NOTIFICATION OF INCOMPLETE APPLICATION
2/3/2004 Case No.: BLD2004-00093
Comments: A field inspection of the subject property was conducted on 1/30/04
pursuant to an after-the-fact application for a building permit for two
decks.
The shoreline setback for this parcel is derived using a common line
procedure. An imaginary line is drawn from the most waterward portion
of the roofline of one adjacent residence to the most waterward portion
of the roofline of the other adjacent residence. The position where this
line crosses the subject parcel serves as the setback for the parcel. No
structure may project into the setback. The waterward deck currently
exists forward of the required shoreline setback for the property. As
such it cannot be permitted but would require a variance from the Fish
and Wildlife Chapter of the Mason County Resource Ordinance. In
addition, the Mason County Shoreline Master Program (SMP) also
regulates structures forward of the common line. While the SMP is
less restrictive, it still requires that all structures forward of the common
line be less than 30' in height. A portion of the deck and stairway
exceeds 30' in height and is forward of the common line. To retain this
configuration, a variance from the SMP would be required. Application
for a variance does not guarantee approval. The proposal must meet
specific criteria listed in the relevant regulations. Please contact me to
discuss options for this project.
