the sale. Now you are telling me that it is compliant. I stopped the purchase of the building
based on the phone conversation with you during the sale. This is what I am talking about.
This is why I will correspond only by email from now on. I remember it very well and you dont.
I did tell you at the time of my feelings and you said you were sorry. I did not feel there was
much more to say, until I actually needed your help again. This time, because of our past
history, I wanted you to know how not confident in you I am.
Yes I would like to only interact with someone else in the planning department.

Attached is a letter I received from Dr. Marshal together with my response. Dr. Marshal wrote to the Board on
January 4, and we briefed on this item on February 21. On February 22 I received this email from her. I wanted
to preface these attachments by stating that it is not my intent to be defensive, argumentative or disrespectful to
Dr. Marshal, but simply to address the allegations laid against me. She has expressed her distrust of me and her
belief that I have been dishonest with her. I am truly sorry that she feels that way and hope that this letter will
provide some level of understanding for the events that occurred during that time. While she has stated that she
has not contacted an attorney, her reference to it puts me in the cautionary position of letting you know that as
well.

Please accept this letter in response to you email and attached correspondence dated February 22,
2o16. 1 have cited portions of your letter below together with my reply for your easy reference as
well as the parties copied.
In November of 2o13, the property at the metal scrap yard up the hill from Belfair was
approved by you, Barbara Adkins, as a compliant location for me to start my business. I
questioned you about the zoning, but in an email back to me,you approved the zoning. 1 leased
the property from the owner and the property was approved by the WSLCB.
In July of 2014, when I called Mason County for my pre-inspection, I was informed by Jeannie
McFarland, that Barbara Atkins had made a 'grave error'and the property is 'not compliant
due to the zoning'.
While I have no record of the actual date of your phone call with Ms. McFarland or the precise
verbiage, I will agree that the original determination of the property located at 25603 NE SR 3 in
Belfair was inaccurate. We expressed our sincere apologies at the time and continue to do so. It is
never our intent to mislead or misguide anyone who comes to us for assistance, we strive to be as
accurate and reliable with our information as humanly possible; but there are times we make
mistakes. For that I am,again,extremely sorry.
I was upset that I had leased the property for 8 months, losing sii,000 based on your word,
Barbara. The property owner then asked you, Barbara, if he could change the zoning of his
property from Business Industrial to General Commercial, just like all of the surrounding
properties adjacent to his, AND he and I could continue with business plans, without taking
such a financial loss. You, Barbara, told him, 7 will not consider any change or variance in
zoning for 1-502 purposes".
In this reference I can say with certainty that that would not have been my response. I do not
render decisions on zoning,as that authority lies solely with the Board of County Commissioners.
And our code does not provide relief of zoning restrictions that deviate from the allowed uses
through any variance process. That too, is not my decision, it is our code. If the property owner
would have requested a rezone it would not have been my place to tell him"no", it would only be
my place to advise him of his options. As written,the regulations for General Commercial in Belfair
do not permit wrecking yards. If the owner would have applied for and received a rezone to
General Commercial,the primary business would be considered a"non-conforming use"and future
modifications and expansions would have been negatively impacted.
I then entered into the purchase of my dental building in Belfair, based upon your
recommendation for 1-502 compliance, Barbara. During the sale, I called you to verify the
addresses compliance with you again, and you said, "My gosh!I've made another grave error.
We are justgetting to be best friends,aren't we".
I know of no other incident of misinformation other than that of the Belfair Auto Wrecking site. On
November 23, 2013 and May 22, 203.41 received emails from you stating that you were in the
process of purchasing the building where your dental practice is located at 2407o NE SR 3 in Belfair.
This location is and was zoned General Commercial and is appropriate for retail marijuana. If
another error was made, I cannot recall what it might have been.
Since November of 2013, 1 have been busy starting my other business in Allyn, but I never
stopped thinking about the business I wanted to start originally up at the scrap yard. 1 did
much research and spoke with z of the Mason County Commissioners and some planners about
my problems'in 2o13 and 2014,in my dealings with you.
I deeply regret that your experience in working with me was so unpleasant. I do wish I would have
known your feelings at the time;perhaps the damage would not be so irreparable now. I also hope
that the information I provided to you from November 2013 to July 2014 on the ten other properties
that you were interested in was timely and correct.
I have since found out that you HAVE changed zoning for 1-502 purposes and it was NOT your
place to tell us that you will not consider any zone change for I-502 purposes. You were unfair
and incorrect in the way you dealt with me in 2o13 and 2014. 1 also feel that you were not
forthcoming with information that would have allowed me to continue with opening my
business up at the scrap yard. That being said, I have NOT contacted an attorney. What I
would like,is for you to do your best to do your job and to help me as a business owner proceed
with starting a second location. I am appealing to you one more time, since you are familiar
with this case and I am not sure who else to turn to. The property has already been approved
by the WSLCB. The building we want to use was licensed as a coffee stand and has it's own
address.
The property in Belfair that recently underwent a conditional rezone was processed and presented
by me, but approved by the Board of County Commissioners. And again, I do apologize for
misinformation on the Belfair Wrecking site. As far as my withholding information from you that
would have allowed you to open a business at that site, please understand that there was not then
and there is not now a way for a retail marijuana business to open on that site without a rezone or a
code amendment. Both of which the property owner is completely within their rights to pursue.
On Saturday, 1 found out,from Randy Neatherlin, that there is a io%footprint rule that will
allow me to start an 1-502 retail in a not allowed zone, if the footprint of the retail is less than
1o%. !f this is true, then why did you not tell me, and let's move on and do it.
Retail uses within the Business Industrial zoning district of Belfair are limited io%of the building's
area and must be ancillary to the primary allowed use. In this case it would need to directly support
the auto wrecking business. The espresso stand was established in 3.999 and predates the adoption
of zoning regulations in Belfair. Therefore, its use is considered non-conforming and may continue
as such, but cannot change or expand. The location of a retail marijuana store in that building
would be a change of its vested use and would not be permitted.
I would like to propose a io%footprint zone allowance of Parcel #22321 140002o, address:
256oi NE State Route 3, Belfair WA 98528, based on the fact that it will make my company
bigger and better as well as adding so more jobs to Mason County,in the second location. The
property owner is extremely motivated for this change. These are the exact reasons, Barbara,
that you granted the zone change to Suspended Farms in Belfair.
As stated in the previous paragraph,the Mason County Code does not permit a change of use for
non-conforming uses. I understand this expansion of your current business would be highly
beneficial to both you and perhaps the County through increased revenues and job creation.
However,the only two remedies available for this property are to rezone it to a retail friendly zone,
or modify the regulations that dictate industrial land uses in Belfair. If the owner of the property in
question is interested in pursuing either of these two options, I would be more than happy to talk to
them.
If there is any doubt or you are not sure how to help me with this very important and long
standing issue, do not just tell me NO. My experience and history with you has been dodgy at
best. My confidence in your guidance is not complete so feet free to pass this letter to your boss
if you cannot help me.
I am very interested in meeting with your department regarding this,if it will help move things.
If you would prefer not to work with me in the future I completely understand. I can pass any
applications for this property on to another planner that you would feel more comfortable with. As
for my"boss", I report directly to the Board of County Commissioners and have copied them as well
as the Prosecuting Attorney's Office on this correspondence.

