Below you will find comments made regarding the proposed development and its critical values. In some cases, setbacks for development from shorelines, steep slopes, streams, and wetlands must be included in your specific proposal; these setbacks are included as part of the comments listed below. This information is based on County and State regulations as they exist to date. These regulations may change and may affect the requirements for development of the subject property. The zoning is Rural Residential 5 (RR5). Single-family homes are an allowed use. The Shoreline Environment Designation is Urban under Mason County's Shoreline Master Program. The existing dwelling on the subject property has a "vested footprint" allowing for maintenance, repair and replacement. Any new expansion of the footprint would need to conform to current regulations. The minimum required setback for new construction along a shoreline is a combined 35 feet from ordinary high water (OHWM), usually defined as the face of the bulkhead. The 35-foot setback is defined as 20 feet of vegetative buffer not to be altered from its present condition, and a 15 foot building setback, which may be maintained as lawn, but no "above grade structures" are permitted to be placed in this area. No vertical expansion or horizontal expansion of existing footprint or building height is permitted forward of the 15 foot line from OHWM. Setback distances may be reduced for side-yards and front-yards to a minimum of 5 feet and 10 feet, respectively. An Administrative Variance for reduction in setback would need to be approved to do so, at a fee of $90.
