My home is Tim 20, Madrona Morningside Beach on the North r'hore of
Hood Canal.. which is about two miles east of Tah uya. I have owned
this place for approximately 29 years.
A year ago, a ?.4".. CERAT,D T09S and family bought T.X 19 which is
adjacent to mine. He applied for and received a permit to build
a garage. At a later date, this permit was changed to allow a
residence on this lot. This new residence does not meet the set-
back standards for Mason County and does not meet his FIAT PLAN
as submitted.
DI contacted the Planning Department (Mr. lion F'awver) in person
with no results. Again, I made a trip to Shelton--this time
talking to tSr. Fawver and his supervisor. They agreed to come out
and inspect the properties. This they did- .at which time they
told me that MR. 1PX)S•S new house did, indeed, not meet the
building codes; but they offered no solution. Why? Just what
is their ,job?
I feel that somewhere the inspectors and the Planning Department
were negligent and derelict in their duties. I feel that MR. FOSS
should be made to conform to the rules of the KASON COMM PUNNING
D[,PAI?'I 4"NTT.
If there is any effort made to grant a variance to MR. FOGS, I would
like to be informed IN WRITING of the date and time.
I`lease consider this a STRONG, FORMAL PROTEST.

With reference to your letter dated October 1 , 19R1 ,
regarding the location of sideyard setback of. Mr. . and Mrs. Gerald
Foss at Madrona Morningside Reach, building permit numbers 10526
and 10278.
The Mason County Commissioners have obtained a copy of the
variance and talked to Mr . Ken Stevens, Building Official . A
variance was granted on September 25, 1981 , based on the fact that
there was no danger in fire to the existing buildings and based on
conditions set forth in the request from Mr . and Mrs. Foss . We
are enlosing a copy of the request for variance and a copy of
variance granted.