Zoning Correction Opens Door
For Another Grove Operation
Tuesday the Mason County Commission repaired another urban boundary designation which split a property in two
different jurisdictions, one half in the Urban Growth Boundary the other half outside the boundary. With approval
to correct the line issue, the owner pursued a rezone of their property(the old Belfair Nursery property)from
residential 4 (R-4) zoning to a mixed use designation.This designation along with a"development agreement"
would allow the investors to expand the current use to make their grow operation "bigger and better". According to
Commissioner Neatherlin, the investors have 2M in the property and business, and will bring much needed jobs to
the county.
Commissioner Jeffreys was cautious with her approval, as she did not want to give the appearance of"spot zoning",
which ultimately restricts the use of the property in the future. Commissioner Sheldon disagreed with the other two
commissioners, stating he did not want a repeat of the Sells Road property owners (zone R-5)when odors got out
of control.
The rezone was approved 2-0.

Barbara. I just thought I would let you know how things are going for me. Most 1-502 compliant property owners are well aware by
this time whether their property is desirable to marijuana retail. They have already been approached and given large cash
donations,up to 10,000 cash at each compliant location to NOT lease,rent or sell to any other retail lottery winners. This is what I
have been up against. I just thought you should know.....
It is actually getting to be sort of thuggish and gang-like around Mason County. I am getting a little concerned for my safety at this
point. There are groups of marijuana growers setting up in Mason County that'hold'the property. When the retailer pays the bribe,
they release the property and force the retailer to sign a contract that promises to fill 50%of our shelves with product from them.
1,being a dentist,am not used to these tactics.
I told the LCB and I just wanted you guys to know.
