September 29,2017 Notice of Decision Case: DDR2017-00064 Applicant: Port of Grapeview Notice is hereby given that Port of Grapeview, whom is the applicant for the above- referenced Special Use Permit Request, has been granted the Permit. The request was approved pursuant to the Mason County Development Regulations, specifically for the use of a 185 sq. ft. public restroom facility. This is a final County decision. No further appeals to the County are available. Appeal may be made to Superior Court or the appropriate administrative agency as regulations apply. Is�� �A�� Nti. 1�1� ss�66ob I 1 BEFORE THE HEARING EXAMINER FOR MASON COUNTY 2 Phil Olbrechts,Hearing Examiner 4 RE: Port of Grapeview 5 FINDINGS OF FACT,CONCLUSIONS Special Use Permit OF LAW AND FINAL DECISION 6 DDR2017-00064 7 8 INTRODUCTION 9 10 The applicant seeks a special use permit (SUP) for the construction of a 185-square foot restroom within an existing parking lot for boat trailers located at 5052 E. I 1 Grapeveiw Loop Road. The application is approved. Concerns raised about the project at the public hearing are individually addressed in Finding of Fact No. 5 at 12 pages 3-4 of this decision. 13 ORAL TESTIMONY 14 [This summary is only provided for the convenience of the reader, to provide an 15 overview of the testimony presented at the hearing. The summary of testimony is not to be construed as containing any findings of fact or conclusions of law, or as indicating 16 what information the examiner found pertinent or significant.] 17 Ron Buckholt, Senior Mason County Planner, summarized the staff report. In response to examiner questions, Mr. Buckholt clarified that the shoreline is on the 18 east side of Grapeview Loop. 19 Roger Hansen,project architect,noted that the restroom is funded by an RCO grant as 20 part of a larger project involving improvements to the boat ramp and the installation of a dock. A portable chemical toilet is currently located on the project site. Up until 21 three or four years ago there was a trailer on the site and that's why there's a septic drain field in place, which served the trailer. There's also a well that has been 22 approved for the proposal but it can't be used for potable water. 2' Robert Allen, neighboring resident, opposes the design of the project. Mr. Allen noted 24 that as recent as their last regular meeting three weeks ago the Port of Grapeview commissioners were saying there's no plan for the restrooms. They hadn't figured 25 out if they were going stick built, concrete or some other design. Mr. Allen has formerly served as a port commissioner for 20 years. Mr. Allen is aware that the RCO grants would require the restroom to be ADA compliant. The commissioners aren't aware of the proposed design. Mr. Allen disputes the County's position on Special Use Permit P. 1 Findings, Conclusions and Decision health impacts. The drain field is a very old one that is surrounded by cedar trees and I wetlands. Anytime there's moisture there's water that crosses from the uplands over 2 the road, because someone took out the Port's culvert. The Port commissioners have no plan for maintenance of the facilities. There are multiple problems associated with 3 the proposal. One is vandalism. The Port of Allyn has seen a lot of vandalism of its wooden structures. The Port of Grapeview has had one act of vandalism involving{ 4 fire crackers that necessitated a new portable toilet. Citizens in the area are very much against the project. The three commissioners are members of a small 5 organization in favor of the project. The entirety of the residential trailer was 320 6 square f et. The proposed system is much larger than the system used to serve the trailer. Surface water is a problem. Water goes right over the drain field and is an 7 continues north into Puget Sound. There's no site for a secondary drain field. Without potable water, it's unclear how people are supposed to clean their hands 8 keep the restroom sanitized. In the June regular meeting several people walked out in disgust because they wouldn't be heard on problems with the restroom. The 9 commissioners are part of a group that represents only 2% of the taxpayers of the 10 area. 9/10's of the use of the facility is commercial, like UPS drivers. That's why the Port made the restroom a year-round portable toilet because there is no other 11 public restroom available in the community. It's still not known if the project will be constructed as there are still other review processes involved. The special use permit 12 should not be issued until it's known whether or not the project will be built. 13 In rebuttal, Ron Buckholt noted that the Department of Health has reviewed and approved the drain field. The applicant has submitted full design plans for the facility, including materials. 