Thank you for the opportunity to comment on the mitigated determination of nonsignificance for the
proposed construction of a pier ramp and float structure along the southern shoreline of the Hood Canal,
located at 8333 East State Route 106,Union,as proposed by John Herzog. We reviewed the
environmental checklist and have the following comments:
Water Ouality
Erosion control measures must be in place prior to any clearing,grading,or construction. These control
measures must be effective to prevent soil from being carried into surface water by stormwater runoff.
Sand, silt,and soil will damage aquatic habitat and are considered pollutants.
Any discharge of sediment-laden runoff or other pollutants to waters of the state is in violation of Chapter
90.48,Water Pollution Control, and WAC 173-201A,Water Quality Standards for Surface Waters of the
State of Washington, and is subject to enforcement action.
The applicant should consider alternatives to creosote treated wood or other chemically treated wood for
in-water construction of wooden structures. Over time,treated wood may contaminate nearby sediment
and cause toxicity for aquatic organisms. Enclosed is a fact sheet with more information.
Federal Permit
A water quality certification may be required from the Department of Ecology in conjunction with the
U.S.Army Corps of Engineers'permit for this project.
