RE: Variance Conditions
Dear Ed,
The building department sideyard variance request has been
approved conditional upon meeting the fire rated construction
requirements . When I was on site, we briefly discussed that this
could be a possibility. At a minimum, this would not allow any
openings and would require a fire wall at those encroaching wall
sections as I explained during our visit .
I have forwarded the approved variance document to the
Auditor' s office for recording. Once complete, they will mail
you the original .

Thank you for your consideration of our proposal. We have attached the forms required for
the request. We would also like to provide this summary.
Proposed Projects
The proposed projects consist of:
• an all-purpose family/TV/computer/informal dining room
r a detached garage/shop.
An existing 35-year old 11'x13' building (whose setback ranges from to 1 feet) will be
replaced by the family room at a larger setback. Constructing this room on the second floor in not
feasible. This will be a frequently used,high traffic room near the kitchen. A second-floor location
would reduce supervision of grandchildren and other young relatives who visit and would eliminate
casual and larger-function meals from being served in this entertainment area. The intention is to
keep the original, old cedar-paneled living room in its classical condition without the higher tech
innovations of the proposed family room. Also, views from our neighbor's second floor residence
would be obstructed by our second-floor construction. A second floor addition to such an old house
would be cost prohibitive, adding to the hardship.
A 1-car garage of minimum dimensions(22'long x 14'wide)with a shop(K long x 14'wide)
is also proposed. N
Variance
The variance:
• has been agreed to by the Pearsons, owners of the adjacent property.
• is consistent with commonly found set-backs in the community
and will not grant a special privilege not enjoyed by at least nine
other properties in the immediate community.
The variance is needed because:
(1) the lot is extremely narrow,
(2) the current septic drain field must be avoided when the proposed
garage is constructed,
(3)a septic reserve area must also be avoided by the proposed family
room.
(1) Narrow, Tapered Lot.
Since Madrona Morningside was platted on a point of Hood Canal,some pie-
shaped lots were required. Of the 36 original "50 ft" beachfront lots, four were
tapered to 30 ft on the landward side. Ours is one of these. (The other three lots
have since been combined with another or reproportioned.) Since our 50 ft.
measurement is on the beach and at an angle, the useable shoreline itself is only
about 44 feet long.
(2) Drain Field.
In 1983, a new septic system was installed. It incorporated a holding tank
with pump at the house and a septic tank/drainfield as far from the shoreline as
possible(160 ft)without encroaching within 100 ft of a community well. The system
was ahead of its time and works very well. It was approved in a 1996 inspection by
the Lower Hood Canal Clean Water District.
(3) Septic Reserve.
The only location for a septic reserve is to the south of the current drain field.
The good news here is that the soil has a very good draining character. We need
keep as much land as possible available for future requirements of the Lower Hood
Canal Clean Water District, County and State.

14.08.180 UBC Section 503.1 Building Setbacks Is adopted and amended by adding a new sentance: 'Ali
structures greater than 30"in height shall be set back five(5)feet or more from any easement or property line from
the closest projection and ten(10)feet from any county and state road right-of-way. Any proposed structure within
twenty-five(25)feet of a county road right-of-way shall be subject to Public Works review and comment.
A variance may be granted to said line If a hardship can be demonstrated and the adjacent property owner has no
objection and is willing to encumber the deed to his/her property. This document must be recorded with the Auditor
of Mason County.
