Dear Applicant: As part of this department's review of your permit application, a Shoreline Inspection (SPI)was performed on your property. Below you will find comments made regarding the proposed development and its critical values. In some cases, setbacks for development from shorelines, steep slopes, streams, and wetlands must be included in your specific proposal;these setbacks are included as part of the comments listed below. This information is based on County and State regulations as they exist to date. These regulations may change and may affect the requirements for development of the subject property. Sincerely, Rick Mraz Land Use Planner Mason County Planning Department 4/23/2002 1 of 3 SP12002-00036 Shoreline Inspection 4/23/2002 Case No.: SP12002-00036 Comments: A field inspection of the subject property was conducted on 4/17/02 to consider regulations affecting a proposed remodel of an existing residence and garage. The parcel is a steeply sloping lot located along North Shore Road and contains frontage on Hood Canal. The proposal is to conduct a remodel and addition of the landward portion of the home and reconstruct and reposition the existing garage. Expansion of structure along the shoreline must conform with a derivation of the common line principle that protects view corridors for adjacent residences. A sketch is enclosed that describes the cone of permittable expansion that is created by this common line principle. Only the eastern side of the residence need conform to this setback concept. The view corridor of the adjacent western residence is not affected by expansion proposals that meet the current (and required) shoreline setback for the existing home. Expansion on this side of the house may extend to the most waterward part of the existing home, not including the deck. Due to the steep slope along the extent of the property, any changes in footprint to existing structures shall require a geotechnical report per the provisions of the Mason County Resource Ordinance. Enclosed is a copy of the Landslide Hazard Areas chapter of the Resource Ordinance. Please note the distinction between a geologic assessment and a geotechnical report. This project will require a geotechnical report. The report must state that the hazards of the landslide area can be overcome in such a manner as to prevent harm to property and public health and safety, and must also assure the project will cause no significant environmental impact. Expansion of the landward portion of the home may encroach into the required 25' setback from the Right of Way (ROW) for North Shore Road. Encroachment into this setback will require a variance from the Mason County Development Regulations. A variance application and a pertinent excerpt from the Development Regulations is enclosed for your convenience. Please note that a proposal must meet all variance criteria for approval. Any reconstruction of the garage that involves a change in footprint must also be addressed through the variance procedure. Pursuant to ammendments to the Mason County Resource Ordinance, significant changes to shoreline regulations are 4/23/2002 2 of 3 SP12002-00036 Shoreline Inspection 4/23/2002 Case No.: SP12002-00036 scheduled to be enacted on June 1, 2002. If the proposal does not receive the necessary Development Regulations variance by this date then a variance from the Fish and Wildlife Habitat Conservation Areas chapter may also be necessary to pursue the project. A Habitat Management Plan (HMP), prepared by a qualified biologist, would be required to support the variance request. The HMP addresses impacts to the buffer and offers measures to preserve and protect the buffer or mitigate impacts. A copy of the Fish and Wildlife Habitat Conservation Areas chapter is enclosed. It includes details on the contents of an HMP. It also contains information about that variance procedure. The timetable for completion of a Development Regulations variance request, which includes public notice requirements, Planning Commission and County Commissioners Hearings is very tight. Planning staff cannot guarantee that the variance request will be heard and finalized prior to the June 1 deadline. Copies of this determination are being sent to the applicant and the contractor, Steve Boad. Only Mr. Boad is receiving the regulations and application.