16 17 In rebuttal, Mr. Hansen noted that the water is designated non-potable because it comes from a well and is used for a public facility. There's nothing wrong with the 18 water other than the regulations prohibit its use for drinking. The water is otherwise fine. The water is fine for cleaning and washing hands. The project is currently 19 going through building permit review and has probably cleared all departments. A secondary drain field has been designated as required by the Department of Health. 20 The Health Department has approved the project for septic permits. There are other 21 phases of review involved, specifically for improvements to the boat ramp and the installation of a dock. Mr. Hansen noted that if there are insufficient funds, the ADA 22 restroom will not be built. There is community support for the project. 23 EXHIBITS 24 25 The seven exhibits identified at page I of the August 30, 2017 Staff Report were admitted into the record during the September 13, 2017 public hearing. Google maps was admitted as Ex. 8. Special Use Permit p.2 Findings,Conclusions and Decision 1 FINDINGS OF FACT Procedural: 4 1. Applicant. The applicant is the Port of Grapeview. 5 2. Hearing. A hearing was held on the application at 1:00 pm on September 13, 2017 in the Mason County meeting chambers of the Mason County 6 Commissioners. 7 Substantive: 8 3. Site/Proposal Description. The applicant seeks a special use permit(SUP) 9 for the construction of a 185-square foot restroom within an existing parking lot for 10 boat trailers located at 5052 E. Grapeveiw Loop Road. The restroom will consist of two (2) individual bathrooms for men and women and will be ADA compliant. The 1 1 structure will be wood frame and metal roof. The front facade of the facility will include a covered porch area for weather protection. The parcel associated with the 12 proposed public restroom is slightly larger than an acre is size. The site is relatively flat and there are no critical areas on the property. 13 14 4. Characteristics of the Area. The property is surrounded by RR-5 zoning 15 as well, except for the parcel across the street to the south, which is zoned RC-2 (Rural Commercial). The subject parcel and the surrounding parcels east of 16 Grapeview Loop Road make up the Port of Grapeview ownership, which includes the port, marina, boat launch, and associated parking. The proposed public restroom 17 facility will be located in the area of the existing parking lot for boat trailers, on the 18 west side Grapeview Loop Road. 19 5. Adverse Impacts of Proposed Use. There are no adverse impacts 20 associated with the proposal. Pertinent impacts are individually addressed as follows: 21 A. Public Health. Several concerns were raised about the public health impacts 22 of the proposal, including assertions that the project is lacking a secondary drain field, that the proposed drain field will be inundated with stormwater 23 and that the restroom will only be served by non-potable water. All of these issues are comprehensively addressed in on-site sewage and water system 24 regulations, implemented by Mason County Public Health in their issuance of approvals for the proposed septic and water systems. Most notably, septic 25 regulations specifically require surface waters to be directed away from drain fields. See Washington Administrative Code ("WAC") 246-272A-0210(5)(e); WAC 246-272A-0270(1)(g)(ii). Mason County Public Health has tools available to it to enforce these septic standards. See WAC 246-272A-0430. It Special Use Permit p. 3 Findings,Conclusions and Decision is certainly possible that Mason County Health was not aware of the drainage 1 characteristics of the property identified at the public hearing. The conditions 2 of approval require this information to brought to the attention of Mason County Public Health in case it does constitute a health issue that needs to be 3 addressed. 4 B. Aesthetics. Aerial photographs, Ex. 8, and staff testimony establish that the 5 proposal will not adversely affect any shoreline views. 6 C. Vandalism. One person testified that there was potential for vandalism because the existing porta-potty had been vandalized once before and the Port 7 of Allyn facilities have been vandalized. This evidence does not reasonably suggest that the project site would be unusually susceptible to vandalism to 8 the extent that any protective measures would have to be required. Further, since the facility is managed by a public entity, affected residents will have 9 some leverage to compel repairs when necessary. 10 11 D. Accessibility. Concerns were expressed during the hearing over whether there was sufficient funding to make the restrooms compliant with federal 12 accessibility requirements under the American With Disabilities Act ("ADA"). ADA requirements will be imposed as a part of building permit 13 review under Chapter 11 of the International Building Code. The applicants will not be allowed to construct the restrooms without complying with 14 accessibility requirements. 