information on file with the Lead Agency. This information is
available to the public upon request.
This DNS is issued under 197-11-340 (2) , the Lead Agency will not act on
this proposal for 15 days from the date below. Comments must be
submitted by 07/20/94 .

SUBJECT: Hydraulic Project Application - 150-Foot Concrete Upland Retaining Wall -
Hood Canal, Tributary to Admiralty Inlet, Section 27, Township 22 North,
Range 03 West, Mason County, WDFW Log No. 00-65183-01, WRIA 15.MARI
Dear Ms. Olsen:
Washington Department of Fish and Wildlife (WDFW) received the above-referenced Hydraulic Project
Application on June 16, 1994, but we are unable to complete processing at this time for the following
reason(s):
Proposal Design - Project modifications are required.
WDFW reviewed the plans and specifications for the proposed project and determined that they
do not provide adequate protection for fish life. The application and specifications
accompanying plans for the proposal indicated that the retaining wall is to be placed upland.
Upland is defined as the property located landward of ordinary high water (OHW). OHW is
"the mark on the shores of all waters that will be found by examining the bed and banks and
ascertaining where the presence and action of waters are so common and usual and so long
continued in ordinary years, as to mark upon the soil a character distinct from the abutting
upland, in respect to vegetation . . ." (Washington Administrative Code, WAC 220-110-
020(24)).
Neil Rickard, Area Habitat Biologist, inspected the site of the proposed project on June 28,
1994. The property was generally flat adjacent to the Northshore Road, sloping toward the
shoreline of Hood Canal with a defined bankline being found only at the extreme east end. The
property landward of the shoreline had been completely denuded of all vegetation and contained
no residential dwellings or other structures. The western portion of the property contained
vegetation along the shoreline making a determination of OHW possible. This determination
should be made by a qualified representative from Mason County or Department of Ecology.
The slope along the remainder of the property had been cleared and graded making an OHW
determination impossible.

Based on site-specific characteristics, WDFW requires that the waterward side of the footing
excavation for the western portion of property be placed 3 feet landward of all wetland vascular
plants. For the remainder of the property where all vegetation has been removed, the waterward
face of the retaining wall should not be placed waterward of the toe of the slope.
Your proposal is placed on hold until we receive the above-identified information. Your application will
be processed after the information has been received.

the state of Washington.
