Box 480 Allyn, WA 98524 January 28, 2011 RE: FPA 2008-00005 Dear Mr. Carey, This letter is a follow up to our recent phone conversations and my Stop Work Notice of 1/21/11. Today I returned to your property and removed my Stop Work order from your property. Below I will explain why I did so. Regarding the logging without a permit, you recently explained to me that the logging occurred in December and January without any permits. You told me that the reason that you cut without a permit is that you were thinking that you qualified for the 5,000 BF per year exemption. You told me that you cut about 9,000 BF in all, less than 5,000 in December 2010 and less than 5,000 in January 2011. Unfortunately the 5,000 BF exemption is per 12-month period, not calendar year. However I think that your activity qualifies as Class I FPA(permit exemption)for the following reasons: The property logged falls into three ownerships: Jeff Carey, Harold Carey and Mason County. The property logged in the Jeff Carey ownership is less than two acres in aggregate, so categorically exempt regardless of the volume cut or the eventual disposition of the timber. The Harold Carey parcel that was logged was a fraction of an acre, but is contiguous to other parcels in the same ownership that exceed two acres. The logging on the Harold Carey parcel can still be considered a Class I provided that the volume cut is under 5,000 BF (which it is) and that the timber is not sold. As for the timber that was cut off the County right of way(Kauffman St). The contiguous County ownership is greater than 2 acres but the volume is under 5,000 BF. This cutting can be considered a Class 1 providing that the timber is not sold. Using aerial photography I have calculated the total area that you logged at .87 acres. The threshold for a stormwater review is the disturbance of 1-acre or the creation of 5,000 sq. ft of impervious surface. You have described to me your intent to open up a portion of the Kauffman Street right of way and a portion of the ally between blocks 27 and 26 of the Plat of Allyn. This activity will require review for stormwater if the area of impervious surface created is 5,000 sq. ft or more. Yesterday told me that you are planning to makes sure that your work amounts to the creation of less than 5,000 sq. ft of impervious surface. Even if no County stormwater review is required, please do implement Best Management Practices as you develop your property. As for slopes, because no other permit is required, an area of concern is whether or not slopes of 15% or more (at with at least 10' of height) exist on or within 50 ft of your activity. Using an aerial photography and a clinometer on site, I have determined the slopes on, and immediately adjacent, to your logging are about 13% at the steepest. Thus no geological review is required for this work. I would like to comment that I noticed and appreciate the preservation of several snags on your property that show signs of being used for foraging by Pileated Woodpeckers, a protected species in Mason County. Please continue to design around these snags in the development of your property. If you need to alter these snags, a Mason Environmental Permit and a Habitat Management Plan will be required. For the record, the property that you logged was part of a bigger piece of ground that you had applied for a Class IV General FPA on in 2008 (FPA 2008-00005) but which has never been issued. You have informed me that you have no current plans for additional logging in the area covered under the application for FPA 2008-00005. Today I will close out that case as cancelled.