15 16 E. Fundin hasin ublic Opposition. Several concerns were raised at the public hearing regarding the funding, phasing and public opposition to the 17 project. These issues are beyond the scope of special use permit review, which are limited to addressing the special use permit criteria applied in the 18 conclusions of law below. 19 20 CONCLUSIONS OF LAW 21 Procedural: 22 1. Authority of Hearing Examiner. MCC 15.03.050(10) and 17.05.042 23 provide the Examiner with the authority to review and act upon Special Use Permits. 24 Substantive: 25 2. Zoning. The zoning is Rural Residential 5. Special Use Permit p.4 Findings, Conclusions and Decision l 3. Review Criteria and Application. MCC 17.04.222(c) requires a SUP for I essential public facilities in the RR5 district. The review criteria for an SUP 2 application are governed by MCC 17.05.044, which are quoted below in italics and applied through corresponding conclusions of law. These criteria, in addition to 3 miscellaneous criteria that apply to all Hearing Examiner decisions, are addressed below. 4 MCC 17.05.044 SPECIAL USE REVIEW CRITERIA: 5 6 (1) That the proposed use will not be detrimental to the public health, safety and welfare. 7 4. There are no significant adverse impacts associated with the proposal as 8 determined in Finding of Fact No. 5. Consequently, the proposed use not will not be 9 detrimental to the public health, safety and welfare. 10 (2) That the proposed use is consistent and compatible with the intent of the Comprehensive Plan. 11 5. The proposed use is consistent and compatible with the Comprehensive 12 Plan Chapter IV description of Rural Areas, which authorizes "[s]mall-scale recreational and tourist uses consistent with a rural nature." The proposed restroom 13 is a nominal improvement to a rural recreational activity, i.e. boating. 14 (3) That the proposed use will not introduce hazardous conditions at the site that 15 cannot be mitigated through appropriate measures to protect adjacent properties and the community at large. 16 17 6. All hazardous aspects of the proposed use are comprehensively regulated and addressed by Mason County Public Health in its implementation of Washington 18 State's septic regulations. 19 (4) That the proposed use is served by adequate public facilities which are in place, or planned as a condition of approval or as an identified item in the County's Capital 20 Facilities Plan. 21 7. The proposal is itself as public facility. It will be served by adequate 22 water from an on-site well. 23 (5) That the proposed use will not have a significant impact upon existing uses on 24 adjacent lands. 25 8. As determined in Findings of Fact No. 5, no significant impacts are expected to result from this proposal, including impacts on adjoining properties. Special Use Permit p. 5 Findings, Conclusions and Decision 1► (6) If located outside an Urban Growth Area that the proposed use will not result in 1 the need to extend urban services. 2 9. As determined by staff, the proposal will not result in the need to extend 3 urban services. 4 MISCELLANEOUS CRITERIA FOR ALL HEARING EXAMINER REVIEW: 5 MCC 15.09.055(C): Required Review: The Hearing Examiner shall review 6 proposed development according to the following criteria: 7 1. The development does not conflict with the Comprehensive Plan and meets the requirements and intent of the Mason County Code, especially Title 6, 8, and 16. 8 2. Development does not impact the public health, safety and welfare and is in the public interest. 10 3. Development does not lower the level of service of transportation and/or 11 neighborhood park facilities below the minimum standards established within the Comprehensive Plan. 12 10. According to staff, the proposed development complies with the Mason 13 County Code Titles 6 and 8.The project is not subject to Title 16, which only governs 14 subdivisions. As previously determined, the proposal is consistent with and therefore does not conflict with the Comprehensive Plan. As determined by staff in the Staff 15 Report, the proposed use expansion should not lower the level of service of transportation facilities below the minimum standards established within the 16 Comprehensive Plan. As previously determined, there are no significant adverse 17 impacts associated with the proposal so it does not impact the public health, safety and welfare. Given these factors and the important role that the applicant plays in the 18 economy of Mason County, the proposal is in the public interest. 