Box 1002 Allyn WA 98524-1002 NOTICE OF MASON COUNTY CODE VIOLATION ENFORCEMENT CASE ENF2013-00090 PARCEL NUMBER: 12220-50-74001 SITE ADDRESS: 161 E Lakeland Dr. Allyn Dear Mr. Woodward: Mason County Dept. of Community Development has received concerns about land use activities taking place on the subject property that are in violation of Mason County Codes regarding (a) the expansion of an existing non-conforming land use and (b) conducting an open storage business enterprise on your property with no county reviews. Each of these violations requires a decision on your part. This property has had a self storage business enclosed in a building that was constructed around 1978. The Allyn community worked on an urban growth area subarea plan in the mid-2000's, and that plan and the associated zoning map were approved in June 2007 by the Mason County Board of Commissioners. The subject property is part of a designated Village Commercial (VC) zone that promotes a pedestrian-oriented mixed use district with many community wide and tourist retail land uses, with residential uses on the second story of the buildings. The recent concern (since early September 2013) involves the expansion of storage involving the parking of recreational vehicles outside of the existing building in areas that are accessed from the south. Mason County Dept. of Community Development considers your enclosed self-storage business enterprise, and the now expanded open storage, as being non-conforming land uses, as the VC zone permitted uses do not allow such storage use; see Mason Co. Code Sec. 17.12.100 enclosed. The Storage @ Allyn enterprise as an enclosed self-storage business can continue on your VC zoned property, but the outside open storage of vehicles must cease operation, as the use is not allowed in the VC zone. Outside open storage in the Allyn urban growth area is an allowed land use in two zones: a) the Highway Commercial (HC) zone as an accessory use; or b) the Business Park (BP) zone following a special use permit public hearing review. This public review involves application submittals, public notification, public hearings in front of the County Hearing Examiner, and a decision of the hearing proceedings. Woodward storage area land use Dec 2013 letter In the review of the reported outside open storage land use, you have one choice of actions to take: CEASE OPERATION of the open storage of vehicles outside of the enclosed storage building on the property. With this action, you will no longer have the expansion of an existing non-conforming land use and no longer conduct an activity that is not allowed in the Village Commercial (VC) zone. In the meantime as you make your choice, Mason County Dept. of Community Development will monitor activities on this subject property. To address these concerns and the violation of Mason County Code, please comply with this request and submit proof that you have complied as requested above to the Dept. of Community Development by December 23, 2013.