19 DECISION 20 21 The proposal is consistent with all applicable SUP standards as outlined above and is approved subject to the following condition: 22 1. County planning staff shall apprise Mason County Public Health of the drainage 23 issues raised by Robert Allen during the public hearing, including that the alleged removal of a culvert by an adjoining property owner may result in stormwater 24 flows across the proposed drain field. 25 Dated this 27th day of September 2017. Other Permits/Approvals. The proposal will require a Mason County Building Permit for the construction of the proposed public restroom. A Notice of Application and Public Hearing(Exhibit 4)was posted in the Mason County Journal on August 17,2017 (Exhibit 7).Notice was posted on site on August 31, 2017 (Exhibit 5) and mailed to neighboring properties on August 9, 2017 (Exhibit 6).No comments have been received as of the date of this report. VIII. Analysis. A Comprehensive Plan Review: Type III review for permit applications require that the Hearing Examiner evaluate the proposal for consistency with the County's Development Code, adopted plans and regulations. The Hearing Examiner shall review the proposal according to the following criteria: 1) The development does not conflict with the Comprehensive Plan and meets the requirements and intent of the Mason County Code, especially Title 6, 8 and 17. The development does not conflict with the Comprehensive Plan and meets all the requirements and intent of'the Mason County Code. The development proposal will not impact the public health, safety or welfare. 3) The development does not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the Comprehensive Plan. The development proposal will not lower the LOS for transportation or neighborhood park facilities. MCC 17.05.044 Applicable Special Use Review Criteria: 1. Will the proposed use be detrimental to the public health, safety and welfare? The placement of the proposed public restroom meets all county setbacks and assures adequate off street parking. Per MCC 17.04.223, non-residential uses require a 25 ft front, side and rear yard building setback(s). Furthermore, the restroom will be required to be setback 5 feet from the existing on-site septic tank and 10 feet from the on-site drain field(and reserve drain field). No potential detrimental effects have been identified. 2. Will the proposed use be consistent and compatible with the intent of the Comprehensive Plan? The proposed use is consistent and compatible with the Comprehensive Plan. Rural Residential 5 zoning does allow for public facilities via an approved special use permit. 3. Will the proposed use introduce hazardous conditions at the site that cannot be mitigated through appropriate measures to protect adjacent properties and the community at large? No hazardous conditions are expected as a result of the proposal. 4. Is the proposed use served by adequate public facilities, which are in place, or planned as a condition of approval or as an identified item in the County's Capital Facilities Plan? Utilities, which are in place or will be in place, are currently adequate to serve the proposed public restroom, such as public road access, surface parking, water well, septic tank and drain field(s). The proponent will be required to place a reserve drain field on site as a contingency back-up plan in the event that the primary drain field fails. The project will not lower the level of service of transportation or neighborhood park facilities below applicable minimum standards. 5. Will the proposed use have a significant impact upon existing uses on adjacent lands? There will be no significant impact upon existing adjacent land uses. Adjacent properties and land uses are primarily owned by and affiliated with the Port of Grapeview operations. 6. If located outside an Urban Growth Area, will the proposal result in the need to extend urban services? The proposed public restroom would not result in a need to extend urban services. The restroom will tie in with aseptic drain field and it will not provide drinking water. At . the time of building permit review, a condition of approval will require a sign to be posted inside the public restroom, stating "not approved as drinking water". The proponent shall provide a landscaping plan to the Planning Department for consideration at the time of building permit submittal. Site plan shall indicate the placement of an ADA parking stall and ADA accessibility (safe connection path with associated ramps) from said stall to the entrance of A ♦' the proposed restroom facility. ADA infrastructure shall be placed as close as possible to the restroom facility. Although this is a building department requirement, it needs to be addressed on the site plan associated with the Special Use Permit, in order to demonstrate that the site plan is feasible before the proposal can go to public hearing.
